KS DANCE ACADEMY

TERMS & CONDITIONS

2026/27

These Terms & Conditions explain how places, fees, attendance, cancellations and participation are managed at KS Dance Academy. They are designed to keep expectations clear and ensure the school runs fairly and consistently for all students and families.

KEY TERMS AT A GLANCE

·       KSDA operates a 40-week teaching year.

·       Fees must be paid by the stated due date.

·       Multi-class discounts of up to 30% are available, plus an eligible 5% sibling discount.

·       Four weeks' written notice by email is required to remove a class or leave KSDA.

·       Fees remain payable during the four-week notice period, whether or not the student attends.

·       Student absences and missed classes are not refundable.

·       Places continue automatically unless the required notice is given.

·       Where KSDA cancels a class, we will first try to provide a replacement, rescheduled or suitable alternative class.

·       Exam, competition, costume, show, event and other third-party costs may become non-refundable once committed.

Nothing within these Terms & Conditions affects your statutory consumer rights.


 

1. REGISTRATION & COMMUNICATION

All students must be registered with KS Dance Academy (KSDA) before attending classes.

Parents/guardians are responsible for providing accurate and up-to-date contact, emergency, medical and other relevant information. Please notify us promptly of any changes that may affect your child's safety or participation.

Email is our main method of communication. Parents/guardians are responsible for providing a valid email address and checking KSDA communications, including junk or spam folders.

Administrative queries should be sent by email rather than discussed with teachers during teaching time.

We aim to respond within a reasonable timeframe, although replies may take longer during school holidays, office closures, shows, competitions and particularly busy periods.

2. TRIALS & JOINING KSDA

Trial offers may be available to new students and will be communicated separately.

Trials must be arranged in advance and are subject to class availability. A trial does not guarantee a permanent place.

After the trial period, continuation must be confirmed with KSDA. Once a permanent place is accepted, the normal fee, payment and withdrawal terms apply.

KSDA may recommend a different class where we believe it would better suit a student's age, ability, experience or development.

3. CLASS PLACEMENT, PROGRESSION & TIMETABLES

Students are placed in classes according to factors including age, ability, experience, technical level and individual development.

Progression is determined by KSDA teaching staff. Students of a similar age will not necessarily progress through grades or levels at the same time.

Our timetable is planned around student numbers, teaching staff, venues and the overall needs of the school.

KSDA may make reasonable operational changes, including changing a teacher, class time, level or venue, or combining or splitting classes where necessary.

We will give as much notice as reasonably possible of significant changes. Where a change materially affects the service originally agreed, affected families will be contacted directly and applicable consumer rights will continue to apply.

4. FEES & PAYMENT

KS Dance Academy operates a 40-week teaching year.

Current class fees are communicated separately and may be reviewed periodically.

Fees must be paid according to the payment arrangements in place and by the due date stated on the invoice or payment schedule.

For Term 1 of 2026/27, fees will be invoiced as normal. KSDA intends to introduce monthly Direct Debit payments after Term 1, with full details provided separately before implementation.

A student's place is reserved for them and continues automatically unless KSDA receives the required four weeks' written notice.

Where payment becomes overdue, KSDA may apply a previously communicated reasonable late-payment or administration charge.

If fees remain unpaid, KSDA may suspend attendance until the account is brought up to date and may ultimately withdraw the student's place.

Parents/guardians should contact KSDA promptly if there is a problem with an invoice or payment.

5. MULTI-CLASS & SIBLING DISCOUNTS

KSDA offers extensive discounts to support students taking multiple classes.

Depending on the number of eligible classes taken, multi-class discounts of up to 30% are available under the current fee structure.

An eligible 5% sibling discount is also available to families with more than one child enrolled at KSDA.

Discounts are applied according to the current published fee structure and eligibility criteria and may be reviewed periodically. Any changes will be communicated before they take effect.

Where a credit or refund for an individual class is due, this will be calculated using the actual amount paid for that class after applicable discounts, rather than the full undiscounted class price.

6. ATTENDANCE & MISSED CLASSES

Regular attendance is important for student progression and for the continuity of the class.

No refund or fee reduction will normally be provided where a student misses a class due to illness, holidays, school commitments, other activities, transport difficulties, family circumstances or personal choice.

Fees reserve the student's place and contribute towards ongoing teaching, venue and operating costs, which continue regardless of individual attendance.

Where appropriate and space permits, KSDA may offer a suitable catch-up class following illness. Catch-up classes are offered at our discretion and cannot be guaranteed.

Please let us know when your child will be absent where possible.

Repeated absence may affect a student's progression and eligibility for exams, competitions, performances or other opportunities where regular training is required.

7. IF KSDA CANCELS A CLASS

We will make every reasonable effort to run classes as scheduled.

If KSDA needs to cancel a class, we will first try to provide a reasonable alternative, such as:

·  A replacement teacher

·  A rescheduled class

·  A suitable make-up class

·  Another appropriate alternative arrangement

Occasionally, a class may be affected by unforeseen or unavoidable circumstances. These may include teacher illness, serious family illness or emergency, bereavement, severe weather, emergency venue closure, utility failure, transport disruption or other unexpected circumstances outside KSDA's reasonable control.

In these situations, KSDA will make every reasonable effort to provide a replacement teacher, alternative class, rescheduled session or other suitable arrangement.

Where KSDA cancels a class and a reasonable alternative cannot be provided, an appropriate credit or refund will be provided where required.

Any credit or refund will be based on the amount actually paid for the affected class after applicable multi-class and/or sibling discounts. Where appropriate, a credit may be applied to a future invoice or payment.

The matter will always be handled fairly and in accordance with applicable consumer rights.

8. LEAVING KSDA OR REMOVING A CLASS

KSDA requires four weeks' written notice to leave KS Dance Academy entirely or withdraw from an individual class.

Notice must be given by email. The four-week notice period begins when KSDA receives the written notice.

The student's place remains reserved throughout this period and all fees falling within the four-week notice period remain payable, whether or not the student attends.

Stopping attendance does not constitute notice. Telling a teacher verbally, by message or in class does not replace written notice by email.

If fees have already been paid beyond the applicable notice period, any balance due will be dealt with according to the payment arrangement and applicable consumer rights. Any outstanding fees remain payable.

9. EXAMS, COMPETITIONS & PERFORMANCE OPPORTUNITIES

KSDA provides students with opportunities which may include examinations, shows, competitions, festivals, performance teams and other events. These opportunities may involve additional costs and commitments.

Exams

Exam entry is at the teacher's discretion and will depend on factors including technical readiness, attendance and preparation.

Students preparing for examinations may be required to attend additional classes or rehearsals. Where these are specified as compulsory, attendance and the associated fees form part of the student's exam preparation.

Once an examination entry has been submitted and paid to an examining body, the fee may be non-refundable unless a refund is available from that organisation.

Competition & Performance Teams

Accepting a place on a competition or performance team represents a commitment to the team and its training requirements.

Students may be required to attend specified technique classes, team sessions and rehearsals. Poor attendance, insufficient preparation, inappropriate behaviour or failure to meet team requirements may result in withdrawal from a competition, performance or team.

Shows, Competitions & Events

Additional costs may include entries, costumes, tickets, rehearsals, coaching, travel or event fees.

Once KSDA has booked, ordered or paid a third party on a student's behalf, these costs may be non-refundable to the extent that they cannot reasonably be recovered by KSDA.

Separate conditions may apply to particular trips, camps, shows, competitions or events and will be communicated when booking.

10. UNIFORM, HEALTH & SAFETY

Students should attend class in the correct KSDA uniform and appropriate footwear once required.

Hair must be secure and away from the face. Specific hairstyles, including a ballet bun, may be required for particular classes, examinations or performances.

Jewellery, long nails, unsuitable footwear or clothing may prevent participation where a teacher considers them a safety risk.

Parents/guardians must tell KSDA about injuries, illnesses, medical conditions or additional needs that may affect participation and keep this information up to date.

Students should also tell their teacher if they feel unwell, experience pain or have an injury during class.

Dance and Acro are physical activities. Students must follow teacher instructions and participate appropriately for their level.

Physical Contact

Appropriate physical contact is sometimes necessary in dance teaching to correct alignment or posture, demonstrate positioning, support skills and help students perform movements safely.

Any physical contact will be relevant to the activity and carried out professionally. Parents/guardians should contact KSDA if their child requires adaptations or if they have any concerns.

11. STUDENT & PARENT CODE OF CONDUCT

We want KSDA to be a positive, supportive and safe environment.

Students are expected to treat teachers and fellow students respectfully, follow instructions, participate positively, behave safely and respect our venues and equipment.

Bullying, discrimination, intimidation, abusive behaviour or persistent disruption will not be tolerated.

Parents/guardians are also expected to communicate respectfully with KSDA staff, students and other families.

Concerns or complaints should be raised directly and privately with KSDA so that we have an opportunity to investigate and respond.

Aggressive, abusive, threatening, intimidating or seriously inappropriate behaviour towards staff, students or other families will not be accepted.

Serious or repeated breaches of these expectations may result in a student's enrolment being reviewed or terminated. Any decision will be handled reasonably and in accordance with applicable contractual and consumer rights.

12. DROP-OFF, COLLECTION & SUPERVISION

Parents/guardians remain responsible for children before their scheduled class begins and after it finishes unless specific supervision has been arranged by KSDA.

Children should not be dropped off significantly before their class and left unattended.

Please collect children promptly and ensure KSDA has any relevant information regarding collection arrangements.

Students should not leave the studio during a class without permission.

Where a student has a gap between classes, KSDA does not automatically provide childcare or supervision during that time unless a specific arrangement has been made.

13. PHOTOGRAPHY, VIDEO, PRIVACY & SAFEGUARDING

The safety and welfare of our students is a priority.

KSDA may photograph or film classes, rehearsals, performances and events for appropriate school purposes, including celebrating achievements, our website, social media and promotional material.

Photography and video consent preferences will be recorded through student registration and should be kept up to date.

Parents/guardians should respect the privacy of other students and should not publicly share identifiable images or videos of other children without appropriate permission.

Teaching or rehearsal material supplied by KSDA should not be redistributed without permission.

Personal information is collected and processed where necessary to administer enrolment, communicate with families, manage payments and support student welfare. Information will be handled in accordance with applicable UK data protection requirements and KSDA's Privacy Policy.

Any safeguarding concern should be raised directly with the Principal. Where necessary, safeguarding information may be shared with appropriate organisations or authorities in accordance with safeguarding responsibilities and applicable law.

14. VENUES & PERSONAL BELONGINGS

Students and families are expected to respect KSDA facilities and any third-party venues we use.

Students are responsible for their personal belongings and should avoid bringing unnecessary valuables to class.

KSDA cannot accept responsibility for loss, theft or damage to personal property except where liability cannot legally be excluded.

15. CHANGES TO FEES, TIMETABLES & SERVICES

From time to time, KSDA may need to make reasonable changes to its operation. This may include changes to teachers, class times, venues, class groupings or other teaching arrangements.

We will give as much notice as reasonably possible where changes affect enrolled students.

Fees and discount structures may be reviewed to reflect changes in the cost of operating the school.

Fee increases will not be applied retrospectively. Parents/guardians will be informed of new rates before they take effect.

Where a change materially alters the service a family has agreed to receive, KSDA will communicate directly with those affected and applicable consumer rights will continue to apply.

16. ENDING A STUDENT'S ENROLMENT

KSDA may suspend or terminate enrolment where there is a serious or repeated issue involving:

·  Non-payment of fees

·  Unsafe behaviour

·  Bullying or abusive behaviour

·  Serious or repeated breaches of these Terms & Conditions

·  Inappropriate conduct by a student or parent/guardian

·  Behaviour which significantly affects the safety, welfare or reasonable operation of KSDA

Where appropriate, we will try to resolve concerns before ending enrolment.

In serious circumstances, including situations involving safety, safeguarding, threatening behaviour or serious misconduct, immediate action may be necessary.

Any outstanding fees, credits or refunds will be dealt with fairly according to the circumstances, services already provided, costs already committed and applicable consumer rights.

17. LIABILITY & STATUTORY RIGHTS

KSDA will take reasonable care in providing its classes, activities and services and in maintaining an appropriate teaching environment.

Parents/guardians are responsible for providing relevant information that may affect a student's safe participation, and students are expected to follow reasonable instructions from teachers.

Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded or restricted, including liability for death or personal injury caused by negligence.

Nothing in these Terms & Conditions affects your statutory rights.

18. TERM DATES & SCHOOL HOLIDAYS

KS Dance Academy operates a 40-week teaching year.

Term dates and scheduled school holidays are published separately.

KSDA does not automatically close for UK or Scottish bank holidays.

Unless a date is specifically included within the published KSDA holiday dates, scheduled classes will run as normal.
