TERMS AND CONDITIONS
Fees, Deposits and Refunds
1.A fee is charged for each class enrolled per term Each student will be charged a fee for each class type enrolled in per term. This fee is a set price and only will be discounted in accordance with clause 27 or for students who enrol in all class types offered at EDN Dance Company in which the student is eligible to enrol.2.Students are expected to attend all classes and an invoice will be raised for the whole term. Parents are required to inform EDN Dance Company of any absences as soon as practicable and preferably prior to class commencement.
3.A pro-rata invoice for students who enrol during the year will be issued to enable payment immediately.4.Refunds will not be given for non-attendance other than for the reason set out in Clause 16 or where the Code of Conduct has been invoked as set out in Clause 23.5.If no notice is given to advise of a student not returning before term begins, term fees must be paid in full for that term.6.If no notice is given in regards to a student not performing in the concert, costumes must be paid for. Costumes must also be paid for if a student has signed the concert commitment form.
7.Refunds will not be given where a class must be cancelled and rescheduled for the reasons set out in Clause 18.
Payment
8.Invoices must be settled by the terms as set on the invoice provided. All invoices received have 14 days from date of the invoice to be paid.9.Once costume invoices have been issued, they must be paid within the terms and on or before the due date set out in the costume invoice. Costume invoices must be paid if a student does not complete the year.10.Costume fees must be paid in full at least one month prior to dress rehearsal, to ensure all components of costumes are accounted for and ready to wear for EDN Dance Company’s end of year concert. Failure to do so will result in the student being unable to dance or otherwise participate in the end of year concert. If there any issues or concerns, please discuss this matter with Shea Giordimaina on or before 1st October 2022.11.EDN Dance Company accepts the following payment methods:a)by electronic transfer to the bank details provided on the payment slip at the bottom of your invoice. All electronic transfers must reference the student’s ID number (which can be found on the invoice) and name. Failure to do so may result in the payment being unidentified, the account remaining outstanding and the student not being admitted to class;b)by credit / debit card either in person at the premises of EDN Dance Company or via telephone number 0401 575 424;c)by cash, cheque or money order: i)via post addressed to the Finance Department, EDN Dance Company, 36 Graysharps Road, Hurstbridge, Victoria 3099; or ii)in person handed to your teacher in an envelope with the student’s name and class clearly printed on it.
12.EDN Dance Company will not accept any liability for cash or cheques left at EDN Dance Company Reception, loss of payment or the receipt of payments by any other persons not authorised to receive money on behalf of EDN Dance Company. All payments must be made in accordance with Clause 6above and for clarity, only EDN Dance Company teachers are authorised to receive payments on behalf of EDN Dance Company.
13.If a payment plan has been organised, an administration fee of $20.00 will be added to the total fees payable by the student for the particular term.
14.If payment plan is not completed by the agreed upon date, 10% of the fees will be added to the total fees payable by the student for the particular term.
Register, attendance and absence
15.A register for each class is maintained by the class teacher and records student attendance for the purposes of health, safety and security.
16. If a student is absent from class for four or more consecutive weeks for medical reasons and an original medical certificate for the absent period is provided to the class teacher or Shea Giordimaina,a refund of 90% of the fees paid for those classes not attended will be given. The medical certificate must be provided within one month of the absence otherwise no refund will be given.
17.If a student is absent from class, the student or, if the student is under 18 years of age, a parent/guardian of the student, MUST contact the studio to advise of this absence prior to the class commencement time.
18.If a class is cancelled due to a health epidemic, extreme temperatures or unforeseen events, no refund will be credited to the next terms invoice. If a teacher is unwell, a substitute teacher will be sourced and the class will proceed as normal. If a substitute teacher is unable to be found, the class will be cancelled with a refund for the cancelled class only given on the next invoice.
Late Payment
19.The payer of an invoice will receive both verbal and written notice if payment has not been received in accordance with these terms and conditions.20.EDN Dance Company reserves the right to charge a late payment fee in increments of $5.00 per week if an invoice remains unpaid after the first class of a new term.21.In the event of an invoice remaining unpaid for 60 days from the date of the invoice, EDN Dance Company reserves its right to engage a debt collection agency or take legal action to enforce and/or recover this payment. In this instance the payee is liable for all costs incurred including commission on collection of the additional costs and including legal demand costs.
22.If an invoice has not been paid at the start of term or upon enrolment in accordance with Clause 7, the student will not be allowed to participate in any classes until the invoice has been paid in full.23.Students are required to give 3 weeks notice if they wish to withdraw from a class. Failure to inform the EDN Dance Company staff of withdrawal will result in the forfeiture of all payments already made and proceedings to collect any debts that might remain unpaid for all students including any interest charges in accordance with Clause 20.24.If a student wishes to change class or to start an additional class, the student or, if the student is under 18 years of age, the student’s parent/guardian, must give their consent in writing to the Dance School Administrator so that they may be invoiced for the additional or new class.25.Students must not take dance classes at any other dance school while enrolled in any classes at EDN Dance Company.26.If a student wishes to take a class elsewhere that is of a type not offered at EDN Dance Company, the student or, if the student is under 18 years of age, the student’s parent/guardian, must obtain the consent of both Shea Giordimaina and the other studio director.
Discounts
27.Where two or more siblings attend classes at EDN Dance Company, the family will receive a 5%discount off their total fees for the term.
28.The discount will be reversed if payment is not received in accordance with Clauses 8-11.
29.In the event the eldest sibling leaves during a term, the discount will not apply at the start of the next term if only one sibling remains enrolled.
Waiver
30.Physical contact with students may be necessary by members of the teaching faculty for the purpose sof instruction. If you have any concerns regarding this matter, please contact Shea Giordimaina, the director of EDN Dance Company, to discuss the matter.
31.EDN Dance Company reserves the right to protect its students and teachers and therefore strictly NO VIDEOGRAPHY OR PHOTOGRAPHY is to be taken during any classes, rehearsals, dress rehearsals, photo day, concert day or any other EDN Dance Company events.
32.EDN Dance Company may post video footage or photos of its students and teachers only where media release forms have been filled in and signed by a parent, guardian or student over 18 years of age. These images and footage will only be used in an appropriate manner at all times.
33.Any parent/guardian, student, teacher or other person found to be posting/sharing unauthorised video footage or photography from class time/dress rehearsal/concert etc will be asked to remove the footage or photos immediately. Failure to do so will result in immediate dismissal from EDN Dance Company.
Code of Conduct
34.A Code of Conduct will be issued to students and parents/guardians of students. EDN Dance Companyrequests that all students and parents/guardians of students under 18 years of age familiarisethemselves with the Code of Conduct. Failure to observe the Code of Conduct may result in studentsbeing asked to leave. EDN Dance Company reserves the right to refuse any student prior to or afterenrolment. No refund will be given if the Code of Conduct has been breached.
Right to attend, change classes, withdrawal and termination of attendance
Content
35.EDN Dance Company reserves the right to alter the advertised programme and faculty without priornotice. The information in this and any other printed or electronic brochure/notice was correct at thetime of printing or publication on-line.
36.EDN Dance Company reserves the right to alter the class timetable at any time during the year. Oneweeks’ notice will be given in writing and by face to face communication.
Data Protection
37.EDN Dance Company holds information about our students and parents/guardians of students under18 years of age to enable us to carry out our business as a membership, dance education and training organisation. This information includes the contact details you supply to us and may also include information on examinations, courses and student records.
38.EDN Dance Company will not disclose your information to third parties outside of EDN Dance Company staff except where the law allows or requires, or where you have given your permission todo so. We may from time to time contact you individually about other carefully selected EDN Dance Company services which we think may be of interest to you.
Changes to the terms and conditions
39.EDN Dance Company reserves the right to change these terms and conditions at any time providing one term’s notice is given to students.
Agreement to the terms and conditions
40.Parents and guardians of students under 18 years of age attending classes are required to sign their acceptance of the terms and conditions for each student under their responsibility by signing the confirmation below and returning it to EDN Dance Company staff prior to the start of a new term. EDN Dance Company accepts electronic signatures as if signed in the original.
