1. Our agreement with you

1.1 As a customer of CM Dance these terms & conditions form the basis of your agreement with CM Dance Studio.

​1.2 CM Dance agreements with you also include your enrolment form, which you complete and provide to CM Dance. You also agree to update your enrolment as you or your child’s information changes.

​1.3 You agree to adhere to CM Dance policies, procedures and code of conduct as stated in the CM Dance Studio Handbook.

​1.4 Participation in the Annual Concert at the end of the year is expected of all students.

​1.5 Any timetabled class having four or fewer students enrolled may be cancelled at the discretion of the Director.

 

2. Refunds, Discounts and Credits

2.1 Upon enrolment, you will be invoiced a $30.00 non-refundable enrolment fee, which must be paid within 5 days of invoice.

​2.2 No refunds, discounts or credits are given for missed classes for any reasons while the student is enrolled. Students may make up missed classes per term, subject to availability, within the same term as the missed class. (Exception: when a medical certificate is supplied or at the discretion of the Director.) Credit for any missed classes during the period stated on the medical certificate will be held over to the following term's invoice. 

​2.3 Students are enrolled for one whole school year, running with local school terms. If you wish to withdraw your child from dance, the Director must be notified either in writing (text message not permitted) via email. Failing to attend class is not regarded as cancellation of enrolment and you will still be invoiced for classes missed prior to exit notification.​

​2.4 Credits will be provided in the case of the Director cancelling any classes. Additional classes will no longer be provided.

2.5 Any classes that fall on a public holiday will not be refunded. However, students are invited to participate in a make-up class in any genre to cover that date. Please contact CM Dance to organise the make-up class.

2.6 Pro Rata is only given to new students who start late in a term, not for being absent due to illness or injury during the term.

2.7 Extended holidays (2 weeks or more) – please provide at least one month’s forward notice so that pro rata can be applied to your term fee.

2.8 Multi-class discounts will be applied from the 3rd class based on the total number of classes on the invoice across all students in the family. Class packages do not apply.

​2.9 All invoices are sent via email.

2.10 All payments must be paid via Class Manager Parent Portal or EFTPOS.

3. Class Procedure

3.1 CM Dance requests that small children are taken to the toilet before their class commences to avoid disruption during class.

​3.2 Please be punctual on arrival and ensure your child is collected on time.

3.3 Students must adhere to the Studio’s class uniform requirements.

​3.3 For CM Dance to maintain a positive teaching environment, classes during the term are closed to all visitors unless otherwise booked in with the Director.

3.4 Parents are not permitted inside the dance room for any reason.
Exceptions may be made for very young dancers who need brief support while settling in, at the teacher’s discretion.

​3.5 During Open Days, we ask that all mobile phones be switched off and put away.
To protect the privacy and comfort of all dancers, photography is not allowed inside the dance room (CM Dance staff excepted).

​3.5 Zero Tolerance Policy: Families engaging in gossip or negative behaviour will be asked to leave the studio with no refund of monies. 

3.6 Students should not bring valuables to the studio. CM Dance is not responsible for lost or stolen items.

3.7 Respect for one another in the classroom is paramount.

 

4. Costs

4.1 Fees will be paid by the due date of each term.

​4.2 Fees are distributed via e-mail on the second last week of the previous term in Terms 2, 3 and 4, and upon enrolment in Term 1. 

​4.3 Payment for tuition is to be made via Class Manager Parent Portal. 

4.4 If you require a Payment Plan please contact the Director. A 2% administration fee will be added to any payment plans.

4.5 Any fees not paid by the due date will incur a 5% late fee on the original cost each week after the due date until paid in full.

​​4.6 Students are invited to participate in exams, performance teams & annual concerts all of which will incur additional charges including but not limited to; exam/test fees, formal uniform purchase, extra rehearsal fees, costume purchase, concert ticket purchase, Concert Package purchase, photography purchase,etc. The Studio provides plenty of information to enable you to make an informed decision as to whether to participate.

​4.7 CM Dance reserves the right to cancel or change the timetable and price structure at any point in time.

​4.8 Costume fees and Concert Package will be added to the Term 4 invoice.

 

5. Communications

5.1 CM Dance will communicate with you primarily by BAND and email. CM Dance will not provide your details to any other company, entity or organisation unless consented to by you and all other information will be kept private by the Studio in accordance with the Privacy Act.

5.2 All notices, events and other information will be posted on BAND. Parents must sign into BAND upon enrolment. ​

5.3 CM Dance will use its best endeavours to ensure that all communications are virus-free, however, CM Dance is not responsible for any loss or damage suffered by you in the event that a virus or like issue is transmitted unknowingly by CM Dance.

​5.4 Parents/carers should not contact class teachers. All communication should go through the Director or Studio Manager.

5.5 Notify the studio of absences via BAND public or private chat.

 

6. Working with Children

6.1 All Staff, Teachers, Assistant Teachers and Volunteers of the Studio have a valid Working With Children Check as required by relevant legislation.

6.2 All Staff, Teacher and Assistant Teachers of the Studio will have current CPR and First Aid training.

 

7. Limit of Liability

7.1 CM Dance does not exclude or limit –

(a) The application of any provision of any statute (including the Trade Practices Act 1974) were to do so would contravene that statute or cause any part of this clause 7 to be void;

​(b) All care according to the “Code of Ethics of Dance Teachers” will be taken by, but no responsibility for injury or loss to person or property howsoever caused and without limiting the generality of the aforegoing damage or injury resulting from or caused by any negligence of the Director, teachers or other employees of CM Dance.

​7.2 If students are injured/ill for any length of time, a certificate from a medical professional needs to be obtained before your child is able to participate in class again. Students are encouraged to still attend class and watch.

 

8. Consent

8.1 Your child’s enrolment in CM Dance classes and events is voluntary and participation in class and activities involved in all classes on offer can involve risk of personal injury, including but not limited to muscle strains, sprain and falls and you freely assume these risks for your child/ren as outlined in clause 7. The participant will immediately fully inform each teacher of any physical difficulties or injuries that occur before or during class.

​8.2 Where the participant may require medical assistance, CM Dance has permission to seek First Aid or medical attention.

​8.3 The Teacher or Teaching Assistant may have to assist your child’s understanding of action, posture or position by physical contact e.g. holding hands in a circle; lifting; correcting posture or alignment, etc. You consent to Teachers and Assistant Teachers of CM Dance having contact with your child in this regard.

 8.4 You consent to Staff, Teachers, and Assistant Teachers of CM Dance in escorting your child to the toilet during class if your child requires.

​8.5 Images, footage and audio recordings of your child are permitted to be used by the Studio for Studio promotional purposes. If you do not wish your child to appear in any CM Dance promotional material, you may opt out through the parent portal AND by contacting CM Dance via email.

 

 

9 Competitions and Exams

9.1 Tuition fees must be up-to-date for competition and exam entries to be processed.

9.2 Competition and exam entry fees must be paid at the time of confirming entries.

9.2 Students must only purchase solo costumes meeting the standards and approval of the teachers and Studio.

9.3 Teachers will attend competitions when possible, to support dancers. Competition dancers should prepare to warm up and perform independently if necessary.

9.4  Students must wear CM Dance uniform attire on arrival and departure from competitions and exams.

9.5 Parents should encourage a healthy competitive attitude, avoiding jealousy among students. Families are expected to model this behaviour.
