Throughout these terms and conditions, the terms “we”, “us” and “our” refers to Laura Zahra, sole proprietor of this website branded as “Elite Studios” and holder of VAT number MT25029036, operating at 62, Triq San Pawl, San Pawl il-Bahar, Malta, Europe. Throughout these terms and conditions, the term “this site”, refers to this website. By using this website you agree to these terms. If you do not agree to these terms, do not use this site.

General Terms

We reserve the right to refuse service to anyone for any reason at any time. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Website or designs and products displayed here or purchased from here. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Online Store Terms

You may not use our website for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

Accuracy of Information

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any color will be accurate.

Price and Product Modifications

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the products (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service offered through this website.

Order Cancellation

Our cancellation policy applies if a cardholder makes a purchase payable by credit card or debit card and requests order cancellation 10 days prior to attending to the first class. If the first class would have already been attended to or the cancellation request is made less than 10 days prior to the first class of the term then order cancellation will not be possible. Given that the cancellation is requested in advance of 10 days from term initiation, then we will cancel your order and refund you by means of store credit applicable through the use of a coupon code generated specifically for you. We only accept cancellation requests via email, and these must be made by replying to the original email sent to you via our website to confirm your order details. When applicable the coupon code with the store credit will be sent to you by return reply.

Refunds

In the event that we decide to terminate an entire term due to an unforeseen event such as one of our tutor partners not being able to attend the classes, a refund will be provided. In an event where a single class is cancelled, for example due to a tutor being sick or for other health or personal reasons an extra class will be added to the next consecutive week or in a week following the end of the original term thereby the term would be extended or adjusted accordingly by the same number of classes that would have been cancelled from our end. Due to the aforementioned, a full refund only applies if an entire term is cancelled and a partial refund (pro-rata) is only applicable in the event where a cancelled class fails to be re-scheduled from our end. When applicable, refunds are processed within 30 days from a written request. To make a request our client needs to reply to our email with the order information, in other words the original email sent to you when you placed the order.

Term Duration

When making a purchase via our website, you are buying classes for the next term unless otherwise stated on the specific item which you are purchasing.

Prohibited Use

You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.

Governing Law

These Terms of Service and any separate agreements we provide you shall be governed by and construed in accordance with the laws of Malta, Europe.
