Terms and Conditions
Please read these terms and conditions carefully. Upon enrolling into classes at Ruth Nuttall
School of Dance a legally binding agreement is formed and your (or your child’s) attendance
at our classes will be strictly subject to full cooperation with these terms.
Please note that if any parent/ career or student is in material or persistent breach of any of
these terms and conditions, we reserve the right immediately to terminate the contract with
you and/or exclude your child from attending further classes until such time that the matter
can be resolved or the agreement is terminated, without further liability to you.
1. Class Booking, Payments and Fees
1.1. The first two classes will be offered on a trial basis for all children new to the school.
Payment for the trial must be made in advance of the classes via card upon booking via the
website.
1.2. On enrolling to the school following your trial classes, you will be sent an invoice via
Classmanger with the remaining sessions for the month your dancer joins.
1.3. In order for a place to be kept open for your child in our classes, payment is required
monthly in advance, by subscription only. Payments will be taken on the first of the month
(your first payment will consist of an additional month to cover your withdrawal fee).
1.4. The system we use for payments is GoCardless. All registrations and payments are set
up through this system. We no longer accept cash, cheques or BACS payments for class
fees.
1.5. We reserve the right to make changes to these amounts and/or collection dates if
necessary. In this case, you will be given notice via email prior to collection. All ''Class Fees''
and ''Additional Fees'' are subject to change at any time on a term by term basis. Up to date
fees will be published on the Classmanager Portal or are available on request.
1.6. Payment will be taken from the account you specify on the 1st of every month. Late or
missed payments may result in your child losing their place in class. If you are experiencing
payment issues, please contact us as soon as possible so we can help.
1.7. Prices are based on 36 weeks' worth of classes, split over 12 months. Fees are
averaged over 12 months to ensure consistent monthly payments, including during holiday
periods when classes do not run. Therefore a payment will be taken on 1st August.
1.8. Other events, including but not limited to exams and shows, can be offered at the
discretion of the principal and will be priced individually and independently to class fees.
1.9. All class fees and event payments are non-refundable, except in exceptional
circumstances at our discretion.
1.10. All fees remain payable whether or not your child attends the classes. There are no
reductions or refunds for missed classes under any circumstances (including injury, sickness
or holidays). A refund will not be provided if classes have to be cancelled due to an event
beyond our reasonable control including but not limited to fire, flood, storm, adverse weather (in any season) or other Act of God, pandemic or epidemic of any disease, industrial action,
war, civil unrest, terrorist threat or incident.
1.11. A late payment fee of £10 will be added if subscriptions fail on the third attempt.
1.12. Dancewear, uniform and shoes can be ordered through the school's preferred
suppliers, as listed on the website.
1.13. The principal reserves the right to refuse to teach anyone whose fees or payments are
in arrears.
2. Changing and Cancelling Classes
2.1. Should you wish to add or cancel your child's class, we require one month's written
notice via email to [email protected]. Notice takes effect from the date we receive your
email, and fees remain payable for the full notice period. For example, if notice is given on
2nd February, the notice period would run from 1st–31st March, and a closing statement
balance will be sent.
2.2 Requests for changes to class schedules or levels may be made but remain entirely at
our discretion and no change can be guaranteed.
2.3. If the scheduled teacher is unavailable (due to ill health or other emergency, for
example), every effort will be made to reschedule the class.
2.4. Weather/emergency and any closures due to circumstances beyond our control: we
may cancel classes at short notice. These will be rescheduled where possible.
3. General
3.1. New students will be taken into a class as soon as a place becomes available. It is not
always necessary to wait for the new month. If a place is unavailable immediately then an
alternative class will be offered if available, or the child will be placed on a waiting list.
3.2. It is the parent/carer's responsibility to ensure that the information the school has about
a child is up to date and relevant, using the Classmanager portal.
3.3. At all times the staff will endeavour to keep the highest standards of instruction and
behaviour. Students must follow all school rules and instructions and a failure to do so will
result in a breach of these terms and conditions. Disruptive, disrespectful or antisocial
behaviour in on or around the premises will not be tolerated by any person associated with
the school (whether before, during or after classes) and we reserve the right to exclude that
student on a temporary or permanent basis in our sole discretion. In the event of any
temporary or permanent exclusion no refund will be applicable.
3.4. All students must wear correct uniform for classes and exams, including appropriate
hairstyle. No jewellery is to be worn. Please label all uniform and shoes clearly.
3.5. Attendance is expected at all agreed classes and rehearsals; any absences should be
notified in advance to the principal.
3.6. Pupils will be entered for examinations, shows, presentations etc. at the discretion of the
principal.
3.7. In the event that the regular teacher is unavailable for class, a suitable cover teacher will
be supplied where possible, or the class will be re-arranged.
3.8. The school and the principal accept no responsibility for loss of or damage to personal
belongings.
3.9. You understand and agree that dance teachers may use tactile feedback and instruction
with students to support verbal feedback and instruction where appropriate.
3.10. A basic first aid kit is kept on the premises and those holding an up to date first aid
qualification may administer basic first aid on students if necessary whilst a student is at the
School. However, to the fullest extent permitted by law, and otherwise as set out in these
terms dance teachers and the School shall not be responsible for any injuries or accidents
that occur and which are outside of our reasonable control.
3.11. If a student needs to take any of their own medication (whether self administered or
otherwise) whilst at the School we ask that parents be available to administer the medication
unless otherwise previously agreed with us. In any event, we cannot be held liable and
accept no responsibility for administering such medication (and/or the effects of the same)
and the students’ parent/guardian takes full responsibility.
3.12. By agreeing to these terms you hereby consent to us taking photographs/ video of your
child where appropriate to record or photograph students for educational and/or marketing
purposes which may include usage on social media. Your preference for sharing of images
is recorded on your Classmanager account and consent can be changed at anytime at your discretion.
3.13. Your payment and child's attendance at class act as your acceptance to these terms
and conditions.
4. Adult Pay As You Go Classes
4.1. Classes can be booked on a pay-as-you-go basis for adult dancers, subject to
av
ailability.
4.2. Payment must be made in full, in advance, via card or BACS payment at the time of
booking through their invoice. We do not accept cash or cheque.
4.3. A place in class is only secured once payment has been received; arriving without a pre-
paid booking does not guarantee entry if the class is full.
4.4. Pay-as-you-go bookings are non-refundable and non-transferable to another person,
except in exceptional circumstances at the discretion of the principal.
4.5. If you are unable to attend a booked class, please notify us at least 24 hours in
advance. With sufficient notice, we may offer a credit towards a future class; late
cancellations and no-shows will not be refunded or credited.
4.6. Credits issued for cancelled classes must be used within the following term of issue.
4.7. The school reserves the right to cancel or reschedule a class due to low numbers,
teacher illness, or circumstances beyond our control. In this event, a full refund or credit will
be offered.
4.8. Correct dancewear or comfortable clothing suitable for movement should be worn, along
with appropriate footwear. No jewellery should be worn during class.
4.9. Where relevant, the general terms outlined in Sections 2 and 3 of this agreement apply
equally to adult pay-as-you-go classes.
4.10. Booking and attendance at a class constitutes your acceptance of these terms and
conditions.
5 Limitation of Liability & Disclaimer
By entering into these Terms and Conditions you hereby waive and release the School from
all claims arising from injury of any manner resulting from participation in a class other than
as a direct result of our negligence.
Where relevant the dancer or their parents or guardians should seek medical advice before
carrying out any exercise or in relation to the suitability of the class and we cannot be held
liable for any claim as a result of attendance where unsuitable.
We accept no responsibility and cannot be held accountable for any loss or damage of
personal belongings or property whilst attending a class or on the premises.
Nothing in these terms and conditions shall in any way limit Ruth Nuttall School of Dance
liability for fraud or fraudulent misrepresentation or for death or personal injury caused by its
negligence, or any other liability which cannot be excluded at law and your statutory rights
are in no way affected.
Governing Law
These terms and conditions are governed by the laws of England and Wales.
