Terms and Conditions

By enrolling with Electrix Dance Studio, you have agreed to the terms and conditions set out in this document, via your online enrolment.


This document comprises of all of the terms and conditions set by Electrix Dance Studio.

Any parent/guardian of an enrolled student under 18 years of age at Electrix Dance Studio, must agree to the terms and conditions set below.

Students over the age of 18 years old must agree to the terms and conditions set out below.

Students will be unable to commence classes until these Terms and Conditions are agreed to.

 

FEES, DISCOUNTS, PAYMENTS AND REFUNDS

     Fees

1.     A compulsory Annual Registration Fee of $55 per student is payable prior to the students first enrolled class.

2.         Class Prices:

o  Recreational classes - 45min: $17.50 per lesson  /  60min: $18.50 per lesson

o Performance Team – $28 per lesson

o  Private Tuition (30mins) - $28 per student, per lesson  

o  Duo Tuition (30mins) - $25 per student, per lesson  

3.    All class fees are billed per term and are payable prior to commencement of that term. All invoices have 14 day payment terms.

4.      Where an invoice remains unpaid in accordance with these Terms and Conditions, the payer will receive both written and verbal notice to advise that the payment has not been received.

5.      Electrix Dance Studio reserves the right to charge a late payment fee in increments of $5.00 per week, if an invoice remains unpaid after the students first class.

6.    In the event that an invoice remains unpaid for 30 days from the date of the invoice, Electrix Dance Studio reserves the right to engage a debt collection agency and/or law firm to take legal action to enforce and/or recover payment.

7.     In the event where an overdue account is referred to a collection agency and/or law firm, the payer will be liable for all costs which would be incurred as if the debt is collected in full, including commission on collection of the additional costs and including legal demand costs.

8.        Where an account remains unpaid for a term, EDS reserves the right to arrange a direct debit set up for the enrolled students funds for the remainder of their enrolment.

 

Costume Fees and Payments

9.       Costumes will be invoiced in Terms 2 and 3. When payment is finalised, costumes will be:

o  ordered (Term 2)

o  available for collection (Term 3 and 4)

10.   Failure to make payment may result in costumes not being ordered or available for collection. In this unfortunate event, the student will be unable to participate in the concert.

11.  Upon enrolment, students will automatically be set up with a personal EDS costume account where funds must be deposited each term.  Students will be notified of the amount required for deposit and costume account statements will be issued quarterly (upon request). 

 

 Payment Plans

12.   Where a Payment Plan has been arranged, an administration fee of $10 per terms payment plan will be billed.

13.   Should the Payment Plan not be paid in full by the agreed date, a late fee of $5 per week late, will be applied plus any fees and charges for bounced payments will be billed.

 

Discounts

  1. A 5% class discount is offered to all students that undertake multiple recreational classes only. This is not inclusive of private lessons or elite programs 
  2. Any discount will be reversed if payment is not received in accordance with clause 3.
  3. Discounts are not offered to students participating in private, duo or elite lessons. 


Making Payments

17.     Fees can be paid via the following methods:

o  Cash – must be handed directly to an authorised EDS Staff Member

o   Cheque - made out to Electrix Dance Studio

o  Electronic Funds Transfer – details are provided on each invoice. Each payment must include the students’ name to ensure payments can be correct identified and students are permitted to class.

o  Direct debit arrangements

18.  Electrix Dance Studio will not accept liability for cash or cheque payments left at Reception unattended.

 

Refunds

19.    The Annual Registration Fee in non-refundable.

20.  It is the expectation and responsibility of students to attend all scheduled classes. No refunds will be issued for missed classes.

21.   If a class is cancelled due to minimal students enrolled, all monies will be refunded for the classes that have not proceeded.

22.     Refunds will not be issued when a class must be cancelled and rescheduled. See clause 29.

23.     At the end of Term 4, any remaining funds in a student’s EDS costume account will be refunded.

24.     If costume orders have already been placed externally (this occurs in Terms 1 & 2) and a student then decides to cease their dance experience with Electrix Dance Studio, all ordered costumes must be paid for and collected upon delivery.

 

ATTENDANCE, ABSENCE, CLASS CHANGES AND WITHDRAWAL

Attendance

25.  Students are not permitted to participate in classed until invoices are paid in full at the start of               the term or upon enrolment. 

26. Attendance for each class will be recorded by an EDS Staff Member to ensure the health, safety              and security of our students.  

27. Students must attend all mandatory events set by EDS including Concert Rehearsals, Concerts and             Photo Day.


Absence

28.   Where absence is medically related for four or more consecutive weeks, an original medical certificate must be provided to be refunded 90% of the fees paid for those unattended classes. The medical certificate must be provided within one month of the absence otherwise no refund will be issued.

29.   If a class is cancelled due to a health epidemic, extreme temperatures or unforeseen events, no refund will be credited to the next terms invoice.

30.   If a teacher is unwell, a substitute teacher will be sought and the class will proceed as normal. If a substitute is unavailable, the class will be cancelled and rescheduled. No refunds will be given if attendance is missed. Electrix Dance Studio reserves the right to reschedule classes to appropriate times where the studio and teachers are available.

Where a student is absent from class, no make up lessons will be offered.

 

Class Changes

31.     Where a student would like to enrol in an additional class or make changes to their current timetable, advice must be provided to the EDS Director so that class attendance registers can be updated and invoice adjustments can be made.

32.    While enrolled at Electrix Dance Studio, students are not permitted to undertake classes of the same offerings as Electrix Dance Studio at any other dance studio. If a student wishes to undertake classes not offered by Electrix Dance Studio, consent must be obtained by both the EDS Director and the Director of the second dance studio.

 

Withdrawal

33.     If a student wishes to withdraw from a class, two weeks notice must be provided. Should a student withdraw and notice is not provided, this will result in the forfeiture of all payments already made and proceeding to collect any debts that might remain unpaid for all students including an interest charges in accordance with clauses 5-7.

 

PHOTOGRAPHY

34.     If photographs are taken by an authorised staff member or professional photographer, parental consent will be sought for internal/external display of photos (this is done via your agreement on the EDS Media Release Form).

35. EDS reserves the right to protect its students and teachers and therefore strictly NO VIDEOGRAPHY OR PHOTOGRAPHY is to be taken during class, rehearsals, photo day, concerts or any other Electrix Dance Studio event.

36.   Classes will be recorded by an Electrix Dance Studio staff member and posted in the classes’ PRIVATE facebook page for rehearsal use only.

37. Any parent/guardian, student, teacher or any other person found to be posting/sharing unauthorised video footage or photography will be asked to remove the footage/photos immediately. Failure to do so will result in immediate dismissal from Electrix Dance Studio.


PRIVACY AND CONFIDENTIALITY

38. Electrix Dance Studio is required to hold personal information of its students and parents/guardians that is provided by you upon enrolment.  This information is kept securely and only the EDS Director has access to this information.

39.   Personal information provided will not be disclosed to any third parties with the exception of being legally required to do so.

40.  Should there be a need for information to be disclosed (with the exception of in legal circumstances), Electrix Dance Studio will seek your permission prior to doing so.

 

MEDICAL

41.  It is the responsibility of the parent/carer and student to notify staff of any injury/medical condition prior to class commencement which may be a cause of concern during class.

42.    If the parent/carer or emergency contact for a student cannot be reached, Electrix Dance Studio will seek the relevant medical support for the student and the parent/carer will be fully liable for any associated costs.


AMENDMENT AND REVISION

43.     Electrix Dance Studio reserves the right to make amendments to these terms and conditions at any time and will ensure that one term’s notice is provided to enrolled students.

44.     Electrix Dance Studio reserves the right to make amendments to the yearly Timetable and Teaching Faculty and will provide two weeks’ notice both verbally and in writing.

 

GENERAL

  1. Students must wear the EDS Uniform in class and at all EDS related events.
  2. All students participate in classes and performances at their own risk. Electrix Dance Studio will not be held liable for any injuries sustained as a result of taking part in this activity.
