Terms and Conditions

Alpha Cheer (Alpha Cheer NZ LTD) refers to Alpha Cheer it’s employees and volunteers. "Athlete" or "child" refers to the person enrolled in an Alpha Cheer class. If the athlete is under 18, enrolment and acceptance of the terms and conditions must be completed by a parent or legal guardian.

ENROLMENT IN ALPHA CHEER


By enrolling in a Alpha Cheer NZ Free trial, you acknowledge and accept Alpha Cheer NZ's terms and conditions. You are responsible for covering all associated expenses, which encompass term fees, competition fees, uniform fees, registration fees and any additional costs incurred. 

An athlete's enrollment becomes official upon their participation in one of our training sessions following the conclusion of the free trial period. Enrollment is valid for an entire season, concluding on December 21, 2023. All accounts are billed on an annual basis. In the event that you decide to discontinue participation prior to December 21, please consult our cancellation policy for guidance.

MEDICAL/FIT TO CHEER


It is the responsibility of the athlete / their guardian to ensure that they are medically and physically fit to participate, and to notify Alpha Cheer of any relevant medical or health issues that arise at any point. If injured and/or unwell the athlete is still expected to attend their team practices. Alpha Cheer may act in loco-parentis in regards to an athlete in the event of an injury, accident or emergency.

Alpha Cheer NZ, staff and coaches will always keep safety as one of our highest priorities, however by enrolling your child into an Alpha Cheer NZ programme caregivers understand the risks of the sport, potential hazards or injuries which may occur and will not hold Alpha Cheer NZ, staff and coaches liable
 

ASSUMPTION OF RISK 

Due to the nature of the activities the risk of serious injury inherent in the activities. I understand I am encouraged to seek medical professionals advice before participating in any activity. I have advised of any physical impairment that I suffer and will continue to inform Alpha Cheer NZ.
 agree that my participation in activities is entirely at my own risk and I assume all risk of serious injury, illness or death.

MEDIA RELEASE 

I understand that routines will be video recorded and photographed. These may be uploaded by either the event producer and/ or Alpha Cheer NZ. I give consent for my child's picture to be taken by Alpha Cheer NZ and this may be used for internal and external uses such as emails, social media and marketing purposes.
I understand that any images & videos taken of my child participating in an Alpha Cheer NZ Programme is the property of Alpha Cheer NZ. I release Alpha Cheer from all claims and demands arising out of or in connection with the use of the materials, including, but not limited to, all claims for invasion of privacy, defamation and any other personal and/ or property rights. 

CLASS & LEVEL SPECIFICS


Alpha Cheer may move/transfer an athlete to another class that is more appropriate for his/her skill level or commitment level. Alpha Cheer may suspend athletes for disobeying instructions and/or violating any process, procedures, conditions or applicable rules for joining our programme(s). Alpha Cheer reserves the right to alter class schedules or cancel a class if required. Alpha Cheer does not guarantee that an athlete will progress through the tumble level programme at any set rate.



UNIFORM & BOW RENTAL
 

All rental uniforms must be cared for and returned in the conditioned they are loaned out. If items are lost, returned damaged or an unsatisfactory condition there will be a charge to replace these items including all shipping costs. Failure to return the bow will result in a $30 charge to your account .
Failure to return the uniform will result in a $150 charge to your account.

ACCOUNTS


All charges will applied to your online account and you will be notified by email. All invoices must be paid within 30 days unless an agreement has been made with Alpha Cheer NZ.


In the event of late payment, the bill payer will incur a late fee per invoice as determined by Alpha Cheer NZ. The invoice will be reissued on the existing invoice via our online portal.
In the event of any amounts not being paid in accordance with the provisions of this contract Alpha Cheer has the right to refuse to teach, train and/or provide services to the cheerleader until such time as all outstanding amounts are paid. Alpha Cheer is under no obligation to provide any abatement of fees for any time the cheerleader is not in attendance. If at the end of the season money is not paid and cheerleader wishes to change gyms, Alpha Cheer will notify that gym of the amount that is owed and the period of time it has been outstanding. All outstanding accounts must be paid by 20 December 2023. Failure to do see will result in debt collection action.
 

CANCELLATION OF MEMBERSHIP/ CLASS ENROLMENTS


BILL PAYER MUST NOTIFY THE ALPHA CHEER TO CANCEL A STUDENTS ENROLLMENTS IN A CLASS. Only a written notice via email, regular postal mail or hand delivered to our HEAD COACHES will be acceptable. All terms included will only be accepted from the day it has been received by the HEAD COACHES. Please note: You are responsible for payment for your student's classes WHETHER OR NOT YOUR STUDENT ATTENDS CLASS until the time you notify the staff VIA WRITTEN NOTICE. Please do not rely on your student to verbally let us know that he/she will no longer be attending classes. Enrollment is established upon submission of this form, Class enrollments and associated fees will automatically continue each term as we do not offer fixed term enrollment. To cancel your enrollment, we require 4 weeks notice in writing and a cancellation fee will be applied to your account. The Cancellation fee will be a minimum of $100 plus all outstanding amounts.
 

DEBT COLLECTION ACTION


The Member authorizes Alpha Cheer NZ to contact any debt collection/credit reporting agency in the event any account with Alpha Cheer NZ is not paid. Should this occur the full outstanding balance for the remainder of the term including any current arrears shall be immediately due in full. In addition, Alpha Cheer NZ shall add $50 to the outstanding debt as its fee for dealing with the default. The Member also agrees to pay all collection costs which may be incurred as a result. The Member also authorizes Alpha Cheer NZ and or the debt collection agency to use any and all search powers available within the law to find up to date contact details for the Member to pursue the debt.
 

ARRIVAL AND PICKUP


Be sure your child arrives no later than 10 minutes before his/her scheduled class time. Your child is to wait quietly in the waiting areas. Alpha Cheer recommends that all children need to be escorted from your car and to the building. Additionally you should escort them from the building to your car. Alpha Cheer does not take any responsibility for athletes once they leave the building. It is the parent’s responsibility to liaise with the child as to their preferred collection method and to ensure the athlete follows your agreed collection method - allowing the athlete to go / wait outside is entirely at your own risk. If your child is in the waiting area more then 10 minutes before or after a class Alpha Cheer does not provide any supervision during this time - it is entirely at your own risk.

MISSED CLASSES POLICY


Missed classes will not result in make-up classes, prorated tuition or refunds. No refunds for classes missed including scheduled holidays. 

ATTENDANCE


Attendance to all Alpha Cheer training, events and related competitions are mandatory. I understand that when one athlete does not attend this negatively impacts the whole group. 
ADVANCED teams will prioritise Alpha Cheer above all other extracurricular. Athletes are responsible If coaches feel your attendance is disrupting the teams progression, you will be asked to move into a low commitment team.

IMAGE POLICY


I understand that routines and trainings will be video recorded and photographed. These may be uploaded by either the event producer and/ or Alpha Cheer NZ. I give permission for my child's picture to be taken by Alpha Cheer NZ and this may be used for internal and external uses such as emails, social media and marketing purposes. 

SOCIAL MEDIA


The member understands that they are not to post negative comments or content on Facebook, Instagram or any other social media platform about our gym or any other cheerleading organisation. Members understand they are not post routines or music on Facebook, Youtube, Instagram or any other social media without approval from Alpha Cheer NZ. Members must understand if their social media is linked to Alpha Cheer NZ in anyway they may not post content which includes but is not limited to illegal or anti social behavior,

ACCEPTANCE OF RULES, TERMS AND CONDITIONS.


I understand the above financial obligations and have read the terms and conditions as set out in the above contract I understand that Alpha Cheer NZ may change and alter these terms of agreement as they see fit. If the athlete is under the age of 18 years a parent/caregiver must sign this form and agree to provide my full name (as it appears on legal documents), contact number, postal address and email address to Alpha Cheer NZ LTD.
I agree to all the terms and conditions of the contract, I understand that you do not require to have my signature as acceptance and that acceptance is deemed through my/my child’s participation.
