Terms & Conditions

1.      Definitions

a.      “Enrolment form” means the form relating to the enrolment of the pupil for a course provided by JPJ Dance Ltd

b.      “Course” means a series of classes provided by JPJ Dance Ltd.

c.      “Teacher” means the individual employed by JPJ Dance Ltd to teach classes. Whilst every effort will be taken to maintain consistency of teaching during the course, JPJ Dance Ltd retains the right to change teaching staff where necessary.

d.      “Fees” means the amount of money chargeable to attend classes for a term as specified.

e.      “Parent” means the parent or legal guardian of the student participating who will be responsible for payment of the fees and is the contracting party to this contract and is also responsible for compliance with these terms and conditions.

f.       “Pupil” means the child or student attending the course and whose details are specified on the Enrolment form.

g.      “Premises” means the Dance studio, hall, rooms, attached buildings and surrounds where the class is held.

h.      “JPJ Dance Ltd” means the company or organisation with whom you have entered into this contract.

i.       “Term” means the period and agreed dates as specified by JPJ Dance Ltd.

j.       “Terms and Conditions” means the terms and conditions set out in this document and agreed in writing by the Parent and JPJ Dance Ltd.

k.      “Website” means the website at www.jpj.dance

 

 

2.      Acceptance

a.      All agreements and issues relating to the teaching of classes by JPJ Dance Ltd to the pupil and on-going communication with teachers, office staff and directors are subject to these terms and conditions to the exclusion of all others.

b.      No variation or addition to the terms and conditions shall be binding unless agreed in writing by JPJ Dance Ltd and the Parent.

c.      These terms and conditions shall be deemed to be accepted once the enrolment form is signed and confirmation of payment of the fees has been received by JPJ Dance Ltd.

d.      JPJ Dance Ltd may cancel this contract at any time before the pupil commences a term for any reason whatsoever. JPJ Dance Ltd shall not be responsible for any loss or damage whatsoever arising from such cancellation but will refund any fees for classes not attended.

 

3.      Confidentiality

a.      By agreeing to these terms and conditions the parent and pupils agree not to share any aspects of the JPJ Dance Ltd programme with any third party who may be involved in a business that operates in the same market as JPJ Dance Ltd.

b.      The parent and pupils will not take, replicate or use any of the JPJ Dance Ltd material directly or indirectly for his or her own use or for use by a third party.

 

4.      Parent Obligation

a.      The Parent warrants that the information provided on the enrolment form is accurate and up to date in all respects at the time of enrolment. Any changes must be sent immediately to JPJ Dance Ltd as and when they occur.

b.      It is the responsibility of the Parent to inform JPJ Dance Ltd of any special medical conditions relating to the Pupil at the point of enrolment. This includes any behavioural disorders.

c.      The Pupil must not attend the Class whilst displaying symptoms of any illness or contagious disease or anything similar thereto. Or if they have been instructed to isolate.

d.      The Parent agrees and accepts the sole responsibility for the general conduct and care for the pupil prior to the class and following the class whilst on the premises.

e.      JPJ Dance Ltd shall have the sole right to exclude a Pupil and/or Parent permanently or for a period determined by JPJ Dance Ltd (at its discretion) if deemed necessary for the safety and wellbeing of other pupils.

f.       Any student wishing to be entered for examinations from Grade 1 or above must seek the prior and written consent of JPJ Dance Ltd before commencing any third-party dance class or attending any third party dance school. Failure to obtain consent may, at the discretion of JPJ Dance Ltd, result in the student not being entered for examinations. JPJ Dance Ltd has the right to withdraw any pupil from an examination at any stage.

 

5.      Limitation of Liability

a.      The Parent agrees that any claim made against JPJ Dance Ltd must be made in writing within 30 days of any such incident arising and failure to report in writing within this timeframe will negate any such claim.

b.      The maximum aggregate liability for JPJ Dance Ltd to the Pupil or Parent shall not exceed the fees of the current term.

c.      Neither JPJ Dance Ltd nor any Teacher, Assistant or employee or agent or other representative accepts responsibility in respect of loss or damage, or expense incurred by the Pupil or Parent arising in any way directly or indirectly or in any way connected with the attendance of the Pupil or Parent at the Classes (or any class) or any other act or omission on the part of JPJ Dance Ltd its Teachers, Assistants, employees’ agents, or representatives.

d.      All warranties and conditions whether implied or by statute or otherwise are excluded from this contract provided that nothing in this contract shall restrict or exclude liability for death or personal injury caused by the negligence of JPJ Dance Ltd, its Teachers, Assistants, employees, agents or other representatives or affects the statutory rights of the Pupil or Parent.

e.      In the event of guidance or instruction from local or central government, due to public emergency including pandemic, classes will be replaced by online classes, JPJ dance Ltd reserves the right to amend the timetable.

 

6.      Fees,  Payment & Termination

a.      The Parent shall pay the fees to JPJ Dance Ltd for each Term within 7 days of the commencement of that term. 

b.      The Fees are not refundable in any circumstances whatsoever without the specific written consent of JPJ Dance Ltd.

c.      Parents wishing to terminate the contract must notify JPJ Dance Ltd by week 8 of the term preceding termination.

d.      If the Parent does not notify JPJ Dance Ltd of termination by week 8 of the current term the Pupil will be automatically re-enrolled for the next term and fees will become due at the commencement of the next term.

 

7.      General

a.      By agreeing to these terms and conditions the Parent consents to the data (non  financial) can be shared within the JPJ Dance Ltd.

b.      The Parent shall indemnify and keep indemnified JPJ Dance Ltd against all loss (including loss of profit) liability and expense which JPJ Dance Ltd may incur directly or indirectly as a consequence of any action or inaction by the Parent or Pupil.

c.      Any notices to be sent by one party to the other may be sent by recorded delivery or be delivered by hand (and via email and text) and shall be deemed to have been delivered and received by the addressee within 48hours of posting or immediately if delivered by hand.

d.      Failure by either party to enforce at any time or for any period any one or more of the obligations arising under this contract shall not be a waiver of them or of the right at any time subsequently to enforce any or all of such obligations.

e.      These terms and conditions constitute the entire agreement between the parties hereto and supersede prior agreements and understandings between the parties.

f.       This contract shall be governed by the laws of the United Kingdom and the parties submit to the exclusive jurisdiction of the UK courts.
