Terms & Conditions

for Students and Parents/Carers


About these Terms

These Terms & Conditions set out the basis on which children and young people attend classes, workshops and activities provided by LMPA Academy ("the Academy", "we", "us" or "our"). By enrolling a child or young person with LMPA Academy, the parent/carer confirms that they have read, understood and agree to these Terms & Conditions.

Our priority is to provide a safe, positive, inclusive and nurturing environment in which children and young people can develop their skills, confidence and enjoyment of the performing arts.

1. ENROLMENT

1.1 A student's place at LMPA Academy is subject to availability and completion of the required enrolment/application process.

1.2 The person completing the enrolment must be a parent, legal guardian or other person with appropriate authority to enroll the child.

1.3 Parents/carers are responsible for ensuring that all information supplied to LMPA Academy is accurate and complete and is kept up to date on the classmanger portal. If you are changing anything that will affect them immediately, please contact us by [email protected] or speak to a member of staff to make them aware before class.

1.4 Parents/carers must inform LMPA Academy promptly of changes to information supplied during enrolment, including contact details, emergency contacts, medical conditions, allergies, medication, injuries, additional support needs, collection arrangements and any other information relevant to the student's safety or participation.

1.5 LMPA Academy reserves the right to determine the most appropriate class for a student, taking account of factors including age, experience, ability, class capacity and the student's individual needs etc. 

2. FEES, MONTHLY PAYMENTS AND FAMILY DISCOUNTS

2.1 LMPA Academy operates a 39 class teaching year for its regular classes.  For the academic year 2026/2027 monthly payments will be calculated over an 11 month period with 1 class added for August

2.2 Tuition fees for Academic year 2027/2028 will be 40 classes, calculated as an annual amount and divided into 12 equal monthly payments starting on 1st August 2027

2.3 Monthly payments are instalments towards the overall annual tuition fee and do not represent payment for the exact number of classes taking place within an individual calendar month.

2.4 The monthly payment therefore remains the same during months including school holidays, LMPA Academy closures are included within the published calendar.

2.5 Monthly fees are payable on the agreed payment date and using the payment method specified by LMPA Academy. Parents/carers are responsible for ensuring payments are made when due.

 

2.6 Where payment is missed or unsuccessful, LMPA Academy may contact the parent/carer to request payment.  A late payment of £12 may be issued.

2.7 Persistent non-payment may result in a student's place being suspended or withdrawn. LMPA Academy will normally attempt to contact the parent/carer and provide a reasonable opportunity to resolve the outstanding payment before taking this action.

2.8 Fees may be reviewed periodically. Parents/carers will be given reasonable notice of changes to regular class fees.

2.9 Family discount of 10% will be applied for each sibling. 

 

3. CANCELLING A STUDENT'S PLACE

3.1 Cancellation of a student's regular class must be made in writing by email to LMPA Academy.

3.2 Verbal notification to a teacher or member of staff, non-attendance at classes, or messages passed through another person will not constitute formal cancellation.

3.3 A notice period of one full payment month applies.

3.4 Fees remain payable throughout the notice period, regardless of whether the student attends classes during that period.

3.5 Where notice is given part-way through a payment period, the notice period will run for the following full payment month.

3.6 Parents/carers should therefore consider the notice period when deciding when to submit cancellation.

4. STUDENT ABSENCE AND MISSED CLASSES

4.1 No refund or account credit will normally be provided where a student misses a scheduled class for personal reasons, including illness, holidays, family commitments, school activities, transport difficulties, appointments or choosing not to attend.

4.2 Where possible, parents/carers should notify LMPA Academy if a student will be absent.

4.3 LMPA Academy is not normally required to provide an alternative class or private tuition to replace a class missed by the student.

4.4 Exceptional circumstances may be considered at LMPA Academy's discretion. Nothing in these Terms affects a parent's statutory consumer rights.

5. CLASSES CANCELLED BY LMPA ACADEMY

5.1 Occasionally LMPA Academy may need to cancel a class because of circumstances such as staff illness, venue problems, severe weather or other operational circumstances.

5.2 Where LMPA Academy cancels a scheduled teaching class, we will normally arrange a replacement class.

5.3 Replacement classes may take place on a different day, at a different time or, where reasonable, at an alternative venue. Parents/carers will be given appropriate notice wherever practicable.

5.4 Where circumstances make it genuinely impossible or unreasonable to provide a replacement class, LMPA Academy will consider an appropriate alternative in accordance with applicable consumer law.

6. TIMETABLES, TEACHERS AND VENUES

6.1 LMPA Academy reserves the right to make reasonable changes to class times, class groupings, teaching staff, studios or venues, class content and timetables.

6.2 Where reasonably possible, parents/carers will be notified in advance of significant changes.

6.3 LMPA Academy cannot guarantee that a particular teacher will teach a class throughout the entire year.

7. ATTENDANCE AND PUNCTUALITY

7.1 Regular attendance is encouraged to enable students to progress and to support the effective running of group classes.

7.2 Students should arrive in sufficient time to be ready for the scheduled start of their class.

7.3 Persistent lateness or absence may affect a student's ability to participate safely or effectively in class, rehearsals or performances.

7.4 Parents/carers should inform LMPA Academy of significant or prolonged absence.

8. DROP-OFF, COLLECTION AND SUPERVISION

8.1 LMPA Academy's responsibility for supervising a student applies during the student's scheduled class or activity and any specifically communicated supervised arrival/collection arrangements.

8.2 Parents/carers remain responsible for their child before the child has been accepted into the care of LMPA Academy staff and following the end of the child's scheduled session.

8.3 Children who require collection must be collected by their parent/carer or an adult authorised by the parent/carer.

8.4 Parents/carers must inform LMPA Academy of relevant changes to collection arrangements.

8.5 LMPA Academy may seek confirmation of identity or contact a parent/carer if staff are unsure whether a person is authorised to collect a child.

8.6 LMPA Academy reserves the right not to release a child to an individual where staff have reasonable safeguarding concerns.

9. OLDER STUDENTS LEAVING INDEPENDENTLY

9.1 Older students may be permitted to leave LMPA Academy classes or activities independently where the parent/carer has provided prior permission.

9.2 Permission should be provided in the form requested by LMPA Academy and may be recorded against the student's account.

9.3 Once an authorised student has left the premises at the end of their scheduled session, LMPA Academy is no longer responsible for supervising their journey home.

10. LATE COLLECTION

10.1 Parents/carers are expected to collect students promptly at the stated finish time.

10.2 If a parent/carer is unexpectedly delayed, they should contact LMPA Academy as soon as reasonably possible.

10.3 LMPA Academy will ensure that a child who has not been collected is supervised appropriately while reasonable attempts are made to contact the parent/carer or emergency contact.

10.4 Repeated or excessive late collection may result in LMPA Academy discussing alternative arrangements with the parent/carer.

10.5 Persistent late collection that cannot be satisfactorily resolved may ultimately affect the student's continued place at LMPA Academy.

11. STUDENT BEHAVIOUR

11.1 LMPA Academy aims to provide an environment where students feel safe, respected, supported and able to participate.

11.2 Students are expected to treat others respectfully, follow reasonable instructions, behave safely, respect premises and property, allow others to learn and participate, and refrain from bullying, harassment, intimidation, discrimination or deliberately harmful behaviour.

11.3 LMPA Academy will normally use a graduated behaviour approach.

Stage 1 – Reminder and Redirection — The student will be reminded of expectations and supported to modify their behaviour.

Stage 2 – Warning — Where behaviour continues, a clearer warning may be given and consequences explained.

Stage 3 – Parent/Carer Contact — If concerns continue or are more significant, LMPA Academy may contact the student's parent/carer.

Stage 4 – Meeting and Support Plan — For persistent concerns, LMPA Academy may arrange a discussion with the parent/carer and, where appropriate, the student to agree steps to improve the situation.

Stage 5 – Suspension or Withdrawal of Place — Where behaviour remains persistently unsafe, seriously disruptive or harmful despite appropriate intervention, LMPA Academy may temporarily suspend or ultimately withdraw the student's place.

11.4 LMPA Academy is not required to follow every stage where an incident is sufficiently serious to justify immediate action.

11.5 Any behaviour giving rise to a child protection or safeguarding concern will be managed under LMPA Academy's safeguarding procedures rather than solely as a disciplinary matter.

12. BULLYING, HARASSMENT AND DISCRIMINATION

12.1 Bullying, harassment, intimidation and discriminatory behaviour are not acceptable within LMPA Academy.

12.2 Concerns should be reported to a member of LMPA Academy staff as soon as possible.

12.3 LMPA Academy will consider concerns sensitively and proportionately and may involve parents/carers where appropriate.

13. SAFEGUARDING AND CHILD PROTECTION

13.1 LMPA Academy is committed to safeguarding and promoting the safety and wellbeing of children and young people participating in its activities.

13.2 LMPA Academy will maintain appropriate safeguarding and child protection procedures informed by applicable Scottish legislation and national child protection guidance.

13.3 Where a member of staff has a concern about the safety or wellbeing of a child, LMPA Academy may record, discuss and share relevant information with appropriate safeguarding agencies where necessary or legally permitted.

13.4 In circumstances involving a child protection concern, the safety and welfare of the child will be a primary consideration.

13.5 LMPA Academy may contact Police Scotland, the relevant local authority/social work service or another appropriate agency where it is necessary to protect a child.

13.6 Detailed procedures for responding to safeguarding concerns will be contained within LMPA Academy's separate Child Protection & Safeguarding Policy.

14. STAFF, VOLUNTEERS AND PVG REQUIREMENTS

14.1 LMPA Academy will take reasonable steps to ensure that people appointed to roles involving children are suitable for those roles.

14.2 Individuals undertaking a regulated role with children must have the appropriate Protecting Vulnerable Groups (PVG) Scheme membership where required by Scottish law.

14.3 LMPA Academy will comply with its legal responsibilities in relation to regulated roles, PVG Scheme membership and Disclosure Scotland.  All staff are vetted and part of the PVG Scheme.

14.4 Appropriate safeguarding expectations and professional boundaries apply to staff and volunteers working with students.

15. MEDICAL INFORMATION, ALLERGIES AND ADDITIONAL SUPPORT NEEDS

15.1 Parents/carers must provide LMPA Academy with all information reasonably necessary to support their child's safe participation, including relevant medical conditions, medication, allergies, injuries, disabilities, additional support needs and other relevant health or wellbeing information.

15.2 Parents/carers must inform LMPA Academy promptly if this information changes.

15.3 Information regarding disability or additional support needs will be treated respectfully and used to help LMPA Academy understand how best to support the student.

15.4 LMPA Academy will seek to make reasonable adjustments where required and reasonably practicable.

15.5 Parents/carers are encouraged to discuss individual needs with LMPA Academy so that appropriate support can be considered collaboratively.

16. FIRST AID, ACCIDENTS AND EMERGENCIES

16.1 Appropriate first aid may be provided where a student becomes ill or injured while participating in an LMPA Academy activity.

16.2 Parents/carers will be contacted where appropriate following illness, injury or an accident.

16.3 In a medical emergency, LMPA Academy may contact the emergency services and take reasonable action considered necessary to protect the student's health and safety.

16.4 LMPA Academy will make reasonable attempts to contact the parent/carer or emergency contact as soon as practicable.

16.5 Parents/carers remain responsible for ensuring that emergency contact information is current.

17. MEDICATION

17.1 Parents/carers must inform LMPA Academy of medication that may be relevant during the student's attendance.

17.2 Medication should not be left with a child or member of staff without appropriate arrangements having been agreed where staff involvement is required.

17.3 Where medication may need to be administered during an LMPA Academy activity, the parent/carer should discuss this with LMPA Academy in advance so appropriate arrangements can be considered.

18. PHYSICAL CONTACT IN PERFORMING ARTS TEACHING

18.1 Performing arts training can involve appropriate physical contact, for example to correct posture or alignment, safely position a student's body, support dance or acrobatic movement, demonstrate partner work, assist with costumes or equipment where appropriate, or prevent injury.

18.2 Any physical contact by LMPA Academy staff should be appropriate to the activity, proportionate, professional and carried out with regard to the student's dignity and wellbeing.

18.3 Students should be encouraged to communicate if they are uncomfortable with physical contact.

18.4 Parents/carers should inform LMPA Academy of any relevant needs or circumstances that staff should be aware of.

19. CLOTHING, FOOTWEAR AND SAFETY

19.1 Students should attend classes wearing clothing and footwear appropriate to the activity and in accordance with any class-specific uniform requirements communicated by LMPA Academy.  LMPA Academy uniform must be worn to all classes.

19.2 Hair, jewellery and personal items may need to be secured or removed where necessary for safe participation.

19.3 LMPA Academy may prevent a student from participating in a particular activity where staff reasonably consider their clothing, footwear, jewellery, injury or equipment presents a safety risk.

20. PERFORMANCES

Musical Fees will be invoiced on 1st September 2026 (Applies to all Musical Theatre Students)

LMPA Academy Student showcase fees will be Invoiced on 1st February 2027

20.1 Participation in LMPA Academy performances is optional unless expressly stated otherwise for a particular programme or project. 

20.2 Parents/carers will be given information about a production before deciding whether their child will participate. 

20.3 Requirements may vary between productions and may include additional rehearsals, performance dates, participation or production fees, costumes, footwear, make-up or hair requirements, travel, tickets and other production-related costs.

20.4 Relevant costs and significant commitments will be communicated separately for each production wherever reasonably practicable.

20.5 Once a student has committed to a production, regular attendance at required rehearsals and performances may be important because absence can affect other performers, choreography, scenes and the production as a whole.

20.6 LMPA Academy may make reasonable changes to staging, choreography, roles, routines or performance arrangements where necessary.

 

21. CASTING AND PERFORMANCE ROLES

21.1 Casting and allocation of roles, solos, routines, groups, positions and other performance opportunities are artistic and educational decisions made by LMPA Academy.

21.2 Decisions may take account of suitability for the role, age, ability, experience, attendance, reliability, confidence, group balance, production requirements and the developmental needs of students.

21.3 Participation in a production does not guarantee a particular role, solo, position or amount of stage time.

21.4 LMPA Academy may change casting or performance arrangements where reasonably necessary.

22. PHOTOGRAPHY, VIDEO AND PROMOTIONAL MATERIAL

22.1 Photographs and video may be taken during LMPA Academy classes, workshops, rehearsals, performances and events for legitimate Academy purposes, which may include promotion and documenting LMPA Academy activities.

22.2 Promotional material may be used on LMPA Academy's website, social media channels, printed promotional materials and other LMPA Academy publicity.

22.3 Images or information may also be provided to local press where appropriate.

22.4 Where LMPA Academy intends to use or share material for a materially different purpose beyond the uses communicated to families, additional permission will be sought where appropriate.

22.5 Parents/carers who do not wish their child to participate in promotional photography or filming must notify LMPA Academy in writing during the application/enrolment process.

22.6 Parents/carers may subsequently contact LMPA Academy to update their preference regarding future photography or filming.

22.7 LMPA Academy will also take appropriate account of the views and wishes of the child or young person.

22.8 Choosing not to participate in promotional photography will not affect a student's entitlement to participate in regular LMPA Academy classes.

23. PERFORMANCE RECORDINGS AND ARCHIVE MATERIAL

23.1 Some LMPA Academy performances, workshops or projects may be photographed or recorded for archival, educational or commemorative purposes.

23.2 Where appropriate, recordings may be made available privately to participating LMPA Academy families.

23.3 Parents/carers must not copy, publish, upload, distribute or commercially exploit LMPA Academy performance recordings except where LMPA Academy has expressly permitted this and doing so does not infringe the rights or privacy of others.

23.4 Separate restrictions may apply because of music, script, choreography, licensing, copyright, safeguarding or performance rights.

23.5 LMPA Academy may issue specific recording and sharing rules for individual performances or productions, which participants and families will be expected to follow.

24. PARENT/CARER PHOTOGRAPHY AND SOCIAL MEDIA

24.1 LMPA Academy may restrict or prohibit photography and filming by audience members, parents or carers at particular performances, classes, rehearsals or events.

24.2 Any restrictions communicated by LMPA Academy must be respected.

24.3 Parents/carers should consider the privacy and safeguarding of other children before posting photographs or recordings containing other students online.

24.4 Where LMPA Academy provides recordings privately to families, those recordings must not automatically be treated as authorised for public posting or social media sharing.

25. PERSONAL PROPERTY

25.1 Students are responsible for their personal belongings.

25.2 LMPA Academy recommends that valuable items are not brought to classes or events unless necessary.

25.3 LMPA Academy will take reasonable care but cannot accept responsibility for loss or damage to personal property unless caused by LMPA Academy's failure to exercise reasonable care or where liability cannot lawfully be excluded.

26. DATA PROTECTION AND PRIVACY

26.1 LMPA Academy processes personal information about students and their parents/carers for purposes connected with providing and administering its services.

26.2 Information may include student and parent/carer contact details, emergency contact information, attendance records, payment information, medical and additional support information, safeguarding information where necessary, photographs and recordings, and communications relating to the student's participation.

26.3 Personal information will be handled in accordance with applicable UK data protection legislation.

26.4 Children's personal information will be treated with particular care.

26.5 Further information about how LMPA Academy collects, uses, stores and shares personal information should be set out in LMPA Academy's Privacy Notice.

27. COMMUNICATION WITH PARENTS/CARERS

27.1 Parents/carers are responsible for ensuring LMPA Academy has current contact information.

27.2 LMPA Academy may communicate important information by email, electronic messaging, an online parent system or other reasonable communication method.

27.3 Parents/carers are responsible for checking communications relating to their child's classes, rehearsals, performances and LMPA Academy arrangements.

27.4 Important changes affecting a student's safety, health, collection arrangements or participation should be communicated directly to LMPA Academy rather than relying on another parent or student to pass on information.

28. PARENT/CARER CONDUCT

28.1 LMPA Academy expects communication between staff, students and parents/carers to remain respectful.

28.2 Abusive, threatening, discriminatory, intimidating or seriously inappropriate behaviour towards LMPA Academy staff, students, other families or volunteers will not be accepted.

28.3 Serious or persistent inappropriate conduct by a parent/carer may result in restrictions being placed on communication or attendance at LMPA Academy premises/events and, in exceptional circumstances, may result in the student's place being reviewed.

28.4 Wherever reasonably possible, LMPA Academy will seek to resolve concerns before ending a student's place because of a parent/carer's conduct.

29. COMPLAINTS AND CONCERNS

29.1 LMPA Academy welcomes constructive feedback and encourages parents/carers to raise concerns promptly.

29.2 In the first instance, concerns should normally be raised with an appropriate member of LMPA Academy staff.

29.3 Formal complaints should be made in writing in accordance with LMPA Academy's complaints procedure.

29.4 Safeguarding concerns will be dealt with under LMPA Academy's Child Protection & Safeguarding Policy and should not be delayed because of the normal complaints process.

30. SUSPENSION OR WITHDRAWAL OF A PLACE

30.1 LMPA Academy may suspend or withdraw a student's place where there is a reasonable and proportionate reason to do so. This may include serious or persistent unsafe behaviour, serious bullying or harassment, circumstances presenting a safeguarding risk, persistent non-payment of fees, serious or persistent breaches of these Terms & Conditions, or serious inappropriate conduct by a parent/carer.

30.2 Wherever appropriate, LMPA Academy will attempt to resolve concerns with the student and/or parent/carer before permanently withdrawing a place.

30.3 Immediate suspension may be used where LMPA Academy reasonably considers this necessary to protect the safety or wellbeing of students, staff or others while a matter is considered.

31. HEALTH AND SAFETY

31.1 LMPA Academy will take reasonable steps to provide a safe environment for its activities.

31.2 Students must follow reasonable safety instructions given by LMPA Academy staff.

31.3 Parents/carers must not knowingly send a child to participate where their health, injury or condition makes participation unsafe.

31.4 LMPA Academy may modify or restrict a student's participation where reasonably necessary for health or safety reasons.

32. EVENTS BEYOND LMPA ACADEMY'S REASONABLE CONTROL

32.1 Occasionally classes, performances or activities may be disrupted by circumstances beyond LMPA Academy's reasonable control, such as severe weather, unsafe travel conditions, venue closure, power or utility failure, public health restrictions, emergency situations or other exceptional events.

32.2 LMPA Academy will communicate with families as soon as reasonably practicable and will take reasonable steps to minimise disruption.

32.3 Any entitlement to replacement provision, credit or refund will depend on the circumstances and applicable consumer law.

33. LIABILITY

33.1 Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.

33.2 LMPA Academy will take reasonable care in providing its services and supervising students while they are participating in LMPA Academy activities.

33.3 Performing arts activities may involve normal physical risks associated with dance, drama, singing, movement, rehearsal and performance.

33.4 Parents/carers are responsible for providing relevant information that may affect their child's ability to participate safely.

33.5 LMPA Academy will not be responsible for losses that were not reasonably foreseeable or were not caused by a breach of LMPA Academy's legal obligations.

34. CHANGES TO THESE TERMS & CONDITIONS

34.1 LMPA Academy may update these Terms & Conditions from time to time, for example because of changes to legislation, safeguarding guidance, LMPA Academy procedures, payment arrangements or operational requirements.

34.2 Parents/carers will be given reasonable notice of significant changes.

34.3 Changes will not remove statutory rights available to parents/carers.

35. OTHER LMPA ACADEMY POLICIES

35.1 These Terms & Conditions should be read alongside other relevant LMPA Academy policies,

35.2 Where a safeguarding issue arises, LMPA Academy's safeguarding procedures will take priority over ordinary administrative or complaints procedures where necessary to protect a child.

36. GOVERNING LAW

36.1 These Terms & Conditions are governed by the law of Scotland.

36.2 Nothing in these Terms affects any statutory rights available to parents/carers as consumers.

37. ACCEPTANCE OF TERMS

By enrolling a child or young person with LMPA Academy, the parent/carer confirms that they have read and understood these Terms & Conditions; that the information provided to LMPA Academy is accurate to the best of their knowledge; that they agree to inform LMPA Academy of relevant changes; that they understand the annual tuition structure and monthly payment arrangement; that they understand the cancellation and notice requirements; and that they agree to comply with LMPA Academy's reasonable policies and procedures relating to the safety and wellbeing of students.
