Terms and Conditions

This document outlines the agreement governing the relationship between Tenacity Dance and you, as the Parent/Guardian. These conditions are crucial to uphold standards and ensure that all members derive the utmost benefit from their association and membership with us.

 

Understanding and comprehension vary based on individual students' age and maturity levels. We strongly advise parents/guardians/carers to discuss safeguarding, health, safety, and our code of conduct with their children/family members to ensure comprehensive understanding and compliance with the terms and conditions stated herein.

 

By enrolling in Tenacity Dance membership, you affirm your understanding, agreement, and commitment to the membership terms, safeguarding measures, health and safety guidelines, and code of conduct detailed in this document.


Membership


1. Membership basis:

a. Tenacity Dance School operates on a membership basis, requiring members to register and pay for half-termly blocks of classes, typically spanning 5, 6, or 7 weeks per half term.

b. The minimum membership commitment is for one half term, with fees required in advance for the entire duration (half term period).

c. Membership automatically continues after the initial period, unless either party decides to terminate.

d. Enrolment at Tenacity Dance is at the discretion of the school's management, reserving the right to refuse enrolment for any reason.

e. Any free trial session is subject to approval by Tenacity Dance, depending on availability, and does not guarantee placement within Tenacity Dance. 


2. Fees, Payments, and Refunds:

a. Membership fees vary based on the specific class/group enrolled in by your child/student. Prices can be found on the Tenacity Dance website.

b. Fees are paid on half-termly basis.

c. Payment for class fees of the upcoming half term is required in advance for existing members, typically due approximately 1 week before the commencement of each new half term.

d. New joiners are required to pay for the remaining sessions in the ongoing half term block upon registration, following a free trial session (if offered).

e. Membership fees are non-refundable, and no reimbursements are provided for non-attendance to scheduled sessions due to sickness, holiday, government restrictions or a decision by the parent or student not to attend. Additionally, Tenacity Dance is unable to offer make up sessions for any that are missed.

f. Payments for standalone masterclasses and workshops are non-refundable unless under exceptional circumstances.

g. Failure to make timely payments may result in the withdrawal of attendance rights until payments are brought up to date.

h. Non-payment may lead to membership suspension or cancellation and exclusion from Tenacity Dance.

i. Tenacity Dance cannot refund fees or provide makeup sessions for missed classes by your child/student due to sickness, holiday, government restrictions, or voluntary non-attendance.

j. Payments are facilitated via Tenacity Dance's management system, utilising card payments or direct debits.

k. Payments by bank transfer, cash or cheque is not accepted, unless by prior approval with Tenacity Dance.

l. Payment requests and invoices are notified through the Tenacity Dance account portal and by email.

m. Tenacity Dance reserves the right to charge a reasonable late payment fee for invoices overdue by more than 14 days to cover administration costs associated with debt collection.


3. Termination and cancellation:

a. Tenacity Dance reserves the right to terminate membership due to serious or repeated breaches of membership rules, misconduct, or obligations by you and/or your child/student.

b. This agreement can be terminated if either party is in serious breach of their obligations to the other.

c. Accounts in arrears on more than three occasions within a calendar year may lead to immediate membership termination.

d. Written notice of one half term is required to withdraw your child/student from membership, with the fee for the notice period payable regardless of attendance.


4. Liability Limitation:

a. To the extent permitted by law, Tenacity Dance's liability, except in cases of death or personal injury resulting from negligence, is limited to the total amount paid for the membership.

Safeguarding and Health & Safety


6. The wellbeing of our students is paramount at Tenacity Dance. We are responsible for adhering to safeguarding and health and safety measures to ensure students' wellbeing and safety while in our care.


7. Tenacity Dance must be kept informed of emergency contact and medical information changes. It is the responsibility of the parent/guardian/carer to update this information in their Tenacity Dance parent portal account.


8. It is the parent/guardian/carer’s responsibility to ensure their children/students safety before and after class(es). Tenacity Dance teacher and staff cannot take responsibility for children outside of the class times. Therefore, students under the age of 18 must be supervised by their parent/guardian/carer whilst on the premises until their class begins.


9. No student will be allowed to leave the studio/premises during a class unless instructed or with prior agreement with the teacher. If your child/student needs to leave early you should inform the teacher at the start of the class.


10. Only students who are participating in the class will be allowed into the studio.


11. Only parents/guardians/carers whose children are participating in the class will be allowed to wait on site.


12. For children/students under 18, parents/guardians/carers must collect them from the designated area in the venue after a class. Students should not wait outside the building but remain within the studio/hall's vicinity until collected to ensure Child Protection.


13. Bags must be placed safely in designated areas as instructed by the teacher and not left on the floor to avoid accidents.


14. Teaching dance occasionally requires the teacher to place hands on your child/student in order to facilitate improved placement of the body. Prior to doing so, students are always asked for permission. Please speak with teachers if you have any questions relating to this.


15. Inform the teacher before class if your child/student has a new injury or condition requiring staff awareness.


16. Trained first aiders among our staff will administer emergency first aid when necessary. Relevant medical information will be provided to emergency personnel if required when someone on our premises needs emergency aid.


Code of Conduct:


17. All Tenacity Dance members are expected to exhibit a professional attitude and commitment, including excellent attendance, punctuality, and dedication to extra rehearsals, events, and performances as required.


18. Notify all absences in advance via email to [email protected] (absences due to sickness or holiday are non-refundable).


19. Students should arrive in good time, at least 5 minutes before the class. Your child/student should be ready to dance, having been to the toilet in time to start their class at the designated time. Similarly, parents/guardians/carers must be punctual for collection. When teachers need to wait for a parent to arrive it results in a delay in the subsequent class starting.


20. Attendance is extremely important. If your child/student does not attend on a regular basis they risk disrupting the class for others as well as disrupting their development. It is not always possible to make up these classes and will affect their performance. We reserve the right to withdraw students from certain events if attendance has been poor.


21. Suitable clothing and footwear (trainers/plimsolls) for dancing should be worn. We offer Tenacity-branded dancewear for purchase; however, it is optional and not compulsory to wear Tenacity clothing. Our website features Tenacity clothing options, including t-shirts, hoodies, and jog pants.


22. Attire and footwear such as crop tops, sandals, heels, crocs, and ugg boots are not permitted. Furthermore, clothing displaying offensive text or images is strictly prohibited.


23. Valuable items should not be bought to class. Students are obliged to take care of their own belongings. Tenacity Dance does not accept responsibility for any personal belongings or valuables bought onto the premises and will not be held liable for losses and damages to personal property. 


24. Students and parents/carers are expected to be respectful to each other and to behave in an orderly, civilised, and well-mannered way towards the teachers/staff of Tenacity Dance and other students/parents. This includes following all instructions without argument or complaint. Failure to do so may result in withdrawal from the school.


25. Students must arrive at class with a positive attitude and be willing to participate fully.


26. Negative/foul language, bullying and intimidation will not be tolerated under any circumstances.


27. Students must not display violent or threatening behaviour toward anyone within Tenacity Dance (This includes students, staff, teachers, or parents). Such behaviour will constitute misconduct and results in immediate dismissal.


28. Students or parents/guardians must not post or share anything negative or of a derogative nature in regard to any student, teacher, parent, or anything else related to Tenacity Dance on any media and/or online platforms such as Facebook, Twitter, Email. If you have a grievance or complaint, you should direct these in the first instance to Tenacity Dance by emailing [email protected]


29. Students must always demonstrate respect for the studio; this includes not purposely causing damage, keeping the studio tidy and ensuring that all rubbish is placed in the bin.


30. Mobile phones must not be used during class.


31. No food, gum, sweets or drinks other than water and juice are permitted in the classes/dance studio.


32. No smoking on the premises


33. Students must understand that at all times, even when they are not at the studio, when they are wearing Tenacity Dance uniform, they are representing themselves and the dance company, so should ensure they behave appropriately and act in accordance with the Tenacity Dance code of conduct and general behavioural expectations.

34. Class timetables and teachers are subject to change from time to time without notice.


35. Tenacity Dance may capture photographs and videos during classes, shows, and competitions for promotional and publicity purposes. These media materials may be utilized on our website, official Facebook page, official Instagram account, email marketing, newspapers, and newsletters, among other platforms. By enrolling your child/student in Tenacity Dance membership, you are consenting to the possibility of your child/student being photographed or recorded. You grant permission for the use of these photos and videos for publicity and promotional purposes as previously mentioned. Should you prefer to withhold permission for the publication of your child/student's photos/videos in public domain media, you can specify your consent preferences through your parent portal account.


36. Tenacity Dance provides existing members with the chance to join our competitive crews through invitation only. To qualify for an invitation to join a crew, students are required to actively participate in at least one of our weekly training sessions. Crew classes/training are additional and necessitate regular attendance in a general class to maintain consistent training. Solely attending a crew class without participating in a general class is not permissible.
