IMPORTANT: Please read these terms and conditions carefully before submitting. By submitting this application, you are accepting the following clauses 1 to 18 inclusive.
"ROCKIT Productions" or "ROCKIT" refers to ROCKIT Productions PTY LTD (ABN: 69619437062), its representatives, employees, volunteers, and sub-contractors and shall be read accordingly.
“YOU" means you, the student enrolled, or anybody who in ROCKIT Production’s reasonable opinion is acting with your authority or permission and "YOUR" shall be read accordingly.
“ACTIVITIES" includes, but is not limited to, all classes, workshops, performances, rehearsals, events, or other related company activities organised by ROCKIT Productions.
PAYMENT
1. Full training fees apply for course enrolment. In agreeing to these Terms and Conditions, you are committing to pay the entirety of your fees whether the student completes the course or not.
2. ROCKIT Productions offers the following payment options: Single Payment (via EFT, Cash, or Credit Card), or Multi-Payments (Direct Debit via Credit Card or Bank Account). Please note credit card payments incur surcharges per transaction.
3. ROCKIT Productions is not responsible for changes in your personal circumstances. If you wish to transfer or withdraw from a training program, once a course has commenced, you must advise ROCKIT Productions in writing and any outstanding amounts for your full course fees (as per clause 1 herein) must be made at this time. In such a case, ROCKIT Productions MAY, at their sole discretion, negotiate a credit or other agreement regarding the unused value of this Agreement. If a credit is negotiated, this is to be used with ROCKIT Productions within 12 months of being awarded.
4. Under normal circumstance, ROCKIT Productions will not be compelled to refund training fees unless the course is cancelled or postponed. In such a case, a refund or credit note to the value of that already paid for training will be extended to the student. (Credit notes be used with ROCKIT Productions within 12 months of being awarded)
5. After the training you have registered for has commenced, ALL requests for refunds will be declined and there will be no adjustments or refunds for missed classes. Exceptional cases may be subject to further consideration by ROCKIT Productions.
DELIVERY OF TRAINING
6. All training programs at ROCKIT Productions are subject to change. ROCKIT Productions reserves the right to change course structures and learning outcomes, move rehearsal and performance venues, change dates and times of rehearsals / performances / events, and to replace teachers when necessary, with other, suitably qualified and experienced, industry professionals.
7. ROCKIT Productions shall not be liable in damages or otherwise for any failure to comply with the proposed schedule or outcome delivery for events beyond their reasonable control (Force Majeur).
8. ROCKIT Productions reserves the right to refuse any enrolment as permitted by law or to request a participant to leave a class or training program if they are disruptive, consistently late or absent or they have not paid their fees.
9. ROCKIT Productions programs and courses are designed for training purposes and personal growth in a fun and encouraging environment. ROCKIT Productions endeavour to ensure that each student is involved and challenged in each rehearsal, no matter which role they may be cast in. We must impress upon you that, when you apply for an audition, this does not guarantee your child a leading role in the production. Agreeing to these Terms and Conditions also confirms that your child’s participation in the course will not be conditional on the size of the role your child is offered.
MEDICAL INDEMNITY
10. While ROCKIT Productions has taken all reasonable health and safety precautions to keep students, teachers, audience, staff and performers safe, you enter the venue at your own risk without recourse to claim against ROCKIT Productions regarding health outcomes.
11. By agreeing to these terms and conditions, you and the student nominated understand COVID-19 restrictions and protocols may be in effect and are likely to change without warning and agree to stay up-to-date and follow requirements for the industry, venue, and local government area as specified. This includes but is not limited to venue guidelines such as physical distancing, hand hygiene, contact tracing, mask wearing, vaccination mandates, and more. I have considered the risk of COVID-19 and my student's own personal circumstances, including any health conditions or vulnerability that they may have prior to attendance. The venue reserves the right to refuse entry to patrons (Students, guardians, teachers, and other personnel / participants) who are displaying signs of illness / COVID-19 or who fail to comply with the conditions of entry.
12. All ROCKIT Productions training programs involve physical activity. By enrolling in a training program, students will indemnify ROCKIT Productions from all liability or responsibility for injury which might be sustained in the normal conduct of classes, rehearsals or performances, not withstanding any negligence by ROCKIT Productions personnel.
13. By agreeing to these terms and conditions, you authorise your child to participate in all activities of ROCKIT Productions from this date forward. You acknowledge that you must advise in writing if they are not physically fit to participate fully in the activities. You also acknowledge that there are risks in participating in the activities and agree that, having taken such precautions as in its discretion are deemed advisable, ROCKIT Productions will not be held responsible for any injury, sickness, or accident or for any loss or damage to personal property resulting from participating in the activities. You authorise ROCKIT Productions to secure medical care if necessary and if for any reason medical attention beyond any first aid furnished by or on behalf of ROCKIT productions is required, you agree to be responsible for any expenses incurred. You agree to indemnify the Company, its officers, directors, agents, volunteers, contractors, and employees and save them harmless from and with respect to all suits, actions and prosecutions by reason of any activity carried out by me whether on or off the company’s property. You give permission for ROCKIT Productions to administer basic First Aid to your child if required on your behalf in case of medical emergency.
MEDIA CONSENT
14. You authorise ROCKIT Productions to take photographs, collect comments, record audio, and film/video footage of your child for promotional and educational purposes from this date forward without expiry. This material may be used for media releases, printed materials, curriculum outcomes, and electronic communication (including online social media) and grant permission for these reproductions either in full or part and in conjunction with any wording for the purpose of promoting ROCKIT Productions and its activities in a positive manner.
PHYSICAL INTERACTION
15. You understand from time to time, students will come into physical contact with fellow students for staging / choreography and ROCKIT Leaders for training correction and safety. Such examples include but are not limited to administering basic first aid, holding hands when crossing the road, technical correction / demonstration, partner work, and pre-show focus (Circle of Love).
MEDICATION SUPERVISION
16. ROCKIT Productions and all representatives are legally prohibited from administering medication. (EG, ibuprofen, paracetamol, etc) If your child requires prescribed medication while attending, they must be able to self-administer and provide ROCKIT Productions with medication details to be used for adult supervision only. If your child has an anaphylactic trigger and requires an EpiPen or asthma and requires preventative or acute medication, please supply an Action Plan for supervisor administration.
STUDENT BEHAVIOUR
17. All ROCKIT students are expected to follow behavioural guidelines. By accepting these terms and conditions you and your child/children agree to follow these guidelines.
