Terms and conditions.
These terms and conditions apply to all
services supplied by Next Steps Movement Studio.
By completing the registration form and
enrolling in a Next Steps Movement Studio class you agree as per the following:
1.
Fees (unless fully paid) are
subject to change without notice.
2.
All payments are via a weekly
direct debit payment or a one off term payment. All payments are to be made in
advance before attending a class to ensure placement in your chosen class. If a
client joins during a term, payment is calculated based on the remaining weeks
of that term. Refunds will only be considered due to extraordinary
circumstances and on a case by case basis. Where a Next Steps Movement Studio
class is cancelled, you will not be charged for that class.
3.
Next Steps Movement Studio has
the right to refuse participation based on poor, abusive, unacceptable, unsafe
or inappropriate behaviour.
4.
All participants of the Next
Steps programs agree that accidents may happen as a result of offering this
service and will release indemnify and hold harmless Next Steps Movement Studio
and Next Steps Movement Studio Coaches from any liability, demands, proceedings
or other claims for injuries (including death) or any health problem suffered
by your child or yourself sustained directly or indirectly by participating in
this program. I have read and understood this warning and voluntarily accept
and assume the inherent risks in participating in each Next Steps class.

In agreeing to these terms you
are providing consent to Next Steps Movement Studio and its coaches to
administer or obtain medical assistance in the event of an accident or medical
condition you may suffer whilst participating in a Next Steps class and agree
to pay for any costs or expenses incurred by Next Steps Movement Studio in
administering or obtaining such medical assistance.
6.
To the extent permitted by law
and while all reasonable care is taken, Next Steps Movement Studio and its
coaches cannot be held responsible and exclude all liability however arising
(including liability for negligence) for direct, indirect or consequential
loss, damage, injury, cost and expenses (including without limitation loss of
revenue or profits, loss of business opportunity, goodwill and/or data, and
failure to realise anticipated savings or benefits). To the extent permitted by
law, you release and indemnify, and will keep indemnified, Next Steps Movement
Studio and all of their coaches in relation to all claims which you now, or at
any time in the future may have against Next Steps Movement Studio or their
coaches, arising from or related in any way to the supply and my participation
in a Next Steps Movement Studio class.
I, the Next Steps Movement Studio
participant, warrant that all information provided is true and correct. I have
read, understood, acknowledge and agree to the above declaration including the
warning, exclusion of liability, release and indemnity.
Refund policy
Please note, we are unable to give refunds
for missed lessons, unless a class is cancelled by Next Steps Movement Studio,
in which case you will receive a refund for classes missed due to this
cancellation.
Classes can be started mid-term depending on availability. If you
decide to sign up, you will only be charged for the remainder of the term.
If a
class is missed, credit cannot be transferred to the next term however, you are
welcome to do a make-up class , in the same or similar class, during the current term, to
replace the missed lesson. This makeup class may be taken at any point during
the term. The parent/carer is required to book make-up classes with Next Steps
Movement Studio, via phone or email.
Members who are unable to attend a class due to extenuating circumstances (i.e. family death, injury, major illness, etc.) may write to Next Steps Movement Studio and with satisfactory written evidence may be eligible for a full refund.
Cancellation policy
Parents must notify the club to remove an athlete from their term class by written notice via email, regular post or hand delivered to the front desk, 30 days prior to the termination of billing. The parent retains responsibility to pay fees until 30 days after the written notice has been received, regardless of whether the athlete attends any classes. Please do not rely on your child to verbally communicate your cancellation. If an athlete ceases attendance without notification, the athlete will still be charged for the entire term fees owed. This charge is for holding the student's place in the class and restricting Next Steps Movement Studio from offering the class to an alternative individual.
Photo and video waiver
If you do not wish to be photographed please ensure the photo consent button has been clicked on your parent portal or alternatively inform
us in writing (where possible) or verbally, followed up in writing. Given the
nature of our work, it is not always possible for us to be able to make note of
every person individually who wishes not to be involved.
I understand and agree that all photos
& videos will become the property of Next Steps Movement Studio. In giving photo/video consent, I hereby irrevocably authorize Next Steps
Movement Studio to edit, alter, copy, exhibit, publish, or distribute these
photos for any lawful purpose. In addition, I waive any right to inspect or
approve the finished product wherein my likeness appears. Additionally, I waive
any right to royalties or other compensation arising or related to the use of
the photo. I have read and understood the above photo release.
We will do our best to ensure no photography, video
filming is made of those that have requested to not take part, and that if it
is made, that it is not published. However, we can’t guarantee that
photography, video filming or publication will not occur. By attending the
activity, you confirm that there is the possibility that this may occur, and Next
Steps Movement Studio can’t be held liable.
We will never intentionally post names of children
or people publicly. We will never sell any photography or video to
third parties.
Third Party
Photography or Video filming from any third party
(e.g. parents, customers, friends of customers, grandparents, general public)
may sometimes occur, outside of our control. Please be aware that if we remove
any content that we are in control of at request, there is the possibility for
a third party to have content that they have created. We are not in control of
what happens with this content and will not be held liable.
Where possible, Next Steps Movement Studio will
give participants the choice to remove themselves from the location before a
photograph or video filming occurs.
Insurance
All athletes will be charged an annual registration fee. The annual registration, along with your Next Steps Movement Studio membership, ensures you are registered with Gymnastics Australia and covered for Personal Liability Insurance. This fees covers you for one calendar year. Any member that has not paid their affiliation fee will not be granted permission to attend a class with Next Steps Movement Studio.
