Face to face Guidelines for a Covid 19 safe return to dance classes April 2021
1. There will be a one-way system in place. Pupils will enter through one door and leave from another. On Tuesdays a fire exit door with be used for entry to avoid other clubs that are using the Centre.
2. Lesson start/finish times will be staggered to reduce congestion and contact at all times.
3. Common contact surfaces will be cleaned between lessons.
4. Anti-bacterial gel will be provided to be used upon entering and leaving the community Centre. (minimum 60% ethanol or 70% isopropanol).
5. Please can students arrive for class ‘ready to go’ and as such minimize use of changing and toilet facilities.
6. Please can students bring their own named water bottle if needed. Reduce items brought to class – e.g., coats and bags (only bring in bags with required items).
7. Parents of children aged 3-5yrs are to park and walk their child to the entrance to be handed over to a member of staff (remaining 2m from other families). Ideally only one parent should accompany them. Please do not gather at the entrance or exit. On pick up please wait in cars until you see the door open and then form a queue with 2m between each other to pick up.
8. Pupils over 6 years should ideally walk themselves straight to the entrance after getting out of the car (I do understand that some parents will want to accompany their child to the door. This is fine as long as distancing is maintained). Similarly, on pick up they will come out one at a time and go straight to cars. Parents will need to distance appropriately if they want to get out of their cars to pick them up.
9. Please be on time to drop off and pick up.
10. Verbal confirmation will be sought from parent or career of 3-5yr old's that they have not been displaying any signs/symptoms of COVID-19. Older students will be asked for verbal confirmation on arrival that they feel well.
11. If your child (or anyone in your household) is unwell with possible COVID 19 symptoms they should stay at home and not attend face to face dance activities
12. Harriet Kincaid School of Dancing agrees to adhere to the UK government and the Worldwide Heath Organization (WHO) recommended ways to prevent the spread of infection.
13. Harriet Kincaid School of Dancing works closely with our venue and a professional risk assessment organisation to do all that is reasonably practicable to prevent the spread of COVID infection. Our COVID-19 risk assessment policy is available on request.
14. We will keep a record of all participants’ names and telephone numbers and will only provide these to the venue if requested for the purpose of track and trace.
Trial lessons for new pupils
1. Each new pupil is entitled to two bookable paid trial lessons. These are payable weekly.
2. New customers will be required to complete an information and consent form prior to themselves / or their child attending their first class.
3. On completion of the trial class (s) customers will be given the option to pay and book for classes for the remainder of the current half term.
Payment of fees
1. Classes are payable in termly blocks. They can be paid in instalments, but payment should be received in advance of the lesson/s. The payment for each term directly reflects the number of weeks in that term. If a child starts part way through a term payment will be calculated based on the remaining weeks. Half a terms notice must be given to cease lessons.
2. Payments will be accepted via bacs transfer or cheque.
3. The placement of pupils in classes will be determined by Harriet Kincaid School of Dancing. Considering, age, ability, and previous experience.
4. Invoices will be sent out via Class Manager prior to the start of the term and should be paid within 14 days of being sent.
5. All deposits for lessons fees are non-refundable except in the event of cancellation by Harriet Kincaid school of Dancing.
6. A follow up invoice will be sent after 14 days. Late payments for the half term will incur a £5 administration fee. If no payment is received after 28 days, we reserve the right to suspend the customers access to classes.
Discounts and Refunds
1. Please note that all classes must be paid for even those that a child is absent for. Non- payment may result in our decision to withdraw the customers place in the class.
2. In extenuating circumstances refunds can only be provided at the discretion of Harriet Kincaid school of Dancing.
Waiting lists
1. If a customer chooses to leave classes and later wishes to return, they may do so subject to a place being available.
2. If your preferred class is full then we will do our best to offer an alternative class or place you on the waiting list.
3. Please note that under COVID 19 restrictions there are strict limits on the numbers in classes to enable us to follow Government guidelines and regulations.
Appropriate attire for classes
1. Students should wear appropriate dress for class. This should be Harriet Kincaid school of Dancing uniform, (from hks.mydancestore.co.uk) except for new pupils who should wear clothes that they can dance in comfortably (e.g., leggings, t shirt).
2. Ballet socks or tights are considered preferrable for ballet classes.
3. Long hair should be tied back.
4. New pupils are not expected to have the correct dance footwear, but we do ask that they have clean shoes to wear in lessons.
Liability
1. A fully qualified teacher will lead all classes. They will be DBS checked and insured and be fully aware of our child protection policy (available upon request).
2. Due to the nature of teaching dance sometimes it is necessary for the teacher to correct positions physically or to provide physical support for a movement. This will always be done in a professional manner and following the guidelines in our risk assessment and child protection policies.
3. We will always do our best not to cancel lessons but if this becomes necessary E.g., through teacher illness, or problems with the venue, we will give you as much notice as possible. We will do our best to offer an alternative or extra lesson. If we are unable to this, we will credit any fees paid towards future invoices.
4. Neither Harriet Kincaid school of Dancing or our venues will accept any responsibility for loss or damage to personal property and possessions.
5. The customer has a responsibility to notify Harriet Kincaid school of Dancing of any illness or injury that may affect the participant’s ability to take part in a class.
6. The customer has a responsibility to notify Harriet Kincaid school of Dancing of any medical conditions a student may have and to keep us updated of any changes to this or new conditions.
7. We do not accept responsibility for loss, damage or injury arising from errors or omissions from the pupil registration form whether completed by the guardian or another adult at the time of enrolment.
8. We do not accept liability for death or other personal injury to any participant. With the exception, of an injury being caused by negligence on our part.
9. We do not accept responsibility for loss or expense due to circumstances beyond our control such as transport, fire, and weather conditions.
Mobile Phones
1. Parents/guardians may take picture/video their own child/children only when it is watching week. These are for personal use only and may not be put on any social media sites (eg Facebook,Instagram) unless they are specifically of ONLY their own child.
2. If a parent is viewing a lesson, we respectfully ask that they do not use their mobile phone for calls whilst in the studio. Please have them on silent.
3. Mobile phones should be placed in silent mode during classes and remain in the students dance bag, it is courteous to ask the teacher in charge if it is felt that a pupil may need to use their phone during a class.
4. In certain circumstances such as the filming of student’s own work, or for the filming of older pupils and adults work the teacher may give permission for the pupils to use their own device. (E.g., a trainee teacher who wished another pupil to film their choreography to allow them to remember it)
5. If you wish to photograph your child (E.G. Attending ballet with the class mascot) please ask the permission of the teacher in charge and we will do our best to accommodate this for you.
Photographs/Video
By agreeing to these terms and conditions you consent to Harriet Kincaid School of Dancing using any photographs or video taken to advertise or publicise the school.
First Aid
In agreeing to our terms and conditions you consent for a qualified first aider to administer first aid treatment to yourself / or your child if required whilst they are attending dance activities. The first aider will wear appropriate PPE in line with Govt advice regarding COVID 19 measures. If you have any questions regarding this, please contact us.
Additional information on dance classes delivered on zoom
Important Notice for parents & participants
In the event of further government restrictions or lockdowns which require our business to close Harriet Kincaid School of Dancing will move to a temporary timetable of zoom dance classes.
Please note parents are responsible for their child’s safety at all times whilst using their home dance space.
Please ensure that there is enough space to participate without obvious risk of injury to the participant or others, or risk of damage to property.
The flooring in the room should be safe for the activity undertaken.
Younger pupils should have a parent in the same room with them during the class.
Harriet Kincaid School of Dancing will not accept liability for injuries that occur whilst taking part in classes.
Terms and Conditions of Sale
Introduction
These Terms of Purchase set out how you (the User) can use and make purchases from our Site and directly from your teacher. Please read them carefully. We pride ourselves in providing a high level of customer service and ensuring that you are clear in respect of all of your rights relating to your purchase. Ahead of making any purchase you will be asked to tick a box on our Site which says “I Accept the Terms and
Conditions of Sale”. In ticking that box, you will be accepting the terms set out here.
We are based in the UK and our Terms of Purchase are governed by UK legislation. We cannot offer international shipping and our digital documents can be downloaded worldwide.

It is always our aim that you will be fully satisfied with your purchase. Should you have any questions about your purchase we will be happy to assist.
Purchase Terms for Classes
We offer a wide range of in person and online dance classes. Please ensure that you attend/login to the class at least 10 minutes prior to the start of the class so that any modifications can be discussed and so that you can obtain key information about the class prior to starting.
Anyone attending later than five minutes after the start time will not be permitted entry to the class for their own safety and for the safety of , and to preserve the enjoyment of, other attendees. Fees for classes when there is late attendance will be forfeited.
Before taking part in any of our classes you must ensure that you or your child is wearing suitable clothing including footwear, has their hair tied back appropriately and brings their own water if needed, have a safe environment to exercise in (if taking part online at least 2metres by 2metres and not outside) and you are free from injury and in good health. If you are new to exercise or you are recently returning from injury, illness or pregnancy, you must speak to a health professional prior to starting any dance class.
If you or your child have any health concerns, injuries or longstanding medical conditions you must notify the instructor at the beginning of the class and follow the modifications advised throughout the class.
If at any point during the class you feel unwell or light-headed you must stop exercising immediately and request assistance.
You have the option to purchase classes on an individual basis (for Adult classes only) or as a block of classes. Should you make a block purchase you will receive credits for future classes. All credits must be used within three months of the initial purchase date. Should you wish to cancel a private class you must provide 48hours’ notice, otherwise you will still be charged. Refunds are available in accordance with your statutory rights.
Purchase Terms for Products (show costumes and school tops/hoodies/bags)
We have worked hard to create products of high quality. For the individual detail and specification of each product, please see the product description which accompanies each product listing. Please note that we take all reasonable steps and care to ensure that all details, product descriptions and prices of products are accurate. Although we aim to keep this Site as up-to-date as possible, the information available on the Site may not reflect the availability position at exactly the moment you place an order.

CancellationRights
Asaconsumerpurchasingonlineyouhavethelegalrighttocancelyourorderwithus.Yourrighttocancelbeginsonthedateyouplaceyourorderandends14calendardaysformthedayafteryoureceivetheproduct.
Youneednot provideareasonforcancellingyourorder; however,youmust emailusat[email protected]tocancelyourorder.Wherepossiblepleaseincludeyourordernumberinthecorrespondence.Wewillthenrespondbyemailtoconfirmthatwe havereceivednotificationofcancellation.
Incircumstanceswhereyouhavealreadyreceivedyourproducts.Youwillberequiredtopackageuptheitemandreturnitatyourowncost.Allproductsmustbereturnedintheiroriginalpackagingandcondition,plusanyadditionalpackagingforreturns.Wereservetherighttoreducetheamountofanyrefundofferedtoreflectanyreductioninthevalueoftheproductwhichiscausedbythewayitis handled or returned by you. Following receipt of the returned products we will arrange for arefundtobereturnedtothecardusedforthepurchase.Pleaseallowupto14daysfortherefundto
showonyourbankstatement.Youwillreceivearefundforthepricepaidfortheproductandtheoriginaldeliverychargesbutyouwillnotreceivearefundforthecostofreturningtheproducttous.

Exclusions
PleasenotethatwhilstweproviderefundsinaccordancewiththeConsumerContracts(information,Cancellation and Additional Charges) Regulations 2013, as set out above, as permitted by thatlegislation,weareunabletoacceptrefundsofthefollowing:
1. Itemswhichcannotbereturnedforhealthandhygienereasons,unlessthereturnedtousunusedandinafullyresealableconditionwithallhygienicsealsinplaceandunbroken;
2. Itemswhicharepersonalisedormadetoyourspecification;
3. Productswhichareliabletodeteriorateorexpirerapidly.
4. Items purchased through the hks.mydancestore.co.uk. Refunds for these items should be sorted directly with them.
FaultyGoods
Nothinginthesetermsaffectsyourlegalrightsinrespectiveofproductswhicharedefectiveornotasdescribed.
Ifyouthinkaproductisdefectiveormis-describedthenpleaseemail[email protected]withadetaileddescriptionofthefaultand,ifpossible,photographs ofanywearandtearorsimilardamagetotheproducts.

All returns made as potentially defective will be examined once they have been received by us andwewillnotifyyouviaemailtoconfirmifyouareentitledtoarefund.Faultygoodswillbereplacedwithalikeforlikereplacementwherepossible.Ifyouareentitledtoarefundthiswillbeprovidedwithin30daysofwhenwenotifyyouviaemailthatyouareentitledtoarefund.Ifyouareentitledtoarefundasaresultofadefectiveproduct,youwillreceiveafullrefundofthepricepaidfortheproduct, the originaldelivery charges andthe costofreturningthe producttous.
Pricing
Thepricesareasquotedonthe email/school noticeboard/websiteforeachitem.Prices do includeVAT.Theproductpricingalsoexcludesdeliverychargeswhichwillbeaddedtothetotalamountatthecheckout (unless delivered by hand, when there will be no delivery charge)
Wemaychangeourpricesatanytimebutchangeswillnotaffectanyorderinrespectofwhichwehavealreadysentyouanorderconfirmation.
Itisalwayspossible,despiteourbestefforts,thatsomeproductslistedonourSitemaybeincorrectlypriced.Wewillnormallycheckpricesaspartofourdispatchproceduressothat,whereaproduct'scorrectpriceislessthanourstatedprice,wewillchargeyoutheloweramountwhendispatchingtheproducttoyou.Ifaproduct'scorrectpriceishigherthanthepricestatedonourSite,we will contact you to inform you of the error and give you the option of either continuing yourpurchaseoftheproductatthecorrectpriceorcancellingyourorder.Ifweareunabletocontactyouusingthedetailsyouprovidedduringtheorderprocess,wewilltreatyourorderashavingbeencancelled and notify you in writing. Delivery
Unless youarepurchasinganitemonpre-orderor abespokecustomisation(whereinsuchcircumstancesanestimateddeliverydatewillbeprovided)deliverywilltakeplacewithin15calendar daysof thedateof theorderconfirmation.Our ordersareusuallysentout as soon as they are ready andshouldreachyouwithina 15 day period.
If we do not deliver your product within 15 calendar days or within the other time period agreedbetweenus,youmaycontactustocancelyourorder.Wearenotresponsiblefordelaysoutsideofourcontrol.Wewillcontactyouassoonaspossibletoletyouknowofanydelaywhichmayoccurtoyourorderandwewilltakestepstominimisetheeffectofthedelay.

WarrantyandLiability
Wewarranttoyouthatanyproductpurchasedfromuswill,foratleastaperiodofsixmonthsfromthe date of delivery, be of satisfactory quality, free from material defects and reasonably fit for allthepurposesforwhichproductsofthekindarecommonlysupplied.
Wewillnotbeliableforanydefectintheproductarisingfromfairwearandtear,failurebyyoutofollowspecificcareinstructions,wilfuldamage,abnormalstorage,accident,negligencebyyouoranythirdpartyoranyalterationorrepairmadebyyouorathirdparty.
Ourliabilityforanylossesyousufferasaresultofusbreakingthesetermsislimitedtothepurchasepriceoftheproduct youpurchasedandanylosseswhichare aforeseeableconsequence ofus
breakingtheseterms.Lossesareforeseeableiftheyareanobvious consequenceofabreachortheywerecontemplatedbyyouandusatthetimethepurchasewasmade.
Wedonotexcludeorlimitinanywayourliability:
1. Fordeathor personalinjurycausedbyour negligence;
2. Undersection2(3)oftheConsumerProtectionAct1987;
3. Forbreachofthetermsimpliedbysections 12to15oftheSaleof GoodsAct1979;
4. Forfraudorfraudulentmisrepresentation;or
5. Foranymatterforwhichitwouldbeillegalforustoexclude,orattempttoexclude,ourliability.
Weonlysupplyproductsfordomesticandprivateuseandyouagreenottouseanyproductsforcommercial,businessorre-salepurposes,andwehavenoliabilitytoyouforanylossofprofit,lossofbusiness,businessinterruptionorloss ofbusinessopportunity.

All refunds are provided in accordance with your statutory rights.
Law and Jurisdiction
These terms and any claim or dispute arising in relation to any purchase will be governed by Englishl aw. You and we agree that the courts of England and Wales shall have non-exclusive jurisdiction to settle any such claim or dispute.
