Waiver and Release of Liability

1. Waiver and Release of Liability:
In consideration of the risk of injury while participating in dance activities, I, the participant, hereby waive any rights or claims for physical or psychological injury, including illness, paralysis, or death, that may arise from participating in these activities. This waiver and release of liability includes traveling to and from dance events.
I voluntarily participate in dance activities entirely at my own risk, acknowledging the potential for serious injury or death due to various factors such as terrain, weather, equipment, and actions of others. I understand that these risks may arise from my own or others’ negligence, and I assume full responsibility for my participation.
I agree to indemnify and hold harmless The Dance Factory Townsville and its affiliates from any claims or actions arising from my participation, including legal fees and costs. Additionally, I accept liability for any damage to equipment or facilities caused by my actions.
2. Medical Condition and Physical Fitness:
I hereby certify that the participant is physically and mentally capable of participating in the Classes. I understand that it is my responsibility to inform The Dance Factory of any pre-existing medical conditions, injuries, or limitations that may affect the participant's ability to engage in physical activity.
3.Permissions:
I hereby consent to receive medical treatment deemed necessary if I am injured or require medical attention during dance activities. I understand and agree that I am solely responsible for all costs related to such medical treatment and any related medical transportation and evacuation. I release, forever discharge, and hold harmless The Dance Factory Townsville and its affiliates from any claim based on such treatment or other medical services.
4. Conclusion:
I have carefully read this waiver and release of liability and understand its terms. This agreement is clear and unambiguous, entered into without duress, and will be interpreted based on its language. If any part of this agreement is found to be invalid or unenforceable, the remaining provisions will still apply.
This release may not be orally modified and constitutes the entire agreement of The Dance Factory Townsville and its affiliates, and me with respect to the subject matter containedherein and supersedes all prior and contemporaneous agreements, both written and oral, with respect to such subject matter.
