Terms and Conditions

Students:

1.      You understand and agree that teachers of Delanoy Dancers may use tactile feedback and instruction with students to support verbal feedback and instruction where appropriate.

2.      Delanoy Dancers reserves the right to permit the recording and photographing of students by staff (or other third-party photographers or filming companies on behalf of Delanoy Dancers) and audience members during an open class or show or other event.

3.      Delanoy Dancers reserves the right where appropriate to record or photograph students for educational and/or marketing purposes, which may include usage on social media.

4.      Further, where any photographs or footage has been taken, Delanoy Dancers reserves the right to sell DVDs and photographs of students performing at events to other members of Delanoy Dancers.

5.      A basic first aid kit is kept on the premises and staff members at Delanoy Dancers may administer basic first aid on students if necessary whilst a student is in class. However, to the fullest extent permitted by law (and subject to clause 18), teachers and Delanoy Dancers shall not be responsible for any injuries or accidents taking place within class that are outside our reasonable control. 

6.      If a student needs to take any of their own medication (whether self-administered or otherwise) whilst in class, the teachers or an appropriate representative of Delanoy Dancers must be informed. In any event, Delanoy Dancers accepts no responsibility for administering such medication (and/or the effects of the same) and the students’ parent/guardian takes full responsibility


 Financial, cancellation and amendment:

7.      Delanoy Dancers will invoice you as follows:

a.      Class Fees for each term will be invoiced prior to the end of the preceding term, and

b.      Additional Fees will be invoiced as and when they are applicable and, in all cases, payment must be received on or before the due date stated within the relevant invoice. 

Fees must be received by Delanoy Dancers before classes can commence. If you do not receive your invoice before the end of term, you should contact Delanoy Dancers by email urgently so that it can be resent and so that you can meet the payment deadline. It is the full responsibility of the parent / student to ensure they have received and paid their invoice before the end of each term for the subsequent term’s classes and if payment is not made by the deadline, late payment fees will apply. (See clause 8)

8.      Late payment: If payment of an invoice is not received on or before the due date, then a late payment fee of £10 will be charged (unless a prior arrangement has been agreed before the due date). If the correct payment is not made 48hrs before your or your child’s first class of the term, then you / your child will not be permitted into the class. 

9.   If you intend to withdraw your child from Delanoy Dancers or change any class(es) that your child undertakes, a minimum of half a term’s notice (with the notice being received in writing (letter or email is acceptable) on or before the last day of the first half of the term) and the withdrawal or change will take effect from the beginning of the next term. (N.B not next half term)

10.    If you withdraw your child from any class(es) after the last day of the first half term, then you will be obliged to pay for the first half of the following term’s fees.

COVID MEASURES:

11.      Delanoy Dancers will continue to implement some Covid prevention measures. However, no refund will be provided in the instances below:

(i)              a student / adult volunteer has a confirmed case of Covid-19 (or any other infectious disease) and it becomes necessary for the whole class to isolate and therefore classes do not operate

(ii)             classes have to be cancelled because a teacher has to self-isolate and Delanoy Dancers is unable to find a suitable cover teacher

(iii)            A class that requires an adult volunteer is not able to provide an adult volunteer for a class

(iv)            a student is unable to attend classes because they have to self-isolate

(v)             a student arrives later than is acceptable to join in

12.      A refund will not be provided if classes have to be cancelled due to force majeure such as fire, flood, storm, bad weather (including heavy snow disrupting transport), pandemic or epidemic of any disease, industrial action, war, civil unrest, terrorist threat or incident.


Illness:

13      Delanoy Dancers cannot be held liable for anyone who has attended the premises where we hold our dance classes contracting Covid-19 (or any other infectious disease).

14      If a student / adult volunteer shows symptoms or has a confirmed case of Covid-19 (or any other infectious disease) then you agree to inform us immediately so that we can inform the relevant persons (as per NHS track and trace strategy). 

 

Liability:

 15      Subject to clause 17, Delanoy Dancers accepts no liability for any injuries sustained whilst participating in a dance class. 

16      Subject to clause 17, Delanoy Dancers accepts no responsibility for loss or damage of personal belongings or property whilst in a dance class. 

17      Nothing in these terms and conditions shall in any way limit Delanoy Dancers’ liability for fraud or fraudulent misrepresentation or for death or personal injury caused by its negligence, or any other liability, which cannot be excluded at law.

Communication and Other Information:

18      To ensure that the work at the school is ethical, standards are well maintained and good practice is adhered to concerning working with children we comply with ISTD ''Code of Professional Conduct'' (copies available on request).

19      Delanoy Dancers has Public Liability Insurance (for further details please contact Fiona Delanoy).

20      Additional rules and guidelines or updates to these terms and conditions may be published from time to time via email. Your / your child’s continuing attendance at Delanoy Dancers’ classes will amount to acceptance of such updated terms and conditions.

Delanoy Dancers’ Privacy Policy:

21      Delanoy Dancers will use your information to keep in touch with you by newsletter and other group / individual communications. We will also store securely any other relevant information (including medical), which is disclosed to us by you, or transpires during the time that you are / your child is enrolled in the school. We will not disclose your information to any third party or send unsolicited marketing material, except as in clause 14.


ADULT STUDENTS

Please note Clauses 9 and 10 do not apply to adult students.
