Terms and Conditions

These Terms and Conditions apply to all students enrolled with Ovation Performing Arts. By enrolling your child and/or setting up a payment method for your child's classes, you confirm that you have read and agree to these Terms and Conditions.

Where a parent/guardian is responsible for payment, these Terms and Conditions apply to the parent/guardian as the contracting customer.

1. Enrolment and Monthly Subscription

Places at Ovation Performing Arts are secured on an ongoing basis. Once your child is enrolled in a class, their place will remain reserved unless you choose to cancel in accordance with the notice period set out below.

From September 2026, class tuition will be paid through a monthly subscription system.

The monthly subscription is calculated by taking the total annual tuition for the academic year and dividing it into 12 equal monthly payments.

The annual tuition is based on the planned number of teaching weeks in the academic year. For example:

The monthly payment is therefore an instalment towards the total annual tuition and is not a payment for the individual classes taking place within that particular calendar month.

This means the monthly payment remains the same throughout the year, including during school holidays and in months where there are fewer or no classes.

2. Monthly Subscription Payments

Monthly subscription payments are collected automatically using the payment method provided by the parent/guardian.

Payments will normally be taken on the agreed monthly payment date, as communicated when the subscription is set up.

The monthly subscription amount is based on the annual tuition for the classes attended and may include applicable sibling and/or multiple-class discounts.

Parents/guardians will be informed in advance of any changes to subscription prices.

The monthly subscription continues until the child leaves the school in accordance with the cancellation and notice provisions in these Terms and Conditions.

School Holidays

Monthly payments continue during school holidays.

This does not mean that parents/guardians are paying separately for classes during the holidays. Instead, the total cost of the planned teaching weeks for the academic year is spread evenly across 12 monthly payments.

This approach means families pay the same predictable amount each month rather than paying different amounts depending on how many classes take place in a particular month.

3. Joining Part-Way Through the Academic Year

If a child joins Ovation Performing Arts part-way through the academic year, their remaining tuition will be calculated based on the classes and teaching weeks remaining in the relevant academic year.

The remaining tuition will then be spread across the appropriate number of remaining monthly payments, where applicable.

Parents/guardians will be informed of the monthly subscription amount before the subscription begins.

4. Cancellation and Notice of Withdrawal

Parents/guardians may cancel their child's enrolment by providing 4 weeks' notice.

Notice should be given directly to Ovation Performing Arts by email or another method communicated by the school.

The 4-week notice period begins on the date that cancellation notice is received by Ovation Performing Arts.

Your child's place remains reserved, and the normal subscription arrangements continue, during the 4-week notice period.

Once the 4-week notice period has been completed, the child's subscription will be cancelled and no further monthly payments will be due.

Final Payment

Your final payment will be adjusted where necessary so that you pay for the tuition falling within your notice period.

For example:

If your monthly subscription payment is taken on 1 April and you give notice on 10 April, your 4-week notice period will end on 8 May.

If your child has one class between 1 May and 8 May, the May payment will be adjusted to cover the relevant class/classes within the remaining notice period rather than charging the full monthly subscription amount.

If the amount already paid exceeds the amount due for the notice period, any appropriate adjustment will be made.

5. Absences

Our classes do not operate on a pay-as-you-go basis.

Because the monthly subscription is based on annual tuition rather than the number of classes taking place in a particular month, individual absences do not reduce the monthly subscription.

No reduction or refund will normally be made for classes missed due to illness, holidays, appointments or other personal circumstances.

Parents/guardians should notify the school if their child is unable to attend a class.

6. Fee Changes

Ovation Performing Arts reserves the right to review and change class and subscription prices.

Parents/guardians will be given reasonable advance notice of any price changes before the new price is applied.

Any applicable discounts will also be communicated clearly and may be subject to the terms of the relevant discount.

7. Late and Failed Payments

To ensure the smooth operation of Ovation Performing Arts and allow us to meet our commitments to teachers, venues and suppliers, payments must be made on time.

If a monthly subscription payment fails, we will contact the parent/guardian and provide information on how to update payment details or make the outstanding payment.

Late Payment Process

Step 1 – Initial Late Payment

If a monthly subscription payment becomes overdue, we will contact the parent/guardian by email and/or text message to remind them of the outstanding payment.

Step 2 – Further Reminder

If payment remains outstanding, a further reminder may be sent by email and/or text message.

Step 3 – Further Action

If payment remains unpaid after reasonable reminders and no communication has been received, Ovation Performing Arts reserves the right to take further reasonable action to recover the outstanding amount. This may include referring the account to a debt collection agency where appropriate.

Any additional charges associated with late payment or debt recovery will only be applied where they are reasonable, proportionate and permitted by law.

Financial Difficulty

If a family is experiencing financial difficulty, we encourage parents/guardians to contact us as early as possible.

We will always aim to discuss a temporary payment arrangement where appropriate.

8. Holiday Camps and Workshops

Holiday camps and workshops are separate from the regular monthly subscription unless specifically stated otherwise.

Where a deposit is required, this will be payable at the time of booking.

Cancellation and refund arrangements for holiday camps and workshops will be communicated at the time of booking.

9. Supervision of Students

Teachers are responsible for students during their scheduled class time only. All teaching staff are DBS checked.

Responsibility for a child ends when the child leaves the teaching room at the end of the class.

Young children must be collected by their parent/guardian or an authorised adult.

If a child is not collected at the expected time, a member of staff will supervise them until they are collected.

Parents/guardians should inform Ovation Performing Arts if someone other than the usual parent/guardian is collecting their child.

10. Child Protection and Safeguarding

Ovation Performing Arts maintains a safeguarding and child protection policy.

Parents/guardians may request to review the relevant safeguarding policy at any time.

All staff and volunteers are expected to follow the school's safeguarding procedures.

11. Behaviour Expectations

Students are expected to behave respectfully and courteously towards other students, staff, volunteers and members of the public.

Ovation Performing Arts will take reasonable and proportionate action where behaviour is inappropriate or disruptive.

Where serious or persistent behavioural issues arise, the Principal may take steps to end a student's enrolment.

Where possible, parents/guardians will be informed and given the opportunity to discuss serious behavioural concerns before a decision is made.

Any decision to end a student's enrolment will be made fairly and in accordance with applicable consumer law.

Bullying of any kind is strictly prohibited. Parents/guardians who have concerns about bullying should notify the Principal as soon as possible.

12. Respectful Environment

All students, parents/guardians, staff and volunteers are expected to maintain a respectful and safe environment.

Smoking, alcohol and illegal drug use are prohibited on teaching premises and at school activities where prohibited by the venue or applicable law.

Aggressive, abusive or threatening behaviour towards students, parents, staff, volunteers or venue staff will not be tolerated.

13. Class Cancellations and Changes

Ovation Performing Arts will make reasonable efforts to provide classes as scheduled.

Occasionally, a class may need to be cancelled, postponed or moved due to circumstances including venue restrictions, government instructions, staff availability, severe weather, safety concerns or other circumstances outside our reasonable control.

Where reasonably possible, we will provide notice of any changes and may offer an alternative class, replacement session or online session where appropriate.

Where a class cannot be provided, any refund, credit or alternative arrangement will be considered fairly having regard to the circumstances.

Ovation Performing Arts will not be responsible for costs or losses incurred by families as a result of circumstances outside our reasonable control.

Parents/guardians are encouraged to check the school's usual communication channels, including email, WhatsApp or Facebook, for important updates.

14. Illness, Accidents and Holidays

Parents/guardians should not send a child to class if they are unwell or have a contagious illness.

Individual classes missed due to illness, personal appointments, family holidays or other personal circumstances are not normally refundable or credited because the monthly subscription is based on the annual tuition rather than attendance at individual classes.

Where a child is unable to attend for an extended period, parents/guardians should contact Ovation Performing Arts to discuss the circumstances.

15. Contact Information and Medical Information and social media/photo consent

Parents/guardians are responsible for ensuring that Ovation Performing Arts has accurate and up-to-date contact and emergency information for their child.

Parents/guardians should inform the school promptly of any relevant changes to medical or other information that may affect their child's safety or participation in classes.

Parents/ guardians should inform Ovation Performing Arts of any changes to their child’s photo and social media consent.

16. Transportation

Staff members are not permitted to transport students under the age of 18 unless prior written consent has been provided by the parent/guardian and the arrangement has been specifically authorised by Ovation Performing Arts.

17. Personal Property

Ovation Performing Arts is not responsible for loss, theft or damage to personal belongings brought to classes, rehearsals, workshops, performances or other activities, except where liability cannot legally be excluded.

Students are encouraged not to bring valuable or unnecessary personal items to class.

18. Private Lessons

Private lessons are booked separately from the regular monthly subscription unless otherwise agreed.

If a private lesson is cancelled by the parent/guardian with less than 24 hours' notice, the full session fee will normally remain payable.

Where a private lesson is cancelled by Ovation Performing Arts, we will aim to offer an alternative date where reasonably possible.

19. Discounts

Where applicable, sibling and multiple-class discounts will be applied to the relevant subscription.

Our current discounts are:

Multiple-class discounts do not apply to Show Class unless specifically stated.

Discounts are applied in accordance with the school's current pricing structure and may be reviewed from time to time.

20. Show Class

Our Saturday Show Class operates under separate arrangements because it is linked to the production schedule.

Approximately one month before the end of the current show period, Ovation Performing Arts will contact families to ask whether they wish their child to continue with the next production.

If a family chooses not to continue with Show Class, the Show Class subscription will be cancelled at that point in accordance with the specific arrangements communicated for that production.

The Show Class subscription price is separate from the standard class pricing structure unless otherwise stated.

21. Agreement to Terms and Conditions

When enrolling a child and setting up a payment method, parents/guardians will be asked to confirm that they have read and agree to these Terms and Conditions.

Where the payment system provides for an acceptance checkbox, the parent/guardian should actively confirm their agreement before submitting their payment details.

A copy of these Terms and Conditions will be made available to parents/guardians and should be retained for their records.

22. Changes to These Terms and Conditions

Ovation Performing Arts may update these Terms and Conditions from time to time where reasonably necessary, including to reflect changes to our services, pricing, payment systems, legal requirements or operational arrangements.

Where a change materially affects the rights or obligations of parents/guardians, we will provide reasonable notice and explain the change before it takes effect.

We will not use changes to these Terms and Conditions to unfairly alter a customer's existing rights or obligations.

23. Consumer Rights

Nothing in these Terms and Conditions is intended to exclude or restrict any rights that parents/guardians have under applicable consumer protection law.

Where a provision of these Terms and Conditions conflicts with a mandatory legal right, the legal right will apply.

24. Acceptance

By enrolling your child at Ovation Performing Arts and, where applicable, setting up a monthly subscription payment method, you confirm that you have read and agree to these Terms and Conditions.
