1. Introduction

These Terms and Conditions ("Terms") govern your use of our dance studio services and website. By enrolling in classes, making a booking, or using our website, you agree to be bound by these Terms. These Terms are subject to New Zealand law, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.

2. Class Enrolment and Bookings

2.1 Booking Process

All class bookings must be made through our website

A booking is confirmed once payment has been received and processed

You will receive email confirmation of your booking

2.2 Age and Eligibility

Students must meet the age and skill level requirements for their chosen class

Participants under 16 years must have parental or guardian consent

2.3 Class Availability

Classes are subject to availability and minimum enrolment numbers

We reserve the right to cancel or reschedule classes with reasonable notice

3. Fees and Payments

3.1 Pricing

All prices are displayed in New Zealand Dollars (NZD) and exclude GST where applicable

Prices are subject to change at any time without prior notice

Price changes will not affect bookings already confirmed and paid for

3.2 Payment Terms

Full payment is required (or otherwise agreed) on the first class of the term

We accept payment methods as displayed on our website

All payments are processed securely through our payment gateway

3.3 Refunds and Cancellations

Cancellations made more than 48 hours before a scheduled class may receive a credit or refund at our discretion

Cancellations made within 48 hours of a class are non-refundable

No refunds will be given for missed classes or partial term attendance

In the event we cancel a class, you will receive a full refund or credit

4. Studio Policies

4.1 Attendance

Students should arrive 10 minutes before class begins

Regular attendance is encouraged for skill development

4.2 Conduct

All students must behave respectfully towards instructors, staff, and other students

Appropriate dancewear and footwear must be worn as specified for each class type

We reserve the right to remove any student whose conduct is disruptive or inappropriate

4.3 Health and Safety

Students must inform us of any medical conditions, injuries, or physical limitations

Students participate in classes at their own risk

We maintain public liability insurance, but students are encouraged to have their own personal accident insurance

Parents/guardians must remain on premises or be contactable during classes for students under 12 years

5. Photography and Videography

5.1 Image Consent

By enrolling, you consent to the studio photographing and videoing classes, performances, and events

These images may be used for promotional purposes including our website, social media, marketing materials, and print advertising

5.2 Copyright

All photographs and videos taken by the studio or its representatives remain the property of the studio

Images may not be reproduced, distributed, or used commercially without written permission

5.3 Opting Out

If you do not wish for you or your child to be photographed or filmed, you must notify us in writing

We will make reasonable efforts to exclude non-consenting individuals from promotional materials

Please note that it may not always be possible to avoid incidental capture in group settings

5.4 Student Photography

Personal photography or video recording of classes by students or parents is not permitted without prior written consent

This policy protects the privacy of all students and the studio's intellectual property

6. Intellectual Property

6.1 Choreography and Class Content

All choreography, class routines, teaching methods, and materials are the intellectual property of the studio and its instructors

These may not be reproduced, recorded, taught, or performed elsewhere without written permission

6.2 Website Content

All content on our website, including text, images, logos, and design, is protected by copyright

Content may not be copied, reproduced, or distributed without permission

7. Liability and Indemnity

7.1 Limitation of Liability

While we take all reasonable care, we are not liable for personal injury, loss, or damage to property except where caused by our negligence

Students participate in classes at their own risk

Nothing in these Terms excludes or limits liability that cannot be excluded under New Zealand law, including liability under the Consumer Guarantees Act 1993

7.2 Indemnity

You agree to indemnify the studio against any claims, losses, or damages arising from your breach of these Terms or misconduct

8. Privacy

8.1 Information Collection

We collect and store personal information in accordance with the Privacy Act 2020

Information is used for class administration, communication, and marketing purposes

We will not share your information with third parties without consent, except as required by law

8.2 Marketing

You may opt out of marketing communications at any time by contacting us or using the unsubscribe function in emails

9. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on our website with an updated effective date. Continued use of our services after changes constitutes acceptance of the modified Terms.

10. Governing Law

These Terms are governed by New Zealand law. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
