Bayview Centre for the Arts (BCA) Terms and Conditions
Welcome to Bayview Centre for the Arts (BCA). By accessing and using our website, registration site, and participating in our programs, you agree to comply with the following comprehensive Terms and Conditions and Privacy Policy. Please read these carefully as they constitute a legally binding agreement between you and BCA. Users are required to acknowledge and agree to these policies as part of the registration process.
Scope of Services
BCA provides a range of services, including dance classes, fitness training, workshops, music programs, and other artistic and educational activities. These terms cover your use of our website, registration platform, and participation in all BCA programs, whether in-person or virtual.
User Responsibilities
By participating in any BCA program or event, users agree to:
Follow all guidelines and instructions provided by BCA staff and instructors.
Understand and accept the risks associated with physical activities, including but not limited to dance, movement, and fitness training.
Notify BCA of any pre-existing medical conditions that may impact participation and seek medical advice prior to engaging in activities if necessary.
Conduct themselves respectfully and in accordance with BCA’s behaviour policies.
Ensure they are physically capable of participating safely in activities.
Registration and Consent
Users must provide accurate personal information during registration. For participants under 18, a parent or guardian must complete the registration and consent process.
Minors: Parental or guardian consent is required for participants under 18.
18+ Self-Consent: Individuals aged 18 or older may self-consent to program participation.
Acknowledgment: By registering, users or their guardians acknowledge they have read and understood these terms.
Payments and Fees
BCA accepts payments via e-transfer, Stripe, PayPal, and other specified methods.
Users paying by credit card will be charged an additional transaction fee.
Payments must be made in advance unless otherwise specified.
Late or missed payments may result in loss of program access.
Cancellations, Refunds, and Rescheduling
General policies apply to cancellations, refunds, and rescheduling:
Cancellations by BCA: In case of low enrollment or unforeseen circumstances, BCA may cancel programs and issue full refunds.
Cancellations by Participants: Refunds may be requested before the program start date and are subject to approval. Acceptable reasons for cancellations include medical conditions or emergencies. Specific terms may apply per program.
Rescheduling: BCA reserves the right to reschedule programs. Participants will be notified and provided options to transfer enrollment or receive a credit.
Liability Waiver
Participants understand and accept that physical activities involve inherent risks, including but not limited to falls, sprains, fractures, or other injuries. By registering, users release BCA, its staff, volunteers, and affiliates from any claims or liabilities for injuries, damages, or losses sustained during participation, except in cases of gross negligence or willful misconduct. Participants also acknowledge that they assume full responsibility for any minor injuries, such as bruises or scrapes, and waive any claims related to accidental injuries, even those arising from unforeseen circumstances.
COVID-19 and Health Policies
Participants agree to adhere to all health and safety guidelines, including COVID-19 protocols such as mask-wearing and social distancing when required. BCA is not liable for any exposure to infectious diseases during program participation.
Photo and Video Consent
By participating in BCA programs, you consent to the use of photos and video footage for promotional and educational purposes, including social media, brochures, and other marketing materials. This consent is considered valid indefinitely unless revoked in writing. Participants can withdraw their consent by notifying BCA in writing.
Intellectual Property
All content, including recorded classes, videos, and educational materials provided by BCA, are protected by intellectual property laws and may not be reproduced, distributed, or used without explicit permission.
User-Generated Content
Users may be allowed to post comments or reviews on BCA platforms. BCA reserves the right to remove content that is inappropriate, offensive, or violates these terms.
Changes to Services
BCA reserves the right to modify or discontinue any service or program. Users will be notified of significant changes, and such modifications will be effective immediately unless otherwise specified.
Governing Law
These terms shall be governed by the laws of Ontario, Canada.
