Terms & Policies 

These are the terms and conditions upon which Australian Dance Arts Pty Ltd Pty Ltd with Australian Company Number 621838051 located 2/22 Narabang Way, Belrose NSW 2085, trading as Ballet Academy Northside – Dance B.A.N. and Sydney College of Dance (the ‘School’) provides training and coaching services for dancers (‘Services’).

In these terms and conditions, the terms ‘You’ and ‘Your’ means the Students. Where the words ‘We’, ‘our’ and ‘Us’ appears that is a reference to the School.

This is an Agreement between the Student and the School.

Note: Where the Student is a Minor as defined under section 21 of the Acts Interpretation Act 1987 (NSW), this Agreement will be deemed to be between the School and the Parent or Guardian of the Minor.

1.    Services

The School provides the following Services:

Dance Instruction for students aged 3 years and above in the following genres:

•       Ballet – Syllabus and Examination by the Royal Academy of Dance

•       Ballet Open Class

•       Pre-School Dance

•       Contemporary Dance

•       Lyrical Dance

•       Jazz Dance

•       Musical Theatre & Drama

•       Acrobatics for dancers (“Acro Dance”)

•       Pilates and Conditioning

•       Performance Groups

•       Pre-Professional Training such as SCD Transition & Youth Transition

3.    Enrolment Policies

3.1 Enrolment is on annual basis unless otherwise agreed by the Parties.

3.2 All enrolments are charged per full school term.

3.3 Students who are enrolling for the first time of the current term, are charged a term fee for the remainder of the current term excluding any discounts.

3.4 The school is closed during school holidays, the day after the school production, on public holidays and Easter Holidays (Long Weekend).

3.5 Ballet Academy Northside accepts enrolments in Term 1, Term 2 and Term 3 only. Exceptions apply for Pre-School Dance students and Pre-Professional dance students.

3.5 All Students enrolling into the School agree to participate in the end of year concert in Term 4.

Please be aware of our compulsory rehearsals for the School Production scheduled from week 7-9 in Term 4!

If your child cannot participate for any reason, you must notify the school latest in the last week of Term 3.

3.6 All classes in Term 4 (except Pilates) may work solely on the choreography for the school production. Students/Costumers who are not participating in the end of year production participate in all classes to be fully included in the production process to learn the choreographic material with their peers.

 

Condition of Enrolment for Eisteddfod students

3.7 Eisteddfod students must have 100% commitment and high attendance in all classes and rehearsals.

3.8 Eisteddfod students must have 100% commitment for all performance dates (see above)

3.9 The school must be notified in writing with at least 24h notice, if a student misses any rehearsal.

3.10 If an Eisteddfod student misses a rehearsal, they must take full responsibility to catch up on their training independently.

3.11 It is the student’s responsibility to remember choreography and be prepared for each rehearsal.

3.12 Eisteddfod students are required to always give their best effort and be supportive of their peers.

3.13 If an Eisteddfod student misses more than 3 rehearsals, they may be asked to book a private lesson with the nominated teacher to catch up on missed training.

3.14 If an Eisteddfod student misses a significant amount of rehearsals or is falling behind other students for any reason, the school reserves the right to temporarily withdraw the student from performances and place them as an understudy until the teacher is satisfied, they can perform to the competitive standard required.

  

Payment Methods

4.1 All term fees and additional fees (except private lesson fees) are invoiced electronically.

4.2 Following payment methods are available: Bank Transfer, Credit Card, Direct Debit.

4.4 The School will not accept payment via cheque.

 

5.    Payment of Fees

5.1 All fees must be paid by the due date on the Invoice. Fees are invoiced on a term-by-term basis.

5.2 Private lesson fees are not invoiced by the School. Private lessons must be paid upfront in cash directly to the teacher. (Please read Appendix D for more details)

5.3 A compulsory school production fee which includes a costume hire/purchase and video production fee (Please read Appendix A for more details) is added to the term 3 fees and any balance of additional costume costs (Solo costumes, etc.) will be added to the term 4 invoice or will be invoiced separately in term 4.

A due date to advise of your child’s non-participation is advised by the end of term 2.

Where we are not advised by this date, all costumes costs have been already ordered are payable by you.

5.4 The school can offer part payment options to students/costumers, if they are unable to pay the full-term fees on time. See Part Payment Terms (Please read Appendix D).

5.5 An Administration Fee of $50 will be charged, where a Student is more than 30 days late in paying an Invoice.

 

6.    Part Payment Terms

6.1 A ‘request for part payment’ must be submitted in writing to [email protected] PRIOR to commencement of the term or latest in week 1 of the current term.

6.2 A ‘request for part payment’ later during the term may not be accepted.

6.3 It is at the discretion of the Director if the school will accept ‘a request for part payment’.

6.4 It is required to pay the instalments as agreed without having to be notified by the administration.

6.5 The school reserves the right to revoke the permission to pay tuition fees in instalments, if the parent/student fails to pay the agreed instalments on time. In such a case it is required to pay all tuition fees for the term before continuing the course.

 

 

Debt Recovery

7.1 The School reserves its rights to commence debt recovery through a Debt Collection Agency where a Student is more than 30 days late in paying an Invoice.

6.2 The Student (Client) shall pay all costs (including legal and agent's fees) incurred by Australian Dance Arts P/L connection with any recovery or attempted recovery of any overdue accounts from the Client.

 

8. Refunds

8.1 No refunds, discounts or credits are given for missed classes.

8.2 The School can offer a make-up class for missed classes.

8.3 The School has no obligation to offer make-up lessons for missed training for any reason. Make-up lessons are encouraged by the School to support the students training progress if they have missed some training.

9. Indemnity

9.1 The Client shall indemnify the School, its employees and agents against any liability, loss or damage (including but not limited to for any personal injury, property damage/loss or wrongful death), costs (including the costs of any settlement and legal costs and expenses on a solicitor and own client basis) and expenses arising out of or in connection with a wilful default or unlawful or negligent act or omission by the Student.

 

10. Missed Classes by Students

10.1 Where a Student is unable to attend a Lesson, or their Lesson falls on a public holiday, the School may offer the Student an equivalent make-up class.

10.2 The school will only offer make up lessons in Term 1 and Term 2. No make-up lessons are offered in Term 3 and Term 4, due to the concert preparation.

10.3 The school will offer a total of six (6) make-up lessons per student per school term.

10.4 No Make-up lessons are credited to the following term.

10.5 No compensation of any kind is given, if a student is unable to attend the make-up lesson.

10.6 It is the sole responsibility of the Student to arrange a make-up class within 14 days of the missed class.

10.7 The School will not to provide a make-up class, if a request to have a make-up class is made more than 14 days after the missed class; if there are no suitable classes available for any reason; if the Student/Costumer is unable to participate in the make-up class(es) offered by the School.


11. Cancelled Class by the School

11.1 Where the School cancels a class for any reason the School in its sole discretion will decide whether it is appropriate to offer a make-up class or credit this class towards the next term fees.

11.2 Weather Cancellations:

The School closures due to severe weather conditions will be announced by noon that day. Notifications of weather cancellations will be emailed and texted. There are no refunds for missed classes or classes cancelled due to inclement weather or cancelled for reasons beyond the control of the School.

 

12. Cancellation of Enrolment by the School

12.1 Your enrolment in the School will be cancelled where any of the following occurs:

•       while any of our Invoices remain unpaid;

•       if You fail to comply with any reasonable direction issued by any staff member of the School which compromises our ability to provide our Services to Students or compromises the safety and welfare of other Students of the School;

•       for any other reason outside our control which has the effect of compromising our ability to perform the Services within the required timeframe;

•       if in our sole discretion the School considers it is no longer appropriate to provide the Services to You.

 

13. Cancellation of Enrolment by Customer

13.1 All cancellations must be in writing latest by the end of the current term by email to: [email protected]

13.2 All cancellation will take effect on the last day of the school term!

Please be aware that you must cancel your enrolment before the commencement of the following term – if the term has started already, your cancellation becomes effective at the end of the current term!

 

14. Fitness to Participate

14.1 The School provides the Services on the assumption that the Student is fit to participate in the Dance Classes.

14.2 By accepting this Agreement, the Student/Costumer agrees the Student is fit to participate in the Dance Classes.

 

15. Dance Studio Hygiene

15.1 No food and drinks except water are permitted in the Dance Studio. Students are required to bring water (Drink bottles, no glass bottles) to hydrate themselves during Dance Class.

15.2 All Students/Costumers need to fully comply with the ‘Occupational Health and Safety/School Premises’ policy (See Appendix A).


16. Uniform

16.1 All students must wear their official school uniform while participating in each class. (Please read Appendix A for detailed information)

16.2 All students must purchase their uniform latest in the 2nd week of their enrolment.

 

17. Conduct

17.1 The School is committed to providing an enjoyable experience for all Students. The School will not tolerate the following forms of unacceptable behaviour:

•       verbal or physical abuse;

•       intimidation by a Student or another Student or intimidation by a Parent or Guardian of any Student (including the Student that is child of the Parent of Guardian);

•       discrimination in all its forms as defined under the Anti-Discrimination Act 1977 (NSW); and

•       harassment or threats of any nature towards Student, Parents and Guardians, or any employees or sub-contractors or third parties attending the School.

 

17.2 The behaviours described in clause 17.1 above, extends to those behaviours occurring at any location attended by the School and during any performances (including before the commencement of any performance and after any performance) made by Students of the School.

 

18. Photograph and Video Recordings

18.1 It is not permitted to take photographs and videos of class work and choreography on School premises or at School events without the permission of the School.

 

19. Communication/Sending Material or Information by Email

19.1 Students/Parents communicating primarily with the School from Monday - Friday per email or phone from 4 – 6.30pm on Saturdays 9-12pm (during the school term).

19.2 It is not permitted that parents/guardians communicating issues with teachers before, during or after class times. Teachers are instructed to contact the School about any complaints and make appointments with parents/guardians outside their class times if necessary.

19.3 The School will send and receive electronic mail. However, as such mail is not secure it may be copied, recorded, read or interfered with by third parties while in transit. If You ask us to transmit any document electronically, ‘You’ release us from any claim You may have as a result of any unauthorised copying, recording, reading or interference with that document after transmission, for any delay or non-delivery of any document and for any damage caused to Your system or any files by a transfer.

19.4 It is the Students and Parents responsibility to read relevant posted information at our website, notice board and email newsletter on a weekly basis. The school will communicate with you primarily by email from Monday - Friday per email or phone from 4 – 6.30pm on Saturdays 9-12pm (during the school term).

Please check your email SPAM FOLDER and mark our email as ‘safe sender’. Contact your email host in case of any technical issues!

19.5 The School is to be notified immediately of any changes of address (with any relevant contact phone or email details) of any student or mother/father/guardian. This is essential and remains the responsibility of the parent/student.

19.6 The School is not liable for any lack of communication if student/parent contact details are incorrect or out-of-date.

19.7 Staff will communicate issues of concern directly with students and/or parents/guardians as appropriate. To assist in the development of self-management skills, Senior students will be consulted directly on all matters related to their training. If deemed necessary, the School will also contact parents/guardians.

 

20. Exclusivity of Enrolment

20.1 Students are not permitted to be enrolled in other private dance schools, while enrolled at Ballet Academy Northside and Sydney College of Dance. There may be exceptions for students who do a long-distance extension program or other reasons agreed by all parties.

20.2 A breach of this policy may result that students are withdrawn from the school.

 

21. Applicable Law

21.1 The laws of New South Wales apply to this Agreement and any Commonwealth Law that may have jurisdiction.



RELEASE/DISCLAIMER

Enrolment in any class or private session constitutes agreement to a waiver of liability for injuries or illness contracted while a student is at the Studio:

In consideration of Students (CLIENTS) participation in and the use of the Schools facilities, he/she hereby releases and covenants not to sue the School, its owners, directors, offices, employees, representatives, agents, trustees and lessees from any and all present claims resulting from ordinary negligence and inherent risk of use of facilities and equipment of the School including but not limited to any loss, injury, damage or liability sustained by him/her while on or about the Schools premises.

1. Enrolment and Exam requirements

The directors and teachers assess each student for their ability to participate in class and it is at their discretion to decide which level is most suitable for each student.

Class requirements

All Ballet students

-  It is required to enrol for a minimum of 2 x Syllabus ballet class per week from level Grade 3 and above

-  It is required to enrol for a minimum of 2 ballet classes per week to be accepted for the Open Ballet class.

 

Ballet Pointe and Pre-Pointe Assessments

-  It is required from each student to have done 2 terms of Pre-Pointe training and a Pre-Pointe Assessment (Conducted by suitable qualified Physiotherapist) before going on Pointe.

Please note all Pre-Pointe assessments and follow-up appointments must be completed by a suitably qualified physiotherapist. Contact our studio to obtain contact details of a physiotherapist if you require this.

-  It is a requirement to have ongoing training in ballet in at least 2 ballet classes (excluding Pointe class) to be accepted into a Pointe class.

 

All Contemporary students

- It is required to have sufficient training in ballet to be accepted into the Contemporary classes.

 

Eisteddfod and other Competition

Eisteddfod is by audition only.

Eisteddfod students are selected based on talent and need to demonstrate 100% commitment and high attendance in their classes and rehearsals. They need to be prepared to commit to one extra class per week for their group rehearsal before and throughout the Eisteddfod season. This also includes some rehearsals in the school holidays.

Costs

Eisteddfod group rehearsals are charged as an additional 45min class per school term (including all multiple class discounts)

Eisteddfod rehearsals in the holidays are included in the price.

Cost per Eisteddfod costume is $40 to hire or $90-120 for a costume to purchase (TBC)

Every Eisteddfod student will need to wear their own B.A.N. tracksuit, to represent our dance school and if collecting any prizes and before their performance. All students are able to get their tracksuit at the reception on Saturdays from 9-12pm.

 

Exam requirements

Ballet Academy Northside is offering examination by the Royal Academy of Dance.

All exam students are required to have at least 80% attendance to all classes. If students can’t meet this requirement, due to illness or injury, at the discretion of the Director/Teacher, they may be requested to take additional private lessons to ensure they can reach the required level to sit their exams.

It is at the discretion of the director/teacher to decide if a student has reached the required level to sit their RAD ballet exam.

Primary – Grade 4 – 2 Syllabus classes per week

Grade 5 – 2 Syllabus classes and Limber-Stretch-Pilates per week

Int. Foundation – Intermediate – 3 Syllabus classes and Limber-Stretch-Pilates or Pilates & PBT per week

Advanced Foundation – Advanced 2 - 3 Syllabus classes and 1 Open Ballet Class and Limber-Stretch-Pilates per week

All exam students need to have ongoing training throughout the whole school year in all their required classes to be able to sit their exam.

 

2.      Occupational Health and Safety/School Premises

The safety of staff and students is of primary importance in all activities carried out by the School, by observing all workplace health and safety legislation.

 

1. CONSENT

1.1 Dance is a physical activity and the teacher or teaching assistant may have to assist your child’s understanding of an action, posture or position by physical contact e.g. holding hands in a circle; lifting, correcting posture. You consent to employees, sub-contractors, contractors and directors of the School having contact with your child in this regard.

1.2 Should your child hurt him/herself, you consent to employees, sub-contractors, contractors and directors of the School to administer first aid to your child whilst the teacher/staff wait for the nominated guardian to take over.

1.3 Your child’s enrolment into our classes is voluntary and participation in the class and the activities of ballet and other styles, creative movement and dance involve numerous risks of injury, including but not limited to muscle strains, sprains and falls and you are aware these are risks for your child participating in class.

1.4. You must inform the School and all teaching staff of any injuries, medical conditions and allergies suffered by your child.

 

2. ATTIRE/DRESS CODE

2.1 Students must attend all classes in suitable attire (see Uniform requirements).

Wearing suitable attire in class is important for students’ safety.

Uniformity in dancewear allows the teachers to assess how well the students are implementing the technique being taught, problems with alignment, and other important aspects of dance training.

2.2 No student is to arrive or leave the School premises in dance attire or dance shoes (ballet shoes, foot-thongs, character shoes, jazz shoes etc.) without some covering clothes and footwear. Dance shoes should never be worn outside!

2.3 No body piercing and jewellery allowed (except small stud earrings for female students).

2.4 All Female students should wear their hair tightly secured and styled away from the face; a neat bun, braid or high pony tail is recommended.

2.5 All ballet students from Pre-Primary level and above are required to have their hair in a ballet bun to each class. Please check this video on 'How to Make the Perfect Ballet Bun'

2.5 Students are expected to observe good personal hygiene habits. Deodorant is required for students age 10 and older. Please respect those with asthma and spray outside or away from others

 

3. OUTSIDE THE SCHOOL PREMISES

3.1 Bushland surrounds our dance facility which is out of bounds for all students and siblings.

3.2 No students or siblings are allowed to play in the car park.

3.3 Please supervise your child if they are under 10 years before class as we are not responsible for your child’s behaviour outside of the dance studios. Please don’t disturb the surrounding units as it is a shared environment.

 

4. INSIDE THE PREMISES

4.1 Only teachers, staff and students are allowed to occupy the studios.

4.2 It would be appreciated if all students can eat all their snacks and lunch outside on the terrace and pick up their rubbish.

4.3 Students are not permitted to open windows without the permission of staff or teachers.

4.4 Only vocational students are allowed in the dance studios unsupervised.

4.5 It is not the teacher’s responsibility to supervise students before the commencement of classes.

4.5 Students should not climb or hang on ballet barres or equipment/stage sets.

 

Parents Viewing Policy

Parents can observe their child through the glass viewing windows at all times.

It is not permitted to enter the dance studios without the teacher’s permission.

 

3.      Uniform

Bloch Discount Card

All students will receive a Bloch discount card. The card can be picked at any Bloch store.

 

20% Discount days

Bloch and Spangles offer exclusive discount days for all BAN and SCD students once or twice a year, usually before exams and concerts. All parents will be informed by email about upcoming discount days.

Please place your child’s name in all items of their uniform, including shoes.

Girls:

Classical Ballet

Pre-School Dance: Any colour and style of leotard and skirt, soft tutu or fairy dress or simply a singlet or t-shirt with leggings – anything your little dancer feels comfortable in. Bare Feet or pink leather ballet shoes with elastic (with ballet socks or tights).

Pre-Primary and Primary: Baby Blue scoop neck leotard, matching chiffon skirt, leather ballet shoes, pink ballet tights in winter, ballet socks in summer

Grade 1 & 2: same as above, no skirt, Character shoes low heel, character skirt

Grade 3 & 4: Navy V-neck, thick strap, seam leotard, leather ballet shoes – very well fitted, pink ballet tights in winter, ballet socks in summer, Cuban heel black canvas character shoes, character skirt

1. Code of Conduct

The School seeks to create an environment where all persons are treated equitably and with respect, where peoples’ rights are respected and where staff and students’ efforts and achievements are encouraged and given due recognition.

Staff and students should treat each other with respect. This involves:

-  Demonstrating courtesy and responsibility

-  Avoiding unfair discrimination on grounds such as race, gender, national origin, sexual orientation, disability or religion

-  Avoiding behaviour which might reasonably be perceived as harassing, bullying or intimidating

-  Respecting the rights and property of others

Staff and students should respect the privacy of others and ensure that information of a personal nature is accessed and used only for School purposes and is not disclosed to a third party as per the Information Privacy Act 2000.

The School aims to achieve the highest standards of excellence in teaching instruction, safety and administration. All members of the staff contribute to the achievement of this aim when they carry out their duties to the high standards of professionalism expected by the School.

Students are expected to carry out their duties in a professional, responsible and courteous manner and to be accountable for their conduct and decisions.

Material, financial and computerised resources should be used only for the legitimate school purposes for which they are provided. Electronic mail and access to the Internet and computerised information systems are provided to staff and students to support their employment activities and/or training and will be used solely for this purpose.

-  No person is to download files from the internet or open attachments unless the source is trusted.

-  Students and staff are prohibited from accessing inappropriate websites and/or downloading images that are offensive.

-  All property of the School is to remain the property of Australian Dance Arts Pty Ltd.

-  Equipment, materials and School facilities should be treated with appropriate care and secured against theft or misuse.

 

2. Attendance

-  All students are expected to attend all classes as scheduled.

-  In all cases of absence through illness the School needs to be immediately notified, refer clause Illness/Injury and Notice of Non-Attendance (below).

-  All exam and Eisteddfod students are required to have at least 80% attendance to all classes/rehearsals. If students can’t meet this requirement, due to illness or injury, at the discretion of the Director/Teacher, they may be requested to take additional private lessons to ensure they can reach the required level to sit their exams/continue Eisteddfods.

 

ILLNESS/INJURY AND NOTICE OF NON-ATTENDANCE

-  The School needs to be informed of all absences, including Saturdays.

-  Parents, guardians and students need to email [email protected] (if you do not have access to email please call)

-  Students reporting their own absence must copy (Cc) the email to their parents/guardians (if, for any reason, parents are not copied in, the School will forward the email to parents.

-  Students who need to leave the School during class must get verbal permission from the Director or designated staff member.

-  Student absences will be electronically recorded by staff members.

-  It is the responsibility of recovering students to communicate directly with the appropriate staff member throughout their rehabilitation regarding the status of their illness or injury.

-  In the case of injury, students will be assisted to organise and implement a rehabilitation programme in consultation with the relevant Health Team members.

-  Students arriving late for class need to report to their teacher prior to attending class and ensure they do their own warm up and be prepared for the class.

-  Students are encouraged to observe classes if they are not able to participate, due to injury.

 

3. Performances and Costumes

The School is fortunate to have an extensive repertoire of works. The choice of repertoire is the responsibility of the Directors.

-  The repertoire and casting reflect the standard required and is made entirely at the discretion of the Director, staff and choreographer.

-  All students need to attend the full schedule of rehearsals at the School if included in any School/Company performance and Competition. Rehearsals are mandatory for the preparation of all performances and competitions.

-  Non-attendance at classes and/or rehearsals during a rehearsal period may result in exclusion from a part or the complete performances.

-  Students who have missed rehearsals should try independently to catch up on missed choreography by asking their peers.

 

CONCERT COSTS AND COSTUME POLICIES

-  Costume deposits will be required for each student if participating in any event requiring a costume (i.e. eisteddfods, public performances, end of year concert etc.). If a student fails to pay the required costume deposit, no costume will be provided.

-  All ballet costumes will be provided by BAN and hired to students. The exception is solo Eisteddfod costumes, which are the sole responsibility of the parent/student. All solo costumes must first be approved by BAN before performances.

- All non-ballet costumes will be purchased by the Student.

 

Costume Purchase Prices:

ALL COSTUMES (EXCEPT BALLET) - $85-$120 (incl. GST) per costume.

Return/Damages

-  Hired costumes must be returned undamaged within 7 days after the performance

-  If a costume is damaged Students/Costumers must pay for the original price of the costume including an administration fee of $50.

 

COSTUME HIRE FEES

-  1st Costume $45 per production/event

-  2nd Costume $35 per production/event

-  Additional costumes $30 per production/event

-  Tutus: Hire fee will be based on value and for each performance.

 

CONCERT/PRODUCTION VIDEO FEE

-  The costs for a video production are $50 for each family.

-  The concert/production (all performances) is filmed in HD and can be downloaded or streamed online, once the editing is completed.

 

CONCERT TICKETS

The School offers two concerts (Matinee and Evening).

All students except Pre School students (Matinee only!) participating in both concerts.

Please note that the costs for the video fee, tickets and costumes might vary in the future, depending on the provider. Parents/students will be informed before commencement of the production about any changes in costs.

1. Media, Promotional Activities and Functions

Marketing

The organisation is committed to integrity, accuracy, and professionalism in its marketing activities. Student or staff images are only used for marketing with the permission of the individual or, in the case of students aged under 18 years of age, with the permission of parents by signing the ‘Parental Consent Form’. All marketing and advertising material will comply with relevant legislation.

The school is responsible for overall marketing and dissemination of marketing and advertising materials.

-  Students may be asked to participate in media interviews, photos or filming as part of the promotional activities of the School.

-  The decision to invite one or more students to promotional activities is made entirely at the discretion of the Director, staff and choreographer.

-  Promotional activities are not part of the official course program at the School.

-  All media/promotional activities are overseen by the Director.

-  Students are accompanied at all times by a member of staff when participating in media/promotional activities.

-  While editorial approval is not always guaranteed, the School works to present its activities and students in the best possible light.

-  Parents of students aged less than 18 years of age are asked to give written consent for their child to appear, as required, in promotional materials for the School

-  If a parent or student is approached by the media in regard to their activities at Ballet Academy Northside, please ensure that you contact the Director before speaking with any media representatives about BAN.

-  At various times throughout the year, students may be invited as an ambassador to attend functions held at the School. At these functions and while on School premises or any event venue, no student, including those over 18 years, is to consume alcohol.

 

2. MOBILE TELEPHONE POLICY

The School recognises that there are times when it is genuinely appropriate and useful for students to have access to a mobile phone

The School also recognises that increased ownership of mobile phones requires school administrators, teachers, students and parents to take steps to ensure that mobile phones are used responsibly. This includes the appropriate usage of the camera function.

- Mobile phones should not be used in any manner or place that is disruptive to the normal routines of the School or to other people.

-   The use of mobile phones or its functions is not permitted during rehearsals or practical/academic classes. Phones should be set on ‘silent’ or ‘vibrate’ mode while on School premises (in exceptional circumstances, should the parent/guardian specifically request it, a mobile phone may be left on). If mobile phones are brought into the studio or classroom, they must not be accessed during class.

-  Mobile phones brought to and kept at School premises, are used entirely at their owner's risk. The School cannot accept any responsibility for theft, loss, damage or health effects (potential or actual) resulting from mobile phone use. Students and parents should recognise, however, that mobile phones are a target for theft and, accordingly, phones should always be stored in a safe and secure place.

-  Students do not have permission to record, on any device, any choreography that is the intellectual property of its creator.

-  Students do not have permission to record any part of any year level assessment/examination classes and or recordings of classes. Any viewing of these recorded classes is only permitted in the presence of a member of the teaching staff.

Audio recordings can only be made with the expressed consent of all parties prior to the commencement of the audio recording.

 

3. Video/Photography/Choreography Copyright Policy

ALL VIDEO/PHOTOGRAPHY/CHOREOGRAPHY CONTENT IS PROTECTED UNDER AUSTRALIAN COPYRIGHT LAW!

It is an infringement of copyright to reproduce, communicate, publish or perform all or a “substantial part” of a piece of choreography, unless the copyright owner has given permission or certain exceptions apply.

-  All choreographic works are the intellectual property of the choreographer/teacher.

-  Choreography copyrights including individual created solo’s, duet’s, group dances and “substantial” movement sequences, it also includes stage design, costume design, light design and all ideas of story and concept.

-  All students must ask for permission in writing to the teacher/director/choreographer if they would like to use or publish any video and photography which shows the choreographic copyright material.

-  All students must credit the school and choreographer if they have been given permission to publish any choreographic content.

-  If students fail to comply with this policy, they will be notified and must remove the material immediately at their costs.

Part Payments

Ballet Academy Northside offering parents/students to pay their tuition fees in three instalments.

Following conditions apply for parents/students who wish to pay their tuition fees in instalments:

Part Payment Terms

-  A ‘request for part payment’ must be submitted in writing to [email protected] PRIOR to commencement of the term or latest in week 2 of the current term.

-  A ‘request for part payment’ later during the term may not be accepted.

-  It is at the discretion of the Director if the school will accept ‘a request for part payment’.

-  The school reserves the right to revoke the permission to pay tuition fees in instalments, if the parent/student fails to register for direct debit on time or if the direct debit transaction fails. In such a case it is required to pay all tuition fees for the term before continuing the course.

 

2. Private Lesson Policy

 

1. BOOKINGS

1.1 All private lessons need to be booked through the school administration per email or call/text. Contact Email: [email protected] or [email protected]

1.2 Students and teachers/staff are not permitted to book a private lesson without notifying the school administration.

1.3 All private lessons should be scheduled during school time.

1.4 If a student needs to book a private lesson in the holidays, they can ask for permission by notifying the administration 48h before the lesson.

 

PRIVATE LESSON PAYMENT/FEES

2.1 Private lesson packages are only valid for the current course year and one teacher.

2.2 All private lessons must be paid in cash directly to the teacher.

2.3 All private lessons must be paid before the first private lesson.

2.4 Please note that some choreographers/teachers might charge a higher fee for their private coaching and for setting new choreographies (Please contact the school administration to clarify the costs).

 

3. PRIVATE LESSON CANCELLATION/REFUNDS

3.1 Cancellation of a lessons must be made AT LEAST 24 hours prior to the scheduled lesson time in order to receive a make-up lesson (for definition of a make-up lesson, please see below).

3.2 Cancellation needs to be via text or email to [email protected].

3.3 No shows or failure to notify the school within 24 hours is considered a forfeited lesson.

3.4 There are NO refunds on unused or cancelled lessons.

3.5 Credits CANNOT be transferred from teacher to teacher.

 

4. MAKE UP LESSON (For Private Lessons only)

4.1 Any lessons cancelled at least 24 hours ahead will receive a make-up lesson at a time convenient to both the teacher and the student.

4.2 Typically, make-up lessons take place at an alternate time/day within the week. In some cases, the make-up lesson will be added after/before the original lesson time, enabling the student to have a longer lesson.

4.3 Make-up lessons not used after one month will be considered forfeited.

4.4 A make-up lesson can be booked with the school administration.

 

3. Duty of Care

Appeals

The School seeks to prevent appeals by ensuring that students are satisfied with their training. Teaching staff are expected to be fair in the conduct. Any complaint will be treated seriously, investigated thoroughly, and dealt with according to the merit of the complaint.

 

Duty of Care

Staff and students should exercise due care in undertaking their activities, particularly where others will rely on advice or information offered. Staff and students have a duty to take reasonable care to avoid causing harm (including physical harm) to anyone. Thus, staff and students should actively promote safe working practices and environments for everyone using school facilities. Staff and students also have a duty of care to follow instructions for safe working practices and to work and behave in ways which are safe and do not endanger the health and safety of others.

Staff will familiarise themselves with the School Policy on Student Care.

Accidents to staff, students and equipment must be reported to administration immediately according to the School’s safe dancing practices such as: always wearing the required uniform including footwear and accessing the first aid kit in the staff area for minor injuries.

 

EXTREME WEATHER POLICY

In the event of extreme weather conditions, email will be our principal method of communication providing up-to date information. If the government declares the extreme weather conditions as a ‘catastrophic’ or ‘code red’ fire day all classes at the School will be cancelled. Temperature readings will be taken from the Bureau of Meteorology website.

 

DUTY OF CARE – SECURITY

- Access to School premises is available from 3.30pm to 8.30pm Monday to Friday and 8.30am to 4.00pm Saturday. Students will not be able to gain access to the School prior to, or after, these times. - Staff members are always present during access hours; if a student arrives earlier than the above-mentioned entry times, they must wait in front of the entrance door.

-  Private possessions brought to the School or left on School property are the responsibility of the student concerned; the School cannot be held responsible for any loss or damage incurred. Personal insurance covering all students’ property is recommended. Private possessions, cash and jewellery may be left with reception staff. Where there are reasonable grounds for suspicion of theft, the Director, and/or designated staff may, in the presence of the student and another staff member, search property such as a bag or locker.

-  For security reasons students are not permitted to invite guests to the ballet centre, except in the case of official School events.

-  Students are expected to be collected from the studio by their parents. If there is an unavoidable delay, students are expected to advise a staff member that they have not been collected and stay within the premises until their parent arrives.

-  Students under 12 years of age are not to leave the School premises alone.

 

DUTY OF CARE – HEALTH AND SAFETY

In order to maximise ability, it is important for dancers to be healthy in mind and body and to enjoy their dancing. As part of the School’s commitment to student care, all students have access to group education and individual assistance with injury prevention and management. The School recognises the importance all staff members play in creating and maintaining a positive culture that can assist students to maximise their learning outcomes and maintain physical and emotional well-being and, therefore, has an established Health and Wellbeing Team.

Students are encouraged to request assistance from the health team or external health and medical specialists for a variety of reasons such as:

-  to maintain general physical and emotional health

-  to improve the mental aspect of dance performance

-  to design personalised nutrition plans which maximise performance
