Terms and Conditions

By enrolling yourself (in the case of adult students) or your child (in the case of students under 18 years of age) in Fox Academy of Dance classes you (as the adult student, or the child student’s parent or guardian) acknowledge that you have read, agree to abide by, and (where the context requires) consent to, all of the terms, conditions, codes and policies referred to below. To Enrol at Fox Academy of Dance for Autumn Term 2020 onwards you agree to abide by the following:

1). I the legal parent/guardian accept and understand that appropriate physical contact may be necessary within dance and acro classes and hereby give permission for any teacher from Fox Academy of Dance to do so. Any person teaching for Fox Academy of Dance is required to undergo a Disclosure and Barring Service (formally CRB) check.

2). I the legal parent/guardian hereby give Fox Academy of Dance permission to use any still and/or moving image being video footage, photographs and/or frames depicting the student named above, whilst performing or in class with Fox Academy of Dance for any of the following uses: Advertisements, marketing, leaflets, or any other use such as for training, educational or publicity purposes or use on website.

3). I the legal parent/guardian understand a half terms written notice must be given if a student wishes to stop any class otherwise a half terms fees will still be charged.

4). I the legal parent/guardian understand all invoices must be settled on or before the first day of each term. Failure to do so will incur a 10% surcharge.

5). I the legal parent/guardian understand that any person who participates in dance and acro classes provided by Fox Academy of Dance shall do so at his/her own risk. He/she shall assume all risk involved, including but not limited to all loss or stolen property, cost, claim, injury, damage, or liability sustained while participating. Fox Academy of Dance will not be held liable for any misfortune that may occur.

6). I the legal parent/guardian agree to receiving marketing and promotional materials from Fox Academy of Dance *to ensure the confidentiality of your data and compliance with the General Data Protection Regulation Act (GDPR) any third parties contracted by Fox Academy of Dance are under a strict protection agreement. The Fox Academy of Dance will not publish or share your confidential data with any other third parties than mentioned herein.

7). I the legal parent/guardian confirm that I agree to Fox Academy of Dance using my data in the following way:

-Supply of information regarding you/your child's dance classes

-Supply of your contact details to our accounting software and email host to provide electronic invoicing (GDPR Compliant)

-Compliance with Fox Academy of Dance's legal obligations or processes.

8). In the event of sudden or unexpected closure or suspension of classes due to any ‘act of God’ including but not limited to snow, weather related closure or any closure advised by the Government or for health and safety purposes, Fox Academy of Dance will not be responsible for any refunds or make-up lessons. Fox Academy of Dance will endeavour to provide a virtual learning experience via Live Streamed Classes in the event that classes cannot take place within the studio. Students MUST not attend classes if they are unwell, shielding or self-isolating but may participate online. There will be no refunds for students not attending class due to illness AND/OR if government restrictions require us to stop face-to-face learning. If government imposed restrictions require us to once again close our doors we will revert to immediate online learning platforms. By re-enrolling with Fox Academy of Dance you are agreeing to this approach and understand that you will not be refunded for any fees paid.

9). Dance is a physical activity and whilst all reasonable care is taken, to the extent permitted by law Fox Academy of Dance is not liable for injuries sustained during classes, instruction, performance activities or otherwise. In the case of an injury or health concern in respect of your child, all reasonable efforts will be made to contact you promptly. But, in the case of an emergency, or in the event that you cannot be reached, Fox Academy of Dance will to seek medical attention for the student. This may involve Fox Academy of Dance rendering first aid to the student or calling an ambulance for the student. 

10). All parents prior to the beginning of term will be sent our Academy Code of Conduct. This should be read carefully by both parent and dancer and all regulations adhered to. 

FAILURE TO COMPLY

In the event of any failure to comply with any of the terms, conditions, codes or policies referred to on this page, Fox Academy of Dance reserves the right to cancel the student’s enrolment and in this situation any fees paid or payable will not be refunded.
