Terms and Conditions


By enrolling your child at The Young Creatives Portsmouth or Havant, you accept these terms and conditions ("Terms & Conditions") and sign your agreement to them as an ongoing agreement between you and TYC ("Agreement").

The Agreement is made between the parent/guardian ("Parent" "Customer", "you" or "your") of each enrolled student ("Student" "TYC member") by a Parent and TYC ("The Young Creatives", "we", "our", "us")  and is valid at all times whilst the Student is enrolled on any TYC activity and until such time as written notice is given in accordance with these Terms & Conditions.


1. INTRODUCTION
 - These Terms & Conditions apply to all our TYC Classes, Holiday Workshops,  and any additional products and/or services offered by TYC

 - For participation of a Student in a TYC Activity all Parents are required to consent to these Terms & Conditions by ticking the acceptance box for these Terms & Conditions. We may update these Terms & Conditions from time to time.
 
 - A "Class" refers to a course of classes offering tuition in performance which will be delivered during the Term (including online activities). Classes will take place once per week for a certain number of hours, as detailed at the time of booking.

 - "Holiday Workshops" refer to Workshops (including online activities) run by TYC during the breaks between Terms.
 

 - "Term" refers to one normal academic term, TYC terms run 3 times a year for 11 to 13 weeks per term

 - "Term Dates" refers to the dates for the relevant Term.

-  "Workshop" refers to a one-off course (including online activities) offering tuition in dance, drama, singing and/or other performing arts related activities which will be delivered for a certain number of hours per day for a period of between one (1) and five (5) consecutive days and can run at any time throughout the year.

- “Online activity” refers to online streamed lessons and online Workshops utilising the Zoom platform.


 2. ENROLLING A NEW TYC MEMBER 

 - We offer a free trial session to all possible new members. This can be booked online through our website www.theyoungcreativesportsmouth.co.uk

 - If we are unable to accommodate a new student on the chosen date, the parent will be contacted and an alternative date offered.  If we are at full capacity for the chosen class the student may be placed on a waiting list. 

 - After the trial session a follow up email will be sent, and if appropriate, the child will be offered a place as a TYC member. A link to our online portal will be emailed - this provides times, current Term Dates, fees and all relevant course details. An invoice for the remainder of the term will be sent via email also.
 
- Once a child becomes a TYC member they are committed to any event/show/production they have been cast in. Pulling out of an event/show/production that has been started results in many issues. We advise all parents to remind children of the commitment they made when joining a performance based group. 

 3. FEE PAYMENTS
 - For a Student enrolled in a Term, the full fees are paid in advance after an invoice has been received. 

 - For a Student enrolled on a Holiday Workshop, a deposit may be taken and the subsequent payment of the outstanding balance due before the Holiday Workshops start.

 - The Balance must be paid in full, subject to any alternative agreements made with the Artistic Director (Marie), by the first day of the Term or Holiday Workshop, by one of the following methods where offered:  
1. Bank transfer;
2. Debit card;
3. Direct Debit;
4. Cash;

- A £2 transaction fee will be added to the whole amount on all fees.

- No refunds are given for child who do not complete a full term, course or set of workshops. 

- Unfortunately we cannot currently accept Childcare or Tax Credit Vouchers.

- Scholarships are sometimes offered to creative children that we feel will benefit from our classes and workshops. Funded places are also provided. If your child is offered a Scholarship or Funded space they are still expected to commit to attending every session. 


 4. USE OF PERSONAL INFORMATION
 - The personal data (as it is defined in the Data Protection Act 2018) of a Student and/or Parent will be processed by TYC and stored on the Class Manager Portal. Our Privacy Policy can be requested from [email protected] 

-   When a TYC member leaves, their data is removed from the Class Manager Portal.

- Data for Parents who registered Children for Workshops is kept for 1 year from the last workshop date to allow us to keep Parents informed of up and coming workshops. Please contact us via email at any time to opt out from this.

- Our full Data Protection policy can be requested from [email protected]

-Any intellectual property created during any Course, Workshop or Holiday Workshop/Camp is owned by TYC.

 5. HEALTH AND SAFETY
 - Students participate at their own risk and are obliged to inform  staff of any existing injuries or medical conditions. All Class Manager profiles must be kept up to date by Parents, detailing any  known medical conditions.

 - If you are unsure whether a Student should participate in any activity please consult the Student's GP before enrolling the Student.

 - Any medication left brought onto the premises must be clearly labelled and the Student should, unless staff have agreed in writing otherwise, be able to administer it themselves.

 - Students must wear suitable footwear and clothing at all times, including TYC uniform for all Courses.

 - If a Student is unwell or has an accident requiring emergency treatment, the Parent will be contacted via the emergency contact details provided. This number must always be contactable whilst the Student is attending a TYC Activity.
 
-  Parents are solely responsible for ensuring that the emergency contact details are up to date on the Class Manager Portal 

- All online activities are recorded and held for a period of four weeks for safeguarding and quality review purposes. 

 6. PERSONAL PROPERTY
 - Students do not need to bring any personal belongings to Classes or Workshops, if they do they are obliged to take care of their own belongings. TYC can accept no liability for lost or damaged belongings.

 - You acknowledge that the maximum aggregate liability of tyc to a Student or Parent under these Terms & Conditions shall not exceed the TYC Activity fee to which a claim relates.

 - The liability of TYC and that of its staff is restricted to class time only and then only to gross negligence.

 7. GENERAL
 - TYC may, at its own discretion, refuse a Student entry to a AN Activity or session if it is felt that the Student's behaviour is unacceptable

 - TYC reserves the right to make changes to the timetable, the teaching staff,  the advertised programme or the programme delivery mechanism (for clarity this may mean that we switch to online zoom classes) in the event of illness or other circumstances beyond our control.

 - Where a session of a TYC Activity has to be cancelled Parents will be given as much notice as possible. In the event of a last minute session cancellation, you will be notified by email, text message, or via the parent whats app group. Parents must ensure that they provide up-to-date contact details.

- No refunds will be given for Classes cancelled fue to reasons out of the control of TYC. In the event of an Activity being cancelled on the part of TYC in advance, TYC will provide substitute lessons where possible either at an alternative time, venue or online.  If no alternative can be offered, Stagecoach will provide refunds for lessons that are unable to be fulfilled.

 - It is occasionally necessary to change the time and/or venue of a  Activity session. This will only be done if absolutely necessary and TYC will do its best to keep class times, programme delivery mechanisms and/or locations as similar as possible but unfortunately this cannot always be guaranteed.

 - In the event that a Student is unable to attend a TYC Activity session, due to sickness, holiday or a decision by the Parent or Student not to attend, TYC regrets that it is unable to refund any payment.

 - All Students must be collected on time after a session. TYC is unable to supervise Students after a session.

 - TYC Activity fees are reviewed annually and may be increased each year.

 - These Terms & Condition constitute the entire agreement between the parties which supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.

 - In the event that one or more of the provisions of the Agreement are found to be unlawful or otherwise unenforceable, those provisions shall be deemed severed from the remainder of the Agreement.

 -  The Agreement shall be governed by, and construed in accordance with, the laws of England and Wales and any dispute, proceedings or claim shall fall within the jurisdiction of the English courts.
