In consideration for being permitted to participate in aerial/circus classes and any other activities conducted by Aerial Energy, you are required to read, understand and agree to the following terms and conditions, prior to commencing a class at Aerial Energy
PAYMENT POLICIES
A minimum 50% deposit is required to book your place in any course. Cancellation of your course commencing will result in loss of the deposit. Full payment of your class is due by Wednesday, week 2 of your course. If no payment is received you may be refused entry into classes.
Once the term has commenced courses are non-refundable and payment is due in full regardless of attendance.
Please choose a time and day that will suit you from week to week, we do offer a minimum of 2 make up classes per term. Makeup classes are either at a similar level or below, or can be given as a 1hr open training (adults only). Cancellation of any course will result in no refund.
Payment can be made in person or online. We offer the following payment options: Cash, Direct Bank Transfer, PayPal or Card through Square.
Please note that if you book in for a casual class or private lesson and cancel within 24 hours of the class, payment is still due in full. Booking a place and not attending will also still require full payment.
All workshops or specialist classes will need to be booked and paid in full prior to the date of the workshop/class and are non-refundable.
Aerial Energy reserves the right to cancel any event or class which does not meet the minimum enrolment requirement. If a class, workshop, event, course or private lesson is cancelled by Aerial Energy, the fee for that event will be refunded, or a credit applied to your account. Credits and refunds will NOT be applied for missed classes due to illness, family holidays, or personal commitments.
Aerial Memberships are 10 week contacts payed fortnightly. Payment is due regardless of attendance. Please contact [email protected] to set up a membership. STUDENT REGISTRATION:
Student Registration and Waiver must be completed and agreed to before students participate in any workshops or class/es.
PHOTO & VIDEO RELEASE
I hereby grant Aerial Energy the permission to use any images or footage taken of me/my child by or on behalf of AE during my/my child’s training for commercial or non-commercial materials including, but not limited to, the AE websites, publicly-filed documents, presentations, signage and advertisements. I understand that I will not receive any compensation for such use and hereby release AE and anyone working on behalf of AE in connection with the use of my/my childs images. AMENDMENT - terms and conditions
RE: COVID Absences
Please read through the following amendment RE COVID 19 absences for isolation periods.
1. 1.All students that must quarantine due to COVID 19, we are offering make up sessions. As there is a surge in cases locally, we want to remain open and operational.
If you are required to isolate and can’t make your classes that your are enrolled in excluding opens, we will have the following on offer:
Slot into another class for a makeup session – if space permits.
Come to our scheduled open sessions with a coach.
Wait till the end of term and we will accommodate the makeups due to relevance.
1. 2.Refunds will not be offered for any COVID 19 related absences, however if there are various attempts made to find a make-up session or class to no avail, then consideration will be taken for credits to be applied.
1. 3.If one of our coaches is positive to COVID-19 and must isolate and the class is canceled for that week, you will be given the following options.

1. 4.For the safety and privacy of all our students and coaches, please be respectful and let us know if you or your child have tested positive and are in isolation.
I would like to keep the communication open so that we are all in the loop, however, to also respect those that have been tested positive. Upon notification from a positive COVID 19 case, we will inform everyone within the related class and provide the time that the student was in the school, however we will not disclose names unless required and have been given permission prior.
We respect ALL our students and their privacy as well as the health and wellbeing of all who attend and our staff.
NO ALCOHOL IS TO BE CONSUMED ON THE PREMISES
A No Alcohol consumption policy during any Aerial/Circus Instructional Class given at Aerial Energy. In the event of a Hens/Girls Party or any other booked event at AE there will be NO Alcohol served or consumed by any participant in the class. Aerial Energy recommend that NO Alcohol be consumed, by Aerial Energy. All rights reserved any student/ participant/nonparticipant, prior to any Aerial/Circus Instructional Class or any other Instructional Class at AE, including any/all participants in Hens/Girls Party‚ or any booked event held at Aerial Energy. Aerial Energy will not be held responsible for any injury or death as a result of a participant/non-participant intoxicated prior to entry to Aerial Energy.
PARTICIPANTS OF MINORITY AGE
A parent/guardian with legal responsibility for the participant must acknowledge, understand and accept all of the above and consent to his/her release as provided above of all the Releases, and, for myself, my heirs, assigns, and next of kin, release and agree to indemnify and hold harmless AE or Related Parties from any and all liabilities arising from the minor child‚ involvement or participation in Aerial acrobatics/ Circus activities, even if arising from the negligence of AE or Related Parties.
HEALTH AND COVID19 SAFETY
I acknowledge I have been advised to consult with my physician with respect to any past or present injury, illness, pregnancy or any other health related condition or any kind whatsoever that may affect my participation and ability to participate in the program. I acknowledge that I have discussed the appropriateness of the Aerial acrobatics/Circus program in connection with any illness or condition that I have or have had with my physician, and that I knowingly execute this release from liability and negligence. I acknowledge that AE does not recommend that pregnant women participate in Aerial acrobatics/Circus. In addition to this I acknowledge if I am COVID-19 symptomatic, if I have been in close contact with someone who has or had COVID-19, or if I have travelled interstate or overseas recently I will not visit the studio until the recommended quarantine period has passed under the guidance of the up to date local and state government restrictions. I acknowledge and agree to adhere to all safety, sanitation and precautionary measures put in place by AE in relation to the Industry COVID SAFE Plan they are conducting business under.
WAIVER & RELEASE OF LIABILITY:
Aerial Energy ("the Business") operates an Aerial Acrobatics Studio from 35 Roberts Rd, Beerwah QLD 4519 ("the Premises"). The Business provides fitness services incorporating stretching exercises, pilates, strength training, balance, posture and associated fitness activities principally using the following apparatus and techniques: Aerial Fitness classes. Aerial Silks / Aerial Hammock - performance of aerial acrobatics suspended from a ceiling or similar structure while hanging from fabric. Aerial Hoop/Lyra - performing aerial acrobatics suspended from a ceiling or similar structure using circular steel apparatus. Portable Aerial Rigging use ("the Fitness Activities").
In consideration of Aerial Energy permitting you/the student to participate in the Fitness Activities you/the student agree and acknowledge as follows: the information you have provided to Aerial Energy is true and correct; Aerial Energy will rely on the information you/the student provides in assessing whether to allow you/the student to participate in the Fitness Activities; unless otherwise disclosed, you/the student have no pre-existing physical conditions, medical condition, or mental impairment that would restrict your/the student's ability to participate in the Fitness Activities;
You/the student are not obligated to perform nor participate in any Fitness Activity that you/the student do not wish to undertake, and that it is your right to refuse such participation at any time during your fitness sessions;
Photo Release 3.5 unless you/the student state otherwise you/the student have no objection to Aerial Energy taking photos of you/the student for use in the promotion of the Business or for such other purposes as agreed by you/the student; you/the student have been informed of the risks associated with the Fitness Activities and you/the student voluntarily choose to participate in the Fitness Activities fully accepting such risks, should they arise; you/the student understand and accept participation in the Fitness Activities may cause personal injury, death or property damage and in particular you/the student understand that there is a risk of injury, such as:
a. stress on joints, ligaments and tendons;
b. skeletal injuries such as sprains, bone fractures, bones chips and breaks; c. muscle injuries to upper and lower body;
d. skin cuts and abrasions;
e. impact injuries due to falling, such as, concussion;
f. blood loss arising from an injury;
g. heart attack;
h. triggering abnormal change in blood pressure;
i. triggering of acrophobia (fears of heights);
j. other health issues,
and that these injuries may require medical treatment.
Should you/the student feel lightheaded, faint, dizzy, nauseated, or experience pain or discomfort, you/the student should stop the activity and inform the fitness trainer; Aerial Energy are not medical experts. You/the student give Aerial Energy and it's staff permission to seek emergency medical services (where required) should you/the student become injured or ill; you/the student are responsible for any medical expenses incurred where emergency medical help is called to attend you/the student.
Due to the nature of the Fitness Activities, which involve performing at heights, participation in them may pose a significant degree of risk of physical harm to the participant and deemed a dangerous recreational activity. To the extent permitted by law, in respect of your participation in the Fitness Activities, Aerial Energy accepts no liability for:
5.1 obvious risks that are patent or a matter of common knowledge;
5.2 inherent risks arising that cannot be avoided by the exercise of Aerial Energy's reasonable care and skill;
5.3 harm suffered by a person as a result of the materialisation of an obvious risk of a dangerous recreational activity.
To the extent permitted by law, Aerial Energy is not liable to you/the student for any claim, loss, expense or damages, whether arising in contract, in tort (including negligence), in equity, by operation of law or otherwise arising out of or in connection with the provision by Aerial Energy of the Fitness Activities.
To the extent permitted by law, you/the student waive any and all claims against Aerial Energy and unconditionally release and discharge Aerial Energy from all liabilities, causes of action that may arise from any act, omission, default, failure or error on the part of Aerial Energy (including negligence) wholly or partially arising from your participation in the Fitness Activities.
You/the student indemnify Aerial Energy against all claims, demands, remedy, suit, damage, loss, cost, liability, expense, action, proceeding, right of action, claim for compensation in respect of, arising from or contributed to by any act, neglect, default or omission by you/the student while you are undertaking the Fitness Activities or within the Premises.
