Terms and Conditions

This is the terms and condition applicable to all physical and virtual classes, courses, workshop and event offered by Welight Art Space.

Please read the Terms and Condition carefully before you make a payment for our classes, courses, workshop or event. By making a payment, you accept these terms and agree to be legally bound by the following terms.

In these terms and condition, ‘us’, ‘we’, ‘our’ and ‘Welight Art Space’ means Welight Art Space Pty Ltd (ACN 632 134 199).

 

1                 Cancellations

1.1             COVID-19

If you have contracted COVID-19, please notify us and refrain from attending your class, course, workshop or event. Please provide us with a doctor’s certificate or COVID-19 test result for our record. To ensure a safe environment at our art school, you must only return to our school once you obtain a negative COVID-19 test.  Other terms and conditions still apply as listed below.

 

1.2          Changes to scheduled classes by Welight Art Space

We reserve the right to amend the scheduling of any class, course, workshop or event. We appreciate your understanding that at times, we may have unforeseeable situation which may affect your booking.If your booking is wholly or partially cancelled by us, we will endeavour to provide a substitute of equal standard. If a class, workshop or event is cancelled due to insufficient enrolments, any students that has previously enrolled in that particular class, workshop or event will be offered an alternative class, a credit or a refund.

  

Term Course

1.3      Refund, cancellation and transfer policy for Term Course or Workshop

The following policy relates to term courses for kids and teens or workshop.

a.         No Refund

Fees once paid are strictly non-refundable, unless in circumstances of an extended illness or physical disability which render you unable to participate in the activities of the term course or workshop. 

 

You are not entitled to a refund if:

i.          you are no longer able to attend the term course or workshop;

ii.         you did not enjoy the term course or workshop;

iii.        you missed some of the classes of the term course or workshop;

iv.        we do not deem that your reason for seeking a refund is commercially reasonable.


b.         Missed Classes

We can offer credit, make up lesson options and/or substitution options for missed classes.

If you or your child have missed your classes, we could provide you with up to two (2) make up lessons or credit refund for one term. You must notify us in writing at least twenty-four (24) hours prior to the class of your reasons for missing the class and that you wish to be provided a makeup lesson or refund in the form of credit.

c.     Student substitutions for workshops

If you have enrolled in a one-day weekday or weekend workshop and you no longer can attend the workshop, you may be able to transfer your enrolment to someone else. Please provide us with notice in writing at least forty-eight (48) hours prior to the workshop that you are unable to attend and provide the details of the substituted student for the workshop.

 

School Holiday Camp Course

1.4     Refund, cancellation and transfer policy for School Holidays Program

The following policy relates to School Holiday Art Camp Course or Workshop

a.         No Refund

Fees once paid are strictly non-refundable, unless in circumstances of an extended illness or physical disability which render you unable to participate in the activities of the school holiday camp course.

You are not entitled to a refund if:

i.          you are no longer able to attend the term course;

ii.         you did not enjoy the term course;

iii.        you missed some of the classes;

iv.        we do not deem that your reason for seeking a refund is commercially reasonable.

b.         Cancellations

A cancellation fee may be payable or your booking fee will be forfeited depending on when you cancel the workshop:

i.          Cancellations before the commencement of the school holidays

Cancellations advised by phone or by email at least five (5) working days before the commencement of our school holiday program will not incur a cancellation fee. However, any paid workshop fees are non-refundable but will be held in credit which must be used within six (6) months from the date of cancellation.

ii.         Cancellations once school holidays have commenced and up to three (3) business days before the workshop

We will charge you a $10.00 fee if you notify us that you wish to cancel the workshop once our school holiday program has commenced and up to three (3) business days before the workshop. The remaining workshop fees will be held in credit which must be used within six (6) months from the date of cancellation.

You may substitute a friend (or sibling) to attend the same class that you have booked at no cost. Please inform us of any substitutions before the workshop commences.

iii.  Cancellations once school holidays have commenced and within two (2) business days of the workshop

We will charge you a $10.00 fee if you notify us that you wish to cancel the workshop once our school holiday program has commenced and within two (2) business days before the workshop. You will not receive any credit if you cancel a workshop within two (2) business days before the commencement of the workshop.

You may substitute a friend (or sibling) to attend the class that you have booked at no cost. Please inform us of any substitutions before the workshop commences.

c.         Class transfers

If you wish to transfer your existing booking to a different holiday class within the same holiday period, you can do this at no charge only if you approach us to make the relevant arrangements before the commencement of our school holiday program.

Any transfer of booking made before the school holiday period commences and before forty-eight (48) hours prior to the workshop is free of charge, otherwise, a $10.00 administration fee applies.


 Adults Paint and Sip Event

1.5             Refund, cancellation and reschedule policy for Adults Paint and Sip

a.         All cancellation of booking and rescheduling will incur a $10.00 administration fee per person for each seat that you have booked (unless you advised us 48 hours prior to the date of the confirmed event). We do not provide refund.

b.         No reschedule fee with at least forty-eight (48) hours’ notice prior to your confirmed event. If you have notified us that you wish to cancel your booking at least forty-eight (48) hours prior to the event date, we can reschedule your booking free of charge. We do not provide refund.

c.         With no notice given or no shows will be charged the full amount of the event without refund. We will not provide you with a refund (in any form) if you did not show up for the event for any reasons or without any prior notice.

d.         We reserve the right to cancel any booked event (on rare and reasonable circumstances). If Welight Art Space cancels any paint and sip workshop, and we will offer you the option to obtain a full refund or to reschedule the event.

 

2                 Use of your Creative Kids Vouchers

The Creative Kids vouchers cannot be refunded once it has been redeemed nor can the Creative Kids Vouchers be retrospectively applied to a payment that you have already paid.

 

3                 Payment of fees

3.1       The fees for the relevant classes, workshop and event are listed on our website. Payment of the fees in full is required at the time of online enrolment to secure your place and booking. We accept Visa and Mastercard credit card as online payment method.

3.2      If you do not wish to enrol via the webpage, you can enrol in person at our office. We accept Cash, Visa, Mastercard or AMEX card, EFTPOS, and online direct deposits into our bank account. Fees are inclusive of GST and tax receipts will be provided on receipt of payment.

 

 

4                 Consent to being photographed

4.1     You acknowledge that we will take photos and videos of you or our students during classes, workshops and exhibition of artworks. These photos and videos are used for Welight Art Space’s marketing purposes such as advertisement, brochures, social media, editorials and website. These photos will not be sold to any third parties and will be used exclusively by and for Welight Art Space.

 

4.2     By enrolling in any classes, workshop and events, you authorise, consent and grant Welight Art Space the right to:

a.         Record you (photo and video form) during classes, workshops and exhibitions,

b.         Edit the photo at Welight Art Space’s discretion; and

c.         Publish the photo and video on our website and promotional materials.

4.3             You agree:

a.         that you will not receive any remuneration from us; and

b.         to release Welight Art Space from any infringement or violation of personal and/or property rights.

 

4.4             If you do not wish to grant consent to us taking your photos and video, please provide us with written notice in advance before your enrolment or prior to the commencement of classes, workshop or event.

 

5                 Student conduct

5.1             Welight Art Space is a shared space and we expect students to respect each other, fellow artists, teacher, other’s artwork and property. We will not tolerate any form of discrimination, bullying or harassment. Students deemed to be exhibiting inappropriate, disrespectful or disruptive behaviour may be removed, suspended or expelled and we reserve the right to investigate into any of the complaints.

5.2             You or your children may be suspended from attending your class, workshop or event whilst we investigate into the complaint(s) about you or your children.

5.3             Cleanliness

Please note that you share the responsibility to ensure that classrooms and common areas are safe, clean and tidy.

 

5.4             Punctuality

Out of respect to other students and tutors, you are required to be punctual for all your booked classes and workshop. Minors (children under age of 18) must be escorted to and from the art school by a parent or legal guardian, and to sign in on arrival and be picked up on time by the end of the class or workshop.

6                 Liability and Indemnity

6.1             You agree and warrant to indemnify Welight Art Space against liability for all loss (including but not limited to incidental, special, consequential, exemplary or indirect), damage, injury to persons or property caused by you, your children, your employees, and the amount of all claims, damages and cost incurred by Welight Art Space will be made good at your expense.

6.2             To the extent permitted by law, Welight Art Space excludes all liability for any loss or damage (actual, special, direct, indirect and consequential) in any kind and whatsoever nature arising out of or in any way connected to our services and our premises.

 

7                 Health and Safety

7.1             Please be noted that you or your children will be exposed to and have direct contact to various kind of art or painting material. You are responsibility for identifying whether you are allergic to any of those material and notify us accordingly. To the extent permitted by law, Welight Art Space excludes all liability and will not indemnify for any loss of damage that you or your children incurs.

7.2             Students with any existing medical conditions, allergy or disability must notify the staff of Welight Art Space on enrolment, and it is your sole responsibility to notify us if you require us to accommodate you or your child’s circumstances during classes or workshop. Welight Art Space reserves the right and discretion to decide the method of implementing any reasonable arrangement to accommodate you or your child.

7.3             You agree to pay and/or reimburse Welight Art Space for any expenses that we incur as a result of providing medical assistance to you and your children, for example, calling an ambulance.

 

 

8                 Privacy

8.1  We collect and store your personal information when you enrol into Welight Art Space’s classes, workshop or events. We only collect your personal information for the purpose of responding to your enquiries, process your registration, booking and enrolment, and sending you our promotional material. If you do not wish to receive any email from us containing promotional material, please notify us that you wish to unsubscribe from our mailing list or you can simply unsubscribe at the bottom of our email.

8.2   All information that you supply to Welight Art Space may be disclosed to our employees, contractors and our website provider, other than the aforementioned, we will not disclose your information to any other person without your express consent, except where required by law. We do not retain any credit card information that you provide.

 

We thank all students and parents for their understanding and support towards the efforts of Welight Art Space and the art tutors who make time, commitments and investments to prepare well in advance of scheduled workshops and classes.
