Sharky Sports – Terms & Conditions

Liability & Risk

Parents agree that by enrolling in our program they are allowing their children to participate at their own risk. In agreeing to participate in a Sharky Sports program I:

• Release and forever discharge Sharky Sports from all claims that I may have or may have had arising from, or in connection with, my child and a Sharky Sports program; and
  
  
• Indemnify, will keep indemnified and hold harmless Sharky Sports, to the extent permitted by law in respect of any claim as a result of or in connection with a Sharky Sports program.
  
  

I warrant that my child has not at any time suffered blackout, seizure, convulsion, fainting, dizzy spells or any other medical condition and is not presently receiving treatment for any illness, disorder or injury which would render it unsafe for my child to take part in a Sharky Sports program. I consent for my child to participate in a Sharky Sports program and understand the risk involved.

I acknowledge that Sharky Sports uses its best endeavours to ensure that the equipment and sporting facilities used in the program are safe and fit for purpose and acknowledge that all sports are inherently dangerous. I have voluntarily read and accept the inherent associated risks. "Sharky Sports" means any representatives of Sharky Sports. "Sharky Sports Program" includes all programs and activities that you or your child participate in during our courses and classes.

Child Behaviour & Participation (The "No Daycare" Policy)

Sharky Sports is a sports development program, not a daycare service. We are committed to providing a high-quality, positive environment for children who want to engage and learn.

By enrolling in the program, parents and guardians acknowledge that:

• Children are expected to follow reasonable instructions and participate appropriately in activities.
  
  
• Participation is Voluntary: We do not "force" children to play. If a child flatly refuses to participate or shows a persistent lack of interest, they may be removed from the program. We ask that parents do not force children to attend if they are unwilling, as this disrupts the session for other players and staff.
  
  
• 3-Step Management: Staff follow a 3-step process for disruptions (Verbal Warning, Brief Reset, Digital Behaviour Report).
  
  

Sharky Sports reserves the right to withdraw a child from the program if:

• Ongoing behaviour is disruptive, aggressive, or unsafe.
  
  
• A child consistently refuses to participate, requiring excessive one-on-one supervision that detracts from the group.
  
  
• A child appears to be attending entirely unwillingly.
  
  

Decisions regarding removal are made on a case-by-case basis. Where applicable, refunds for remaining sessions are at the sole discretion of Sharky Sports.

Photography & Social Media

By enrolling in the Sharky Sports program, you acknowledge and agree that your child may be photographed or filmed during classes. This media may be used for promotional purposes, including but not limited to:

• Official Sharky Sports social media platforms (Facebook, Instagram, etc.)
  
  
• The Sharky Sports website and marketing materials.
  
  

If you do not wish for your child to be photographed or appear on social media, you must email [email protected] prior to the start of the term so a note can be made on your file. Parents are strictly prohibited from taking videos or photographs that include other children in the class without the express permission of those children’s parents/guardians.

Cancellation & No Refund Policy

By enrolling, you are committing to a service contract for a complete term. We do not offer refunds for "change of mind" or issues outside of our control (e.g., weather). A trial session is offered to ensure satisfaction prior to full enrollment; therefore, once enrolled, no refunds are available. In certain medical circumstances (e.g., a broken limb), a credit with a 12-month expiry may be issued at our discretion.

Timetable & Make-Up Classes

All classes are subject to change. While Sharky Sports uses its best efforts to operate classes as per the timetable, in some instances changes are required due to weather or staff unavailability. If your child misses a class, a make-up session may be available at a different location and time. Please contact us to arrange this.

Fee Payment

We only take bookings for an entire term and our fees are structured this way. Fees will be prorated to when you enter the program. All fees must be paid at the time of enrolment by either credit card or bank transfer.

Parental Participation

• Ages 3–5: Parental participation is required to maintain class structure and focus.
  
  
• Ages 5+: Parents are not required to be present for the duration of each class.
  
  

Illness Policy Please do not bring your child to class if they are unwell. This includes a runny nose, temperature, or coughing. If your child is unwell, please take advantage of a make-up class.

Code of Conduct

Player

• Adhere to the principles of fair play and always play by the rules.
  
  
• Respect the rights and dignity of every person including teammates, opponents, and coaches.
  
  
• Respect the decisions of coaches and never argue with them.
  
  
• Always play to the best of your abilities and participate for enjoyment.
  
  
• Never engage in inappropriate conduct, including offensive language or gestures.
  
  
• Care for the equipment and facilities provided.
  
  

Coach

• Promote a safe and inclusive environment free from discrimination or harassment.
  
  
• Ensure all equipment and activities meet safety standards and are age-appropriate.
  
  
• Promote fair play and discourage unsporting behaviour.
  
  
• Follow the advice of a medical officer in determining when an injured participant may return.
  
  
• Maintain respectful and appropriate relationships with all participants.
  
  
• Never engage in inappropriate conduct, including drinking or smoking whilst in an official capacity.
  
  

Parents and Spectators

• Encourage players to play by the rules and show respect to coaches and opponents.
  
  
• Respect the rights and dignity of players, coaches, and other spectators.
  
  
• Understand that sport is designed to be fun; participation and enjoyment come before results.
  
  
• Act as a role model at all times, displaying high standards of sporting behaviour.
  
  
• Participate in positive cheering that reinforces participant efforts.
  
  

Sharky Sports Management

• Promote a safe and inclusive environment and protect the integrity of the sport.
  
  
• Ensure appropriate safeguarding measures and digital reporting policies are in place and reviewed regularly.
  
  
• Ensure all participants, coaches, and parents place wellbeing and enjoyment ahead of performance.
  
  
• Be impartial, consistent, and transparent in decision-making.
  
  
• At all times act as a role model for others, displaying high standards of good sporting behaviour.
