LIABILITY WAIVER

In checking the box below, I understand the nature of this activity in which I and/or my child shall participate. Therefore, I confirm and warrant that I and /or my child are in good health. However, if I have any doubts, I acknowledge that I was advised consult with a physician. I will in no way hold Momentum’s owners, employees, instructors, contractors, designees, or volunteers responsible for any accidents, personal injuries, illness, loss of or damage to personal property, which may occur at the studio or any other designated venue where Momentum students may perform. I on behalf of myself and my child, do hereby Release, Waive, Discharge and Covenant not to Sue Momentum’s owners, employees, instructors, contractors, designees, or volunteers from all liability for any loss or damage, and any claim or demands therefore on account of injury to the person or property or resulting in death, whether caused by the negligence or otherwise, while in, upon, or about the premises or any facilities or any other designated venue where Momentum students may perform or equipment, therein. Each student may decline to participate in any activity. It is incumbent on the Parent to inform the instructor of any physical limitations the student might have. I expressly agree on behalf of myself and my child that the foregoing Release, Waiver and Indemnity Agreement is intended to be as broad and inclusive as is permitted by the law of the North Carolina and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. Rental Agreement: Renter assumes liability for injury of any persons they invite to the space, including but not limited to: injury to students in the renter’s class, injury to performers or collaborators in the rehearsal. Momentum Dance & Events is not responsible for any loss, broken or stolen personal items.

HEALTH & SAFETY GUIDELINES *COVID-19 WAIVER, RELEASE, HOLD HARMLESS, AND AGREEMENT TO NOT SUE MOMENTUM DANCE & EVENTS will follow state and local guidelines on sanitizing procedures, face coverings, and all other mandates. CLEANING & SANITIZING: We will be cleaning and thoroughly sanitizing often. MOMENTUM DANCE & EVENTS will use the most efficient products available for cleaning and sanitizing our studio space, utilizing effective products for combatting COVID- 19. These include disinfectants for floors and high touch surfaces etc.

PREVENTATIVE MEASURES: Children who are not feeling well should STAY home. If a child has a cough, runny nose, or feels ill in any way, please keep them home and notify us of your absence.

STUDENT, PARENT OR STAFF POSITIVE: If you or your dancer test positive or are exposed to a positive person with COVID-19 and you have been to the studio 5 days or less, please email us immediately. We will then email the entire studio and clarify what classes, days, and times you were at MOMENTUM DANCE & EVENTS. If you have come in contact with someone who tested positive and entered the studio 5 days or less, please contact us immediately. We are requiring everyone who tests positive or has someone in their home who is positive to refrain from entering the studio until the ENTIRE household is negative; OR the last person positive in the home has quarantined 5 days.

ÅCLASSES: If you must quarantine due to COVID-19 we will extend your class make ups for 2 consecutive months. No refunds or credits will be given. I, the undersigned, on my behalf and on behalf of my child named below, hereby acknowledge that my child and I desire to voluntarily participate in dance class held at the Momentum Dance & Events LLC: (hereinafter “MOMENTUM DANCE & EVENTS"). I fully understand and acknowledge that participation in the MOMENTUM DANCE & EVENTS exposes me and/or my child to the risk of personal injury, death, communicable diseases, illnesses, viruses, or property damage.

I FURTHER UNDERSTAND AND ACKNOWLEDGE THAT AN INHERENT RISK OF EXPOSURE TO COVID-19 EXISTS IN ANY PUBLIC PLACE WHERE PEOPLE ARE PRESENT. I EXPRESSLY AGREE TO ACCEPT AND ASSUME ANY SUCH RISKS ON BEHALF OF MYSELF AND MY CHILD. I hereby release, discharge, and agree not to sue the Momentum Dance & Events LLC: (hereinafter “MOMENTUM DANCE & EVENTS") or any of its officers, employees, agents and volunteers for any injury, death or damage to person or property, financial duress, arising out of, or in connection with, my and/or my child’s participation in the MOMENTUM DANCE & EVENTS from whatever cause, including the active or passive negligence of the MOMENTUM DANCE & EVENTS, its officers, employees, agents and/or volunteers or any other participants in the MOMENTUM DANCE & EVENTS. In consideration for me and my child being permitted to participate in the MOMENTUM DANCE & EVENTS, I hereby agree, for myself, my heirs, administrators, executors, and assigns, that I shall indemnify and hold harmless the MOMENTUM DANCE & EVENTS and its officers, employees, agents, and volunteers from any and all claims, demands actions or suits arising out of or in connection with my and/or my child’s participation in the MOMENTUM DANCE & EVENTS. My child is physically able to participate in MOMENTUM DANCE & EVENTS classes, events, etc. I acknowledge that NO MEDICAL INSURANCE IS PROVIDED by the MOMENTUM DANCE & EVENTS for MOMENTUM DANCE & EVENTS classes. I authorize the MOMENTUM DANCE & EVENTS to provide or cause to be provided such medical treatment as may be necessary or appropriate if any injury occurs to me and/or my child while participating in the MOMENTUM DANCE & EVENTS classes. I agree to pay for any medical treatment that I and/or my child may require while involved in the MOMENTUM DANCE & EVENTS and not hold MOMENTUM DANCE & EVENTS liable.

I hereby consent to the use of photographs depicting me and/or my child in MOMENTUM DANCE & EVENTS printed materials and/or website. I HAVE CAREFULLY READ THIS WAIVER, RELEASE, HOLD HARMLESS AND AGREEMENT NOT TO SUE AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT IT IS A FULL RELEASE OF ALL LIABILITY AND SIGN IT OF MY OWN FREE WILL. BY CHECKING THE BOX BELOW, I HAVE READ, UNDERSTAND, AND AGREE TO ABIDE BY ALL OF THE RULES, POLICIES, LIABILITY WAIVER AND PAYMENTS SET FORTH IN THIS CONTRACT. I UNDERSTAND I HAVE TO BE 18 YEARS OF AGE OR OLDER TO CHECK THE BOX BELOW WHICH IS SIGNIFYING MY SIGNATURE OF THIS REGISTRATION/LIABILITY/POLICY CONTRACT. 

Photo Release

By summiting this form I agree to the following: I, the parent or legal guardian of the registered child(ren) grant Momentum Dance & Event Center my permission to use the photographs and videos described as marketing and/or website content for any legal use, including but not limited to: publicity, copyright purposes, illustration, advertising, and web content. Furthermore, I understand that no royalty, fee or other compensation shall become payable to me by reason of such use. Parental Acknowledgements • My child will not be allowed to enter or leave the facility without being escorted by the parent or person authorized by the parent or facility personnel. • I acknowledge that it is my responsibility to keep my child’s records current to reflect any significant changes as they occur, i.e. telephone numbers, work location, emergency contacts, child’s physician, child’s health status, infant feeding plans and immunization records, etc.

Payment Policy Tuition and Expense Policy:

Full monthly tuition is due on the first of each month. Tuition is paid through automatic withdrawal from your credit or debit card account. We ask that you opt in to save your payment information on file when you receive your invoice. If you are adding or removing classes for your next month's billing, please contact us no later than 5 days before the first of the month. Missed classes: When a student misses a class, they will not be refunded that part of tuition or prorated on the next month. Instead that student receives a class credit that can be redeemed to take any class regardless of length within the month. There will be a $30.00 fee for returned checks. Please note: tuition is based on the season regardless of how many weeks are in a given month. Tuition payments average out to four classes each month. August is a half-month, with full months September through May.
