Terms and Conditions

BOLLYON AUSTRALIA TERMS AND CONDITIONS

Please read these Terms and Conditions carefully before registering with BollyOn Australia. Your access and use of the service is conditions on your acceptance of and compliant with these Terms. These terms apply to all visitors, users and other who access or use the Service.

By accessing or using our Sites and/or Services, you agree to be legally bound by the following terms and conditions (the “ Terms of Use ”).

Please read these Terms of Use carefully. If you do not agree with any part of these Terms of Use you should refrain from using the Sites and/or Services. We may change, modify, add or delete portions of the Terms of Use from time to time at our sole discretion and your continued use of the Sites and/or Services constitutes your acceptance of those changes.

It is your responsibility to regularly check and/or review these Terms of Use and to decide whether you agree to abide by them and be bound by them. If you do not agree to be bound by or abide by these or any future Terms of Use, please do not use or access (or continue to use or access) the Sites and/or Services.

LIABILITY WAIVER

By registering at BollyOn Studios and accepting this waiver you agreed to the Release of Liability Agreement:

 

1. I am participating in classes, offered by BollyOn Studios. I recognize that dance classes require physical exertion that may be strenuous and may cause physical injury, and I am fully aware of the risks involved.

 

2. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the classes. I represent and warrant that I am physically fit and I have no medical condition that would prevent my participation in the classes. 

 

3. I understand that it is my responsibility to advise the instructor of any injuries or if I am pregnant so the instructor can provide suitable modifications where required.

 

4. In consideration of being permitted to participate in classes, I agree to assume full responsibility for any risks, injuries or damages, known or unknown, which I might incur as a result of participating in the lessons. 

 

5. In further consideration of being permitted to participate in classes, I knowingly, voluntarily, and expressly waive any claim I may have against the owners, instructors, and assistants, individually or otherwise, of BollyOn Studios for damages, and injury that I may sustain as a result of participating in classes.

 

6. I, my heirs or legal representatives forever release, waive, discharge and covenant not to sue BollyOn Studios for injury or death caused by their negligence or other acts.

 

7. I will not hold responsible/sue BollyOn Studios, instructors or employees for any injuries suffered by me caused whole or in part by my failure to follow the instructions of you or your employees or by any physical impairment of mine not fully disclosed to you in writing.


8. I give permission for my videos and photos to be used for publicity and advertising of the studio, on the BollyOn Studios website and social media platforms.

PARENTAL WAIVER

By registering at BollyOn Studios and accepting this waiver you agreed to the Release of Liability Agreement:

3. I understand that it is my responsibility to advise the instructor of any injuries my child has so the instructor can provide suitable modifications where required.

5. PURCHASE & CANCELLATION POLICY

When using our app/website, you are subject to the following terms, conditions, and policies. These can be updated from time to time. Make sure you read the terms and conditions before purchasing your classes.

1. BollyOn Studios is cashless. We do not accept cash or credit cards. All payments should be made online via bank transfer. The school reserves the right to discontinue the students' classes for nonpayment of fees before classes begin.

 

2. Please ensure that fees are paid via the application before you attend your class, if payments are made via bank transfer please send the screenshot to the management team. Please allow 3 working days for your enrollment to be approved to be activated. Credits will be activated immediately if payment is made directly via the application. 

 

3. Bookings are essential for all classes. Classes must be booked from within the app to manage capacity.

 

4. Fees are non-refundable for absence, non-attendance, change of mind, or any other reason.

 

5. Classes are valid only for the term. If you are unable to attend a class, you may replace your class with another from within the portal before the end of the term. Contact us if you are unsure which classes you are eligible to attend. Please note if you are unable to replace your class within the term, we do not offer a transfer of credit to the next term. 


7. If a class falls on a public holiday, it may or may not go on as usual. Please check your calendar for scheduled classes. If classes are canceled, a makeup class may be arranged.

 

IF YOU BELIEVE YOU ARE ELIGIBLE FOR SPECIAL CONSIDERATION OR CAN PROVIDE A DOCTORS CERTIFICATE, IT IS YOUR RESPONSIBILITY TO CONTACT BOLLYON STUDIOS WITHIN 1 WEEK OF YOUR CHANGE IN CIRCUMSTANCE. BOLLYON WILL TREAT APPEALS ON A CASE-BY-CASE BASIS.
