Terms & Conditions

Please find below our full terms and conditions. By completing and signing the online portal registration form to enrol your child with Embody Dance, you are hereby agreeing to the terms and conditions detailed below.

Any dancer currently enrolled with Embody Dance who has not signed our online registration form is also bound to these terms and conditions by their continuing to attend classes. EMBODY DANCE is not liable for any injury related to dance if classes are taken at another establishment. 

1) PAYMENT

a) Invoices for timetabled classes are distributed via email at the start of each half term for that current half term.

b) Payments can be made by, Stripe, Contactless Payment or Cheque. Embody Dance is a cashless dance company. 

c) Any cheques returned unpaid will incur a £10.00 handling charge.

d) EMBODY DANCE reserves the right to refuse payment by cheque if this form of payment has been abused in the past.

e) All Accounts must be settled by the last day of the half term. This is a settlement period of approximately 42 days.

f) Accounts unsettled by the last day of the half term will have a 5% Surcharge added to them.

g) We reserve the right to suspend your dancer’s classes until any overdue payments have been received.

h) Statements are available at online any time through the class portal.

i) Unpaid invoices reminders will be emailed out during the half term.

2) UNIFORM

a) Uniform can be brought form our online shop. For current uniform please visit http://embodydance.co.uk/shop/.  Uniform must be paid for before receiving it at dancing.

b) For all classes, appropriate clothing suitable for dance must be worn – ideally the EMBODY DANCE T shirt, hoody and plain black leggings. Tap shoes must be worn for tap classes. Ideally for acro a plain black leotard, without arms, is to be worn underneath the EMBODY t-shirt to prevent any embarrassment of a t-shirt riding up during an acro move.

3) CREDIT NOTES

a) Credit notes are issued when a teacher cannot be present at a class through sickness, transportation issues or if a cover teacher cannot be arranged. These credit notes will be deducted from the following half terms invoice.

b) Fees are not waived in respect of family holidays, school trips, school exams, quarantine, short-term sickness or injury.

c) Instances of long term sickness or injury will be assessed on an individual basis.

4) TERMINATION OF CLASSES

a) If a pupil wishes to cancel a class EMBODY DANCE must receive written notice 2 weeks prior to the commencement of the half term for which notice is being given. Failure to do so will result in the customer being liable to pay for the subsequent half term fees.

b) Absence of notice or late notice for exceptional circumstances will be addressed on an individual basis.

c) In the event of a pupil leaving EMBODY DANCE with fees still outstanding, EMBODY DANCE reserve the right to pursue recovery of the debt by all legal means including court action.

5) CANCELLATION OF CLASSES

a) Occasionally it is necessary to temporarily change the venue of a class, postpone it to a later date or move it online via ZOOM or other online platforms. Where this occurs EMBODY DANCE will try to notify parents either by email, Facebook page, text, phone or word of mouth.

b) We reserve the right to cancel classes at any time up to and including the date the class starts. Should this occur we will endeavour to give you as much notice as possible via email, the Facebook page, text or phone/word of mouth and a credit note will be raised as mentioned in the ‘Credit Note Section’ 3a. 

c) If Embody cannot meet in a venue due to extreme weather or events beyond our control such as power outages or government lockdown a decision will be made as early as possible to cancel the physical class and move it online via ZOOM or other online platforms. Should this occur we will endeavour to give you as much notice as possible via email, the Facebook page, text or phone/word of mouth. Please note, when a class occurs online, we do not issue credit notes as the class is still taking place. 

6) MISCELLANEOUS

a) Duty of care, safety and conduct. All teachers are qualified, DBS checked and insured. 

b) Any changes to these Terms and Conditions will be announced on the Online Class Portal. 

7) EMBODY DANCE LIABILITIES

a) EMBODY DANCE does not accept responsibility for loss, damage or injury arising from errors or omissions on the online registration form whether completed by you or the person in charge of your child at the time of enrolment.

b) EMBODY DANCE does not accept liability for personal injury to any child attending class, with the exception of such injury being caused by negligence or default of any member of our staff, contract teachersor any other default on our part.

c) EMBODY DANCE does not accept any responsibility for loss or damage to personal property.

d) EMBODY DANCE does not accept responsibility for any loss or expense due to circumstances beyond our control.

e) EMBODY DANCE is only responsible for pupils while they are in their class. Children cannot be supervised whilst they are outside class FOR EXAMPLE IN THE WAITING ROOM. Young children must be collected promptly at the end of their class.

f) EMBODY DANCE holds Public Liability Insurance.

8) TEACHERS

a) Embody Dance engages industry-based professionals to instruct classes.  At times scheduled teachers may not be available and as such an alternative teacher of equal or greater qualification will replace the scheduled teacher.  Due to the nature of the entertainment industry and the high standard of teachers contracted at Embody Dance, teachers may rotate and change at the discretion of Emma Bright.

9) RESPONSIBILITIES OF PARENT OR GUARDIAN

a) These terms and conditions, and online enrolment forms you have signed, constitute an agreement between you and us in connection to classes or any services superseding any prior agreement.

Embody does not accept responsibility for the damage or loss of goods left on the premises prior to, during or after dance classes.

The student and their guardian release Embody Dance, their teachers, instructors, agents and directors from any responsibility in any way for loss or dance of its personal belongings or property.

The student and their guardian are solely responsible for their personal belongings and property whilst left of the premises.

The student and their guardian shall make no claim adversely impacting, causing hardship or undue stress on Embody Dance as a result of their actions.

b) Attendance at class is deemed to be acceptance of the current Terms and Conditions.

c) It is the responsibility of the Parent or Guardian to notify EMBODY DANCE of any illness or injury that may affect the child’s participation at class.

d) It is the responsibility of the Parent or Guardian to ensure that EMBODY DANCE has the correct details for you and your child and keep us updated of any changes to health.

e) It is the responsibility of the Parent or Guardian to regularly read their emails/website/Facebook for information in order to be fully aware of all upcoming events.

f) In the event that we consider you to be in breach of these terms & conditions or that your child is disruptive to other pupils or teachers or venue staff, we reserve the right to exclude your child from any activity within Embody Dance.

h) EMBODY DANCE hires many venues for classes; therefore, all EMBODY DANCE teachers, parents and pupils must be respectful to our neighbours and arrive & leave responsibly.

i) Photographs and video footage of pupils taken by EMBODY DANCE may be used on our website/Facebook page and for publicity and marketing purposes. By enrolling your child in Embody Dance you acknowledge that photos and videos may be taken and used for this purpose.

If you do not wish your child’s image to be used for these purposes, you must tick ‘No’ when asked for photo permission on the online portal consent form.  

j) It is the responsibility of the Parent or Guardian to ensure that their dancer/s adhere to updated Government and Embody Dance guidelines surrounding COVID-19.
