Theative Performing Arts Terms and Conditions/Contract of Enrolment

PLEASE ENSURE YOU HAVE READ AND FULLY UNDERSTAND THESE POLICIES BEFORE SIGNING.
We reserve the right to update these terms and conditions at any time, with notice. If you decide to opt-out of any changes/updates, you must inform us so that we can process a withdrawal for you. If we do not hear from you within seven days of our update notice to opt-out, this will be taken as confirmation that you are in agreement with the updated terms regardless of whether a new signature was provided.
1. Enrolments, Fees and Payments
Enrolments
All enrolments are confirmed upon receipt of enrolment confirmation email after the trial period and are subject to all of the Terms and Conditions (also referred to as the Enrollment Contract) outlined in this document.
Enrolments season to season (i.e. from the end of the current season in mid-July to the start of the new season in September) are automatic unless we receive the required written notice via email and purchase of the cancellation fee in the school shop.
If you do not inform us of your wish to withdraw for the following season by the stipulated deadline (usually 4 to 6 weeks before the end of the current season) we require the Cancellation Fee for the relevant number of classes to be paid.
All new students must pay the enrollment fee.
All returning students (non-continuous enrolments) must pay a re-enrolment fee of £50 and must make sure that the correct uniform for their new class has been purchased from our school shop. Non-continuous enrollment is any instance where notification of withdrawal from regular classes has been received, and a pupil has been withdrawn from our active database or withdrawn from classes without notice (extended absence without confirmation or response).
Lesson fees for students joining mid-season are prorated.
We do not offer drop-in, ad hoc, or pay-as-you-go lessons for regular termly classes.
If you need to swap your child to a different class, please contact us, and we will accommodate them in any class with available places. If you would like to transfer into a currently full class, we will add your child to the waiting list and swap as a place becomes available. If you cannot wait to swap, a withdrawal as outlined in this document will be processed instead until a place in the desired class is available, when you can re-enrol. In this instance, we will deduct any applicable percentage of the previously paid cancellation fees from your new re-enrolment invoice and waive the re-enrolment fee.
Enrollments are non-transferable.
In parent & child or assisted classes (ages 18 months - 3 years), we understand that childcare needs mean that younger/older siblings may be brought to the lesson. If non-enrolled siblings or friends are to come to class, they must be enrolled to join in and participate in the lesson. If siblings (or other children) come to class and join in, the customer will be invoiced for their lesson.
When registrations open for the new season, priority class places are given to customers who inform us of their class choices by email or booking directly through the customer portal by the required deadline. If we do not hear from you to confirm class choice or to withdraw, enrolment into a class with available places will be assigned for you, based on your child's current age and enrolments.
Blocks of classes are available only for our adult classes. Class blocks must be paid for in full in advance, and the students will receive a number of consecutive weekly lessons. Block bookings can make up lessons in any other class of the same level with available space before the expiry date of their class block. After the block is finished, pupils can book into another block or join the season enrollment if they would like to continue. We do not offer refunds on class blocks.
Non-Compete
Theative pupils are not allowed to attend other dance/performing arts schools or organisations, studying any style we offer (ballet, modern/jazz, tap, acrobatics, musical theatre).
This policy is to ensure the pupil's safety and the integrity of their training and that pupils are not becoming confused or hindered by conflicting curriculums and teaching methods.
Any additional training taken elsewhere must be at the discretion of the Theative Performing Arts principal or teachers to ensure that our pupils are always receiving a high-quality education.
Any pupils found to be studying with any other dance school or organisation without Theative Performing Arts knowledge or permission risk immediate dismissal without refund.
If your child is already enrolled in another school offering the same classes, we require written permission from their current dance/performing arts teacher, acknowledging and allowing their participation in our lessons and giving details of their professional qualifications and memberships, and Vice Versa.
Fees & InvoiceS
Fees can be paid in full via Credit/Debit Card. We also offer a monthly payment plan via credit/debit card.
All fees are subject to increase, and we reserve the right to do so without notice.
Class fees are based on a rolling 12-month/ season membership, September to August. If you would like to withdraw from enrollment before the end of the year season, you may give 6 class weeks' notice. NOTE: Class weeks are weeks in the season when lessons are running. If your notice date is near a school holiday or class break, those weeks where classes are not running are not counted in your notice period.
A termination fee for early withdrawal must be PURCHASED from our online shop or it will be charged to your direct debit or card. Once we receive your cancellation fee and email notifying us of withdrawal, we will amend your invoice and any final payments to cover fees up to the end of the notice period..
Withdrawals are not accepted within the first 12 class weeks of enrollment.
Failed payments that were not completed by the automated monthly AutoPay will be charged plus a 5% admin fee.
Invoices or payments that become overdue without any form of communication from the customer will incur a late payment fee of £10 per week until paid. Late payment fees are applied on the 1st day the invoice/payment becomes overdue, then on the first day of each consecutive week until the invoice is paid. If your balance has still not been settled and you refuse to respond to us, we reserve the right to pursue action via debt collection services and/or other legal entities. This applies to all invoices issued. We are entitled to pursue debts for a period of 6 years.
If any payment or invoice becomes overdue, we reserve the right to refuse entry into the class. In these instances, the pupil will not be allowed to participate in any part of their class until the customer’s balance has been paid in full.
Any Direct Debit payments that have been cancelled by the customer without informing us first or following our withdrawal procedure will be forwarded to our solicitors/debt collection agency for the amount of any classes not already covered by your past monthly payments, plus 6 weeks of classes in lieu of notice, plus any late payment fees that accrue as a result of non-payment and non-response to any attempted contact, plus legal fees and interest. If we need to initiate a claim against debt for unpaid fees, in addition to the outstanding amount owed (including late fees), you will also be liable to pay our legal costs plus any interest accrued at the Bank of England base rate of 8%.
Exam fees must be paid in full by their due date to ensure pupils can be entered into their exam. Exam fees are non-refundable. You can find out more about RAD, ISTD and Acrobatic Arts exam fees on their respective websites.
Performance/recital fees must be paid in full by their due date to ensure that your child can participate in our Performances.
Performance/recital fees are non-refundable.
Penalty (reblocking) fees will apply for any child who withdraws from a performance or competition once their place has been confirmed and/or rehearsals have begun.
If you have extenuating circumstances and need additional time to settle your invoice or balance, please contact us first to discuss the possibility of a delayed or segmented payment plan.
Payments
Customers must provide their CREDIT/DEBIT CARD details in the customer portal/online registration system to set up their Direct Debit payments and a backup credit card.
We do not accept cash, cheques or bank transfers.
Confirmation receipts are usually emailed automatically on invoices paid in full. Please contact us if you do not receive a receipt within 7 days of settling the total amount of your invoice.
Where a customer has accrued credit on their customer profile from referrals, overpayments or any other reason, the customer forfeits any such credit in the event of a withdrawal.
Credits accrued from referrals, cancelled classes, overpayments or any other reason are not able to be held or transferred beyond the consecutive season or transferred to another customer.
Customers are invoiced for the entire season (prorated for mid-season enrollees). The invoice is then set to pay off in monthly instalments via Autopay. Each season has 11 total monthly payment instalments from September to July.
The payment schedule is on a set day (usually the 1st of each month, or just before).
Enrollment Cancellation
If you confirm your intention to enrol after the initial taster class(es) but then decide to cancel once an invoice has already been issued or payment has been set up, an inconvenience fee of £25 will be due. This is an administration fee to go towards the time taken to prepare enrollment information, forms, invoices, welcome pack and any uniform that may have been prepared for the enrollee.
Refunds
Theative Performing Arts operates a no-refund policy. All payments are final.
Refunds for missed classes or withdrawals with remaining classes are not given.
Refunds for remaining classes resulting from expulsion are not given.
If the customer withdraws or is expelled from enrollment and is paying via our monthly payment plan, the full balance of the invoice is still due (as per section 2. c . iii.).
We do not accept uniform returns on any uniform items that have been opened, worn, washed or where the packaging has been thrown away.
Any uniform items that are faulty can be returned for exchange.
Force Majeure
In the event of Force Majeure, such as flood, earthquake, fire, extreme weather conditions, epidemics, pandemics, war, terrorism, government advice or any other event outside of our control, where our efforts to maintain delivering classes in another medium are not possible, customers will:
Either, Be able to freeze enrollment at a rate of 30% of your normal monthly fees. This will ensure you still have access to our community Facebook Group and any extra content we post there as well as holding your place in the class for when normal classes resume.
Or; Withdraw as per our normal termination policy.
If we are able to continue providing classes in another way (i.e. converting in-person classes to online classes) no refund is offered.
2. Prices
Prices
Price per month is dependent on the number of classes enrolled in each week and the number of weekly lessons remaining in the season, divided by the number of months or monthly payments remaining in the season.
Monthly cost may vary where there are certain venues that may not be running classes on certain dates, or the start date of enrollment and how many monthly payments are left.
Prices are reviewed and amended accordingly before the start of the following academic year.
Price increases may be caused by a number of reasons, including but not limited to: running costs, staff costs, investment in and upkeep of equipment, cost of living, and inflation.
3. Discounts and Deductions
Discounts
Discounts are available for multiple class enrolments and are tiered depending on the number of classes taken per week.
Lesson fees for each additional sibling are charged -10%.
Sibling discounts do not apply to enrolment fees, exam fees, uniforms, performance/recital fees, competition fees, event fees, workshop fees or holiday camp fees.
Any discounts are offered at our discretion, and we reserve the right to discontinue them at any time.
Discounts/credits are also awarded on regular term fees for successful referrals.
Deductions
In the event of student absence for any reason, deductions on term fees are not given.
In the unlikely event of a cancelled class which cannot be rearranged, either at the end of the current term or added to the following term, your customer profile will be credited with the amount of the cancelled class.
4. Attendances, Absences & Withdrawals
Attendance, Absence & Replacement Classes
Due to the nature of some of our venues and their security policies, all students are required to be on time for class. We recommend arriving at the relevant venue for your child's class a minimum of 5-10 minutes before the start time of their class so that they have time to get changed, use the toilet, have a snack, etc.
Children who arrive more than 5 minutes after the start time of their lesson may not be allowed to participate.
If a student misses a lesson it is the parent's responsibility to book replacement classes by emailing the school office.
Other than a small pre-arranged discount (see point ix), we do not offer refunds or deductions for missed classes for any reason. Instead, replacement or ‘make up’ classes can be booked at any alternative class of the same level/age-group with available space. Missed recreational classes can not be made up in exam classes.
If there are certain days that you know your child will miss their lesson, absence and make-up classes can be notified and booked in advance by emailing the school office.
Each pupil can book a maximum of 2 replacement classes per term (except during show terms). Replacement classes cannot be transferred to the next term and cannot be booked during Watching Week.
Make-up classes can not be booked once choreography, preparations and rehearsals for our Performance have begun, as each class will be rehearsing different numbers and choreography.
We would like to emphasise the importance of consistent attendance. It is incredibly important not only for instilling qualities of commitment and discipline required for consistent improvement, but it is also needed for helping build good social bonds between classmates, teammates and their teachers, ensuring children remain engaged and having fun in the lessons, as well as ensuring the most value for money.
Exam Class Attendance
Pupils must attend 95% of their required classes to be able to enter their exams. This is to ensure that pupils meet the required learning hours to be able to participate in the exam feeling happy and confident and so that it is an enjoyable experience for them.
If this attendance benchmark is not met, we may not be able to enter the pupil in the planned exam session unless private lessons are booked to make up.
Exam pupils are required to attend an Exam Boost class which will take place during the holidays/half term before the planned exam session.
Children wishing to continue taking exams from Grade 3 and up must attend two classes per week.
Withdrawal
If you do not wish to continue your child's enrolment, 6 weeks of written notice via email plus purchase of an enrollment cancellation in the school shop is required.
Withdrawal is not accepted within the first 12 class weeks of enrollment.
Class enrollment is based on a rolling 12-month membership period from September to August. Any withdrawals before the end of the current year season must purchase the early withdrawal/cancellation fee in our online shop, your payment plan and invoice will then be amended to reflect classes up until the end of your notice period.
If you would then like re-enrol once you have already withdrawn, subject to available class places, your monthly payment will be reinstated for the full amount, plus a £50 enrollment fee.
If you withdraw enrollment without notice, cancel your auto-payments without informing us and refuse to respond to invoice reminders or other correspondence from us, we reserve the right to refer the matter to debt collection services and/or other legal entities.
Enrollment season to season (July-September) is continuous. To withdraw and give notice before the next season, you must give the required written notice and purchase an enrollment cancellation from the school shop..
5. Uniform and Grooming
Uniform
All students are required to wear the correct uniform for every class.
Please make sure that your child's uniform fits them properly, is clean and in good repair.
New uniform items can be ordered via the online order form, which is linked at the top of the ‘Customer Portal’ page on our website. Please note uniforms cannot be ordered from inside the customer portal.
New uniforms must be paid for in full before they can be collected and cannot be returned once they have been worn.
All Early Years (3-5y), Pre P/Primary (4-7y) and Junior (7-10y) dancers are required to wear proper, leather, full soled, soft ballet shoes with elastic straps fitted for ballet class. We do not recommend that dancers under 12 years wear split-soled ballet shoes as they do not provide the correct support or resistance for young, developing feet.
Ballet shoes are required to fit snugly like socks, without either being too tight, squashing the toes or curling them under and likewise should not be baggy with any surplus space at the toe. This is to reduce the risk of injury so that teachers can see correct alignment, weight placement and stretch of the feet, and provide a sensory element for dancers to feel the floor through the shoes. If you wish to purchase dance shoes elsewhere, please make sure that they are manufactured by a reputable dancewear brand (Capezio, Bloch, Roche Valley, Katz, etc) and that they have been properly fit at a specialist dancewear shop. Please do not buy your child “ballet shoes” from high street shops or supermarkets (ie Decathlon, Sainsbury's, H&M, etc).
VERY IMPORTANT NOTE REGARDING POINTE SHOES: Pointe shoes are specialist dance equipment and require dancers to have achieved certain criteria before they can safely be worn and danced in. Dancers under the age of 13 years are NOT UNDER ANY CIRCUMSTANCES PERMITTED to wear pointe shoes or to dance en pointe either in class or at home. Dancers who wish to train en pointe must meet the following criteria:
Be at least 13 years of age (guide) but more importantly be anatomically prepared and suited to engage in pointework. i.e. fully developed bones in the legs, ankles and feet as well as the required flexibility and strength.
Have completed ballet training to a high standard, attending a minimum of 2 ballet classes per week, continuously, for a minimum period of 4 years.
Have completed the pre-pointe training programme.
Have strong technique, core and body awareness. i.e. suitable flexibility, strength and control.
Have been assessed and signed off by our Physiotherapist, and to have been properly fit by an experienced, specialist pointe shoe provider, in the presence of the school principal or other designated teacher. Please do not purchase pointe shoes online, or from high-street/sportswear stores.
Uniforms are vital to the pupil’s development and improvement as they:
Reduce distractions so that students are able to focus on their lessons.
Minimise the risk of injury.
Promote a sense of belonging and connectedness, which is an important facet in helping to develop children's social skills.
Eliminates bullying.
Enable teachers to more accurately assess and gauge student progress and performance.
Help to develop artistry skills, by reducing reliance on distracting apparel.
Are cost-effective.
Our uniform is specially selected, specialist clothing and footwear and is required to participate in our classes. This is the same for any other specialised activities such as football, martial arts, gymnastics or horse riding.
Please also note that our logo is copyrighted. We do not allow anyone to reproduce our logo or branding or to use it in any of their own designs or clothing production.
Grooming for class.
Please ensure dancers attend class with appropriately styled hair: tied up neatly and secured off the face and neck. No free-flowing hairstyles.
Please ensure that dancers do not wear jewellery for class (including fitness trackers/watches). Stud earrings may be worn in pierced ears.
Students may wear the appropriate uniform warm-up items (Theative branded ballet wrap, base layer top, onesie or hoodie) for the start of class which the teacher will instruct them to remove at the appropriate time.
It is standard grooming practice not to wear any undergarments beneath dancewear for improved aesthetics. For regular class, we ask that dancers do not wear vests/t-shirts or visible underwear beneath their leotards as this can interfere with teachers' assessment of posture and alignment.
We believe in un-gendered clothing and students may wear whichever uniform they feel more comfortable in (ie designated male/male-identified students are welcome to wear 'traditionally feminine' uniform and vice versa). We operate a zero-tolerance policy on discrimination against students who choose to express their gender in non-binary/non-traditional ways.
Exam Grooming and Uniform
Dancers who are participating in exams must make sure that they:
Wear the correct uniform, in the correct colour and which has been embellished with our school insignia.
Uniform items are clean, properly fitting and in good repair.
If the class uniform is not up to par, customers will be required to purchase new uniform items for exams.
Socks/tights and shoes especially must be in impeccable condition for exam day. Please make sure new socks/tights have been purchased and that shoes have been cleaned.
If a dancer arrives at the exam without a suitable uniform, your child may be required to use new items for which you will be invoiced.
Have their hair styled neatly and correctly.
Remove all jewellery.
Remove all temporary tattoos, nail varnish, and colourful hair wraps/beads.
6. Exams
We are qualified and registered to provide preparation for ballet exams under the Royal Academy of Dance (RAD), modern and tap exams under the Imperial Society of Teachers of Dancing (ISTD) and acrobatics exams under the Acrobatic Arts. You can find details of exam fees on their respective websites.
Exam fees must be paid in full by their due date to ensure pupils can be entered into their exam. Exam fees are non-refundable.
Please see section 5. b. for more information about the required attendance to participate in exams.
Please see section 6. c. for more information about the required uniform and grooming for exams.
Exams will be held at the Royal Academy of Dance HQ in Battersea and a London Centre designated by the ISTD or at one of our venues. Children may be required to miss a portion of their school day to participate, and we can provide official letters to inform schools of the reason for absence.
We expect once-per-week pupils to take around 18 months or 4 to 5 terms of preparation to be ready for an exam. Pupils who attend more than once per week may be able to progress through their grades more quickly.
We add a £5 admin fee to every exam entry to help cover the cost of time to organise and submit entries and cover any processing fees incurred.
Exam Boost
All pupils wishing to be entered for their dance exams must attend an Exam Boost for each style/grade they are to be entered for.
Exam Boost will be held during the holidays/half term before the exam session and will consist of small group coaching, mock exam and feedback.
Exam Boost cost, venue and dates will be confirmed closer to the time and will depend on the exam's discipline (style), length of time for each exam group and venue.
7. Performance/Recital
A pupil’s place in the recital/performance will be confirmed once the performance/recital fee has been paid in full. Recital fees, ticket fees and any other costs associated with the production of the performance are non-refundable.
Participating in our Performance requires a strong commitment from our pupils and their parents and supporting family members. It is absolutely vital that children learn the value of keeping commitments, being good team members, not letting their friends and teachers down and developing skills such as consistency, working towards a goal, working towards something bigger than themselves, personal achievement, resilience, patience, valuing their hard work and the hard work of others, overcoming nerves, gratitude and of course building their self-confidence. Commitment to the performance and any mandatory rehearsals must take priority over other clubs/classes, parties, outings, etc. Please make sure that you make a note of ALL relevant dates and make alternative arrangements where necessary.
Pupils participating in the Performance are required to attend a minimum of 85% of their classes during the Performance Preparation term (2 or 3 missed classes total), unless private lessons are booked to catch up. This is to ensure that pupils are confident, happy and well prepared as well as being good team members. Make-up classes are not allowed during Performance Preparation terms.
Pupils participating in the Performance are required to attend the whole school rehearsal, which will be arranged for a date very close to the Performance date. Any child who misses these imperative rehearsals may be removed from the Performance and parents may have to pay a reblocking fee.
Any Theative Family Members who enable pupils to disregard their commitment to the performance and their team-mates, will be liable to pay a reblocking fee.
Reblocking fees (per number) for withdrawal from the performance after a pupil has been confirmed as participating, including if a pupil is removed as a result of missing required rehearsals (this is to reflect the upheaval and extra work that would be required by other pupils, teachers and other staff) are as follows:
9-12 weeks prior to the show - £20
7-9 weeks prior to the show - £30
4-6 weeks prior to the show - £40
1-3 weeks prior to the show - £50
Missing required rehearsals - £60
Reblocking fees are subject to the same terms as any other invoice/payment.
Theative Family Members must read and make a note of the relevant information in the Performance Information Packs. If you are unsure of any details pertaining to the Performance, please check your information pack first before contacting the school office.
Pupils must remove all nail varnish, false nails, temporary tattoos and jewellery for the dress rehearsal and performance.
8. Communication Policies
Correspondence
It is extremely important that we cultivate effective communication with all our Theative Family Members. As such, all Customers should read our correspondence in a timely fashion so that they do not miss out on important updates and announcements, and so that any resulting queries and questions can be properly responded to.
All important correspondence (newsletters, term dates, deadlines, invoices, etc) will be sent via email and we do not accept liability for missed deadlines in regards to notice, payments, term dates, cancelled/replacement classes, or any other matter in the event that customers have not read their email or made note of relevant information, or not provided us with the correct contact information.
Please make sure you opt-in to be added to our Enrolled Mailing List, at the very least, as this is where we send most of our updates from.
We also post important notices on signs/notice boards in each venue, via WhatsApp, and in the our closed Facebook Group.
It is imperative that all parents provide us with up to date contact information, including email address, mobile phone number, and home address.
To avoid our messages being labelled as spam and being filtered into your junk email folder, please make sure that you have added both [email protected] and [email protected] to your email contacts, mark any emails you receive from us as 'not spam', and read/respond.
Do not contact any of our teachers or staff members via their personal email, phone, SMS, social media, or in-person outside of class times for any reason. All enquiries must be sent to our school office via our official channels.
Social Media
We are committed to maintaining a professional environment and relationships with our Students and Theative Family Members. Please do not follow, friend, or contact our staff via their personal social media profiles.
If one of our staff members (not including our official Social Media Profiles) has followed you on any social media platform, please notify the school office immediately.
If you have any questions or enquiries you may contact the school office via email, phone, or via the inbox on our Official Facebook Page. We aim to respond to all messages within 3 working days.
Please be aware that for all bulk emails regarding important information (sent via our ThinkSmart Software app or Mailchimp) and all emails sent from our Gmail email, we are able to view subscriber reports to see if our emails have been read. For individual emails of import, we may request a read receipt.
Parents and Students are not under any circumstances allowed to post online any video footage, photographs, or sound recordings from Theative Performing Arts lessons or performances. This is without exception.
9. Publicity Policies
Photography/Filming by Customers
Photography and filming of our main lessons and performances by parents/guardians are not allowed under any circumstances.
Filming for private use may be allowed in private lessons (i.e. for practice purposes) but may not be shared.
Unfortunately, photography/filming during watching week is not permitted. This is due to GDPR, Child Protection and Safeguarding. This is without exception.
Photography/Filming by Staff
Photographs and footage taken by staff may be used and shared with other faculty members for teaching purposes.
Any and all digital images and videos of students will be stored on devices with a minimum of 2 levels of security and erased when no longer needed.
With permission, photos and footage taken by teachers in class and at performances may be used for marketing purposes. This may include but is not limited to printed materials, use on our website, use in email marketing campaigns, or ads or posts on our Official Social Media Pages. We will never post photos with other information that may identify our students unless we have explicit consent from parents/legal guardians to do so. (i.e. newsletter segments highlighting or congratulating particular student achievements).
If you have declined to give permission for us to use images/video of your child, we may still post pictures or videos with their faces covered or blurred, or we must exclude them from taking part in this part of the lesson with their friends.
Image and Footage Release
Customer consent for use of images and footage is indicated in the Online Registration Form/ Online Customer Portal.
If you indicate consent, you agree to the following release statement:
“I/We (The Customer), by indicating publicity consent on the Online Registration Form/Customer Portal, authorize Theative Performing Arts and their staff to use photographs, video images, or other likenesses of myself and/or my child taken during lessons and performances, for the following purposes: Use in Theative Performing Arts education and training activities and materials; and use in print or electronic form in Theative Performing Arts publications, presentations, brochures, newsletters/bulletins, social media and websites for educational, public relations or promotional purposes which may result in the raising of funds for Theative Performing Arts. I understand that the images and footage described above may be included in, copied and distributed by means of various print or electronic media. I understand that my and my child’s name will not be included. I understand that this authorization can be revoked at any time to the extent that the use or disclosure has not already occurred prior to my request for revocation; I understand that once images/footage have already been used or posted and are in circulation, Theative Performing Arts are not able to remove or withdraw them. In order to revoke the authorization, I must notify the Theative Performing Arts Principal in writing at the following email address: [email protected] and edit my consent within by emailing the school officel.”
10. Referral Programme
Theative Family Members receive 5 complimentary class passes on enrollment and can request more at any time from the school office or their class teacher. These can be given to any friends who you think would love to join our classes!
Please make sure that all the blank fields on the passes have been completed, that friends who email us to redeem their class pass mention that they have received a referral card and that they know they need to hand their class pass to the teacher at their first booked class, or take a photo and emailing it to us when booking in.
If your friend signs up and, you both will get £10 credited to your customer profiles on our database. This can be redeemed against any invoices for future classes or workshops.
For every 5th successful referral where your friend signs up, you will be credited £50 (they will still be credited £10).
For every 5 successful referrals in each year, you will also be added to a yearly prize draw to win a whole year's worth of tuition! (5 referrals = one entry, 10 referrals = two entries, etc.)
11. Legal Information
All individual Theative Performing Arts teachers are covered by dance teachers' specific public liability insurance and have been found to be suitable to work with children and vulnerable adults by the Disclosure and Barring Service.
Theative Performing Arts are registered with the Information Commissioner's Office.
Theative Performing Arts are fully licensed to play music in our classes and online streaming by PPL and PRS.
All teachers are carefully chosen to embody our ethos, practices, and ability to teach to a high standard. In the unlikely event of a serious incident involving a teacher, please contact The School Principal (Amy Lynn Swarbrick) immediately so that we may work to resolve the situation as quickly as possible.
We at Theative Performing Arts pride ourselves on our ethical and fair business practices. Our terms and conditions must be agreed to before booking initial taster classes and are always available to view in the customer portal and your Parent Handbook. We accept no responsibility for penalties or action taken as a result of customer failure to read/check terms and conditions, reminders, or other correspondence. Legal action will be taken against anyone who engages in libel/slander against us or anyone who poaches students from us.
All Theative Performing Arts lessons, playlists, props, and all other content of Theative Performing Arts classes, performance choreography, marketing materials, images, and footage are the copyrighted and intellectual property of the owner and Principal. Legal action will be taken against plagiarists.
Failure for clients to comply with our Terms and Conditions, including code of conduct, is a Breach of Contract and will result in immediate expulsion, without reimbursement, and may lead to litigation.
Under the Consumer Rights Act 2015, we have endeavoured to ensure that our policies and procedures are transparent and upfront, do not limit your legal rights and do not enforce disproportionate default charges or excessive termination charges.
12. Safeguarding Policy
Statements
Theative Performing Arts is fully committed to safeguarding the welfare of all children and young people up to the age of 18. We recognise our responsibility to take all reasonable steps to promote safe practice and to protect children from harm, abuse and exploitation.
Theative Performing Arts acknowledges its duty to act appropriately to any allegations, reports or suspicions of abuse. All staff and volunteers will work together to encourage the development of an ethos which embraces difference and diversity and respects the rights of children, young people and adults.
Theative Performing Arts recognises its duty of care under the Children and Young Persons Act 1963, the Children (Performances and Activities) (England) Regulations 2014, the Children Act 1989 and Working Together to Safeguard Children 2015.
Theative Performing Arts will ensure that: The welfare of the child is paramount. All children, whatever their age, culture, disability, gender, language, racial origin, religious beliefs and/or sexual identity have the right to protection from abuse. All suspicions and allegations of abuse will be taken seriously and responded to swiftly and appropriately.
Theative Performing Arts will ensure that:
Everyone will be treated with respect and dignity.
The welfare of each child will always be put first.
Enthusiastic and constructive criticism will be given to pupils rather than negative criticism.
Bullying will not be accepted or condoned.

Implementation
In implementing this policy, Theative Performing Arts will:
Ensure that all workers/members understand their legal and moral responsibility to protect children and young people from harm, abuse and exploitation.
Ensure that all workers/members and volunteers understand their duty to report concerns that arise about a child or young person, or a worker's conduct towards a child or young person to the Designated Safeguarding Person.
The Designated Safeguarding Person will refer any child protection concerns to the statutory child protection agencies (i.e. Police and/or Children’s Social Care).
Children, young people and parents will be informed of who the Designated Safeguarding Person is and be able to raise any safeguarding concerns & know that these will be taken seriously and acted upon.
Ensure that workers/members will work implemented in a consistent and equitable manner in line with the safer working practice guidance.
This policy will be regularly monitored by Amy Lynn Swarbrick of Theative Performing Arts and will be subject to an annual review.
Further Points Regarding Safety and Safeguarding of Attendees
Parents/carers have a legal responsibility to stay on-site for all dancers under the age of 8 years old. In some instances where this is not always possible, please arrange with another parent to stay in your stead and mention to the teacher at the beginning of the lesson if you intend to wait elsewhere and make sure that you have given the teacher your emergency contact information.
If you have dropped your child off for class, please be on time to collect them.
Parents/carers are responsible for their child at all times when outside of the classroom and lesson times.
Teachers are only responsible for students inside the studio, during lessons. All children under 11 years may not be left unsupervised by a parent/carer outside of the classroom.
We require up-to-date and accurate information about medical conditions, disabilities, injuries, or additional needs that your child has that may affect their participation in class. Theative Performing Arts are not liable for any injuries suffered as a result of any incomplete information provided to us.
Teachers are not qualified to administer EpiPens or other medications. If your child requires an EpiPen, inhaler or any other medications to be brought into class and may require an unqualified person to administer it, please submit consent via writing to [email protected].
Physical contact is often required between teachers and students to correct technique, and between students (i.e holding hands). Appropriate touch will always be used.
Annexe - Online Safeguarding for Remote Learning
We believe that:
Children should be able to use the internet for education and personal development, but safeguards need to be in place to ensure they are kept safe at all times.

we have a responsibility to help keep children and young people safe online, whether or not they are using Theative Performing Arts’ platforms.
all children, regardless of age, disability, gender reassignment, race, religion or belief, sex or sexual orientation, have the right to equal protection from all types of harm or abuse.
working in partnership with children, young people, their parents, carers and other agencies are essential in promoting young people’s welfare and in helping young people to be responsible in their approach to online safety.
We will seek to keep children and young people safe by:
appointing an online safety coordinator (Amy Lynn Swarbrick). Children can contact our Safety Coordinator at any time via email, phone or SMS.
providing clear and specific directions to staff and volunteers on how to behave online through our behaviour code for adults
supporting and encouraging the young people to use our service in a way that keeps them safe and shows respect for others
supporting and encouraging parents and carers to do what they can to keep their children safe online
developing an online safety agreement for use with young people and their parents/carers
developing clear and robust procedures to enable us to respond appropriately to any incidents of inappropriate online behaviour, whether by an adult or a child/young person
reviewing and updating the security of our information systems regularly
ensuring that usernames, logins, email accounts and passwords are used effectively
ensuring personal information about the adults and children who are involved in our organisation is held securely and shared only as appropriate
ensuring that images of children, young people and families are used only after their written permission has been obtained, and only for the purpose for which consent has been given
providing supervision, support and training for staff and volunteers about online safety
examining and risk assessing any social media platforms and new technologies before they are used within the organisation.
If online abuse occurs, we will respond to it by:
having clear and robust safeguarding procedures in place for responding to abuse (including online abuse) providing support and training for all staff and volunteers on dealing with all forms of abuse, including bullying/cyberbullying, emotional abuse, sexting, sexual abuse and sexual exploitation
making sure our response takes the needs of the person experiencing abuse, any bystanders and our organisation as a whole into account reviewing the plan developed to address online abuse at regular intervals, in order to ensure that any problems have been resolved in the long term.
Parent/carer and Pupils agreement with regards to their involvement with our interactive and pre-recorded classes:
"I/We (the customer and pupil) understand that I or another adult must provide a safe area, at least 2m squared per participant, free of obstructions or dangerous objects for my child to participate in online dance lessons."
"I/We understand that a responsible adult must be present in the same room to supervise my child’s safety and participation for the entire duration of the lesson."
"I/We understand that if my child is under 5 years of age, a responsible adult is required to participate in the lesson with my child to ensure their safety and benefit."
"I/We understand that children should be fully clothed in dance appropriate attire for the entire duration of the interactive or pre-recorded class."
"I/We understand that adults should under no circumstances appear on-camera in any state of undress, or be seen drinking alcohols/smoking/etc, and should not use any foul language or expose their child or any of the other children participating to any other sort of lewd or inappropriate material or behaviour."
"I/We understand that it is our responsibility to openly discuss online safety with our child(ren) and to ensure that sufficient safeguards and blockers have been put in place to facilitate their engagement with online dance classes safely."
"I/We understand that repeated absence from online classes (and/or failure to submit homework assignments), especially when in-person classes are suspended, without adequate notice to the school office is a genuine cause for concern to Theative Performing Arts regarding the wellbeing of our child and may result in my being reported to the relevant authorities."
"I/We understand that Links and Passwords to online classes are not to be passed around to other pupils or parents. All queries regarding accessing online classes must be made directly to the Theative Performing Arts office."
